Some Mainland China lawyers say that the definition of the draft Law on Protection of Personal Information should be more specific

(09 Nov) The China Standing Committee of the National People's Congress (NPCSC), which reviewed the draft Law on Protection of Personal Information last month, is now conducting a public consultation that closes on the 19th of November. Some Mainland China lawyers are of the view that the definition and enforcement of personal information in the Draft should be more specific and clear. Some criminal lawyers estimated that the Chinese Authority would introduce corresponding administrative regulations to improve the whole system. However, if the mandatory collection of sensitive personal information is involved, disputes between the Chinese Government and the public may easily arise.

Canada Promised for Receiving Hong Kong teenagers, but two Large Opposition Parties Call on Trudeau to Do More

After over a year of the Hong Kong “anti-extradition law” protest, the Canadian government finally introduced policies to assist Hongkongers immigrating to Canada. However, the new policies are mainly targeting at students, disappointing many Canadian opposition lawmakers who have been running around for Hongkongers. New Democratic Party member of Parliament Jenny Kwan described that the Canadian Prime Minister Trudeau was slow to respond, and the new policies are not favourable to Hongkongers who intend to apply for refugees. The opposition Conservative Party member Raquel Dancho requested the government that they should sanction the Chinese and Hong Kong officials who harm the Hong Kong human rights.

Canada introduced “resettlement policy for Hongkongers” on last Thursday (12th November), the Hong Kong teenagers who graduated in universities in the past five years can apply for a three-years Canada working visa. Teenagers only require to work for a year and to pass the language test for permanent residency application. However, there is no specific implementation date or timetable yet.

Jenny Kwan, a New Democratic Party Member who born in Hong Kong and migrated to Canada when she was 9, said that after the abolishment of opposition members of Hong Kong Legislative Council, the situation in Hong Kong has deteriorated. However, Trudeau only “announced” the policies launch five months after promising to help Hongkongers that the response was slow and felt very disappointed with that. “The implementation of the plan, which mainly focuses on helping students, will have to wait until next year. The Immigration Minister did not provide details nor mention whether the plan will help the teenagers who have been prosecuted by the National Security Law”.

All Department Heads from iCable News Quit After the Company Sacks 40 Staff in News Team

On Dec 1, 2020, iCable fired 40 staff in their news team with immediate effect. Almost all staff from the reputed investigative program "News Lancet", known for their sharp, critical angle, were sacked, triggering the staff to surround the management office.

Among the 11 staff in the China News team, one was fired and the other 10 including the head Szeto Yuen protested with their resignation.

The incident continued to escalate. According to Citizen News, a total of 5 department heads from Local News, China News, Financial News, International News and the Editorial Team have announced their mass assignation.

WHO official urges China visit on virus origin.

The head of emergencies at the World Health Organization (WHO) says it’s “extremely important” for its international team to visit China to look into the origins of the coronavirus.

Ten months after the declaration of Covid-19 pandemic, WHO is still working to deploy an international team of experts to China to visit the suspected epicentre in the city of Wuhan and surrounding Hubei province.

“Clearly, we all need to understand the origins of the virus. We all need to understand where it has come from, not least to understand where it may re-emerge in the future,” Dr Michael Ryan said.

China scrubs internet posts on positive economic impact of Covid-19

Li Ling, head of the China Health Development research centre at Peking University, estimated that efforts to fight the pandemic would be responsible for earnings of Rmb67tn in 2020, or about two-thirds of China’s gross domestic product.

Online censors had acted and a number of articles and posts mentioning Ms Li’s calculations had been removed, leaving behind error messages or notices that the content had been deleted by its author.

Li later defended himself against critics that his speech was “patriotic” and had been “to extol the splendid success of China’s struggle against the epidemic, and to criticise the major failures of America’s”. His comments have not been censored.

5 Heads of i-Cable News and Entire China News Team Resign En Masse Against Laying Off of Journalists

On Dec 1, 2020, i-Cable News laid off 40 employees with immediate effect, angering staff at the TV news station.

According to the source, the head of i-Cable China News Szeto Yuen was the first to protest by resigning, followed by the rest of the journalists on the team. In total, one journalist was fired, and the other ten on the team, including Szeto, quit in protest. Some members from other teams also resigned to protest against the company's decision.

A senior journalist told Stand News that they felt it was better to take action together and alert the public that i-Cable News had deteriorated, instead being slowly and quietly weakened. He added that it was not worth staying anymore, since the management has intervened in the reporting again and again.

After recent salary cuts, a few junior journalists were only earning around 13,000 HKD a month. Operations at i-Cable News has nearly ground to a halt on Dec 1, 2020.

An upper-mid-level manager said that the top management had not consulted any department heads about this round of firing. The video editors and graphic designers who were fired were widely praised for their abilities by their colleagues. Many of the fired staff played important roles in middle and senior management.

i-Cable China News had investigated corrupt practices in China many times, and followed up the situation of activists; the team was long regarded to be in high reputation.

They were among the few public broadcasters in Hong Kong with a dedicated team for China news; its 11 members, including the team leader, are responsible for the daily China news reporting and the night-time “China Report”. They also have journalists regularly stationed in Beijing and Guangzhou.

