Families of 12 Hong Kong Youth demand for open trail
Feared of a secret trail and that Chinese and Hong Kong Authorities might impose administrative measures to forbid them from attending court hearing, families of the 12 Youth being detained in China Yantin Detention Center issued an open letter today (21 December) asking the authorities for assistance and other discretionary arrangements.
The Shenzhen Yantian District People's Procuratorate announced on December 16 that 10 of the 12 detained Hongkongers will be formally charged, and a closed-door hearing will be held for the other two to decide whether the charges will be dropped.
Families stressed in the Open Letter, “it has been a week, … the authorities have not provided us with the indictment or any case papers, we have no way to know the details of the charges against our children and the proposed sentences.”
Families raised 5 demands in their open letter;
• Open the trial to the public and webcast the trial;
• Protect the right of family members to attend the trial by informing the trial date no less than 20 days before the trial date, so that early testing and other arrangements can be made;
• Or allow test results to substitute the two-week quarantine requirement for the entry of the family members;
• Provide the families with the Indictment and records of interview, and disclose the list of members of the panel and the prosecutor to the public;
• Provide the identity and contact information of all government-assigned lawyers; and
• Protect the right of defense of the 12 Hongkongers and allow the family-appointed lawyers to defend for them.

"Bull" Tsang Kin-shing (of the League of Social Democrats) invited citizens to sign a large banner at the booth. Citizens wrote down various words of encouragements: "Add oil, hands and feet!" Dec 16, 2020 marks the 116th day into the CCP government's jailing of 12 pro-democracy HongKongers after captivating them at sea in August.
China charged 10 of them with "Organizing Other Persons to Croos Borders Illegally" and "Crossing Borders Illegally" on 10 of them, while the 2 juveniles detainees would be put into a "closed hearing".
The #Save12HKYouths Concern Group critized the Chinese authorities for refusing the families' request for meeting and defense. The group did not believe that the "offically assigned lawyers" by the Chinese government would prioritize the interests of the litigants, and worried that they would be submissive to the authorities, making the defense unfavourable to the 12 HongKongers.
The Concern Group also said that the family members intended to go to Shenzhen to attend the hearing, but were worried that they could not make it in view of the 14- day quarantine policy while the date for the hearing was yet to be confirmed.
The Concern Group demanded the Chinese authorities to provide indictment to the families, and allow their own entrusted lawyers to meet and represent the 12 Hongkongers and to participate in their Defense.
They also demanded an open hearing, an early notification of the hearing date, as well as exemption of quarantine when they enter Shenzhen borders for the hearing.

Hongkongers Send Christmas Cards to Support 12 Pro-democracy Protesters Detained by China; HK Student: We Shoulder the Pain Together
The "Save 12 Hong Kong Youths Concern Group" recently launched a campaign to send Christmas cards to the 12 Hongkongers who have been detained by the Chinese authority for over 100 