Their most visible reporting in recent years were the 2012 interview of pro-democracy activist Li Wangyang, who served the longest sentence among those from the 1989 Tiananmen protests.

After broadcasting the interview, Li died in Daxiang Hospital, where he was found dead and leaning against the window, with a rope wrapped around his neck, though his legs were touching the ground. The Chinese authorities initially reported that he committed suicide, but they later changed the conclusion to “accidental death”. This incident caused strong repercussions in Hong Kong, with over ten thousand Hongkongers marching in protest, believing that Li "had been suicided".

In 2017, journalist Lam Kin-Shing covered the memorial at sea for Liu Xiaobo by a group of dissenters, the event was broadcast on Facebook live. Afterwards, Liu’s friends were arrested by China police, and the driver hired by i-Cable China News was detained for three days. Lam was transferred back to Hong Kong and barred from reporting in China again; he resigned soon after.

At the early stage of the Wuhan Pneumonia outbreak last year, China News team sent journalists to Wuhan for investigation. They were among the very few Hong Kong media who sent journalists to Wuhan for on-site reporting.

Moreover, the iCable China News team's reporting had won many awards, including Human Right Press Award and awards in the School of Journalism and Communication in CUHK. Their award-winning programs included “Damage of Nuclear weapons tests”, “The land acquisitions incident of Wukan village”, “ Li Wangyang”, “Even China police are protesting”, “Decoding the future of 30 years later”, “Tiananmen massacre 30th year anniversary”, “Poison milk powder: 10 years later”.

Over 20 HK Police Deployed to Arrest Baptist University Students' Union President

At 7am on Dec 2, 2020, over 20 police arrested Fong Chung-yin, the president of Hong Kong Baptist University (#HKBU) students' union, at his home.

Fong is charged with "obstructing justice, refusing arrest and possessing aggressive weapons" and is detained at Shatin Police Station.

On Aug 6, 2019, Fong was aggressively arrested by the police after purchasing 10 stargazing laser pointers in Sham Shui Po. The Hong Kong police had for more than once claimed that laser pointers were "weapons".

Catholic Newspaper Makes Unauthorized Deletions in Article Critical of HK Government and Police

An article by the Justice and Peace Commission of the Hong Kong Catholic Diocese was printed in the Catholic newspaper Kung Kao Po, but with statements removed without the commission's consent.

The deleted content included criticisms against the Hong Kong government's decisions during the Anti-ELAB movement, as well as the police's lack of respect for human life.

In a response to media, Kung Kao Po said they hope the Commission would respect their editorial freedom, and denied that they were ordered to censor their content.

The article, titled "What Price a Life?", was printed in the Justice and Peace Commission column in issue #4006 of the newspaper.

According to a statement by the Commission, the newspaper deleted parts of the article, and published the edited version without their consent: "We hereby solemnly declare that the edited article has no relation to us."

The commission had contacted the paper multiple times to express that they did not accept the edit, "yet their chief editor did not respect our wishes, and published in our column the edited version, which we do not agree with. We deeply regret the paper's decision."

The original text provided by the Commission shows that three sentences were deleted by the paper. These included statements critical of the government and police force during the anti-ELAB movement:

"Yet the government had also made decisions during the anti-ELAB movement that caused the public to worry that a humanitarian crisis may be developing."

"However, the non-elected HKSAR government has time and again neglected human dignity; if the police force, which ought to defend the safety of the people, had neglected the value of human life; how can such a Hong Kong be repaired and restored?"

"Even though speaking the truth today may cause an 'even higher level' threat to be brought down upon us, we can no longer fall back and compromise."

On Nov 23, 2020, the Foreign Minister of the UK, Dominic Raab, released a six monthly report on Hong Kong. He was considering whether to pull out British Judges who serve as the non-permanent judges at the Hong Kong Court of Final Appeal.

Philip Dykes, Chairman of the Council of the Hong Kong Bar Association, said that Beijing has slowly taken control over the official institutions of Hong Kong and their next target is likely the independent judicial system of Hong Kong.

Dykes worried that the Basic Law will be amended to disqualify judges.

Since the implementation of the National Security Law in July 2020, concerns have been raised internationally towards Hong Kong government’s suppression over dissidents.

Apart from 4 lawmakers being disqualified by Beijing, teachers were disqualified by the Education Bureau, and journalists who conducted registry search were arrested.

In the Report, Raab indicated that he is going to review “whether it continues to be appropriate for British judges to sit as non-permanent judges on the Hong Kong Court of Final Appeal”.

In an interview with Financial Times, Chairman of the Council of the Hong Kong Bar Association, Philip Dykes, said, “China has now turned its attention to Hong Kong’s juridical system. They might implement policies to instill judges the idea of patriotism”.

A CUHK student fled to Germany has a message to protesters, “Take care of yourselves, fight in your own way.”

A 22-year-old female CUHK student shared her exile experiences in Germany and her tough time, staying away from family and suffering from the sexual assault in refugee camp. Although she is eligible for a three-year residency permit in Germany, she feels conflicted while thinking of other protestors still in Hong Kong.

She hopes the German government can simplify the procedures of applying asylum for Hongkongers in the future and emulate the other counties in launching “lifeboat schemes”.

“Prepare for the worst, hope for the best,” she tells other protestors.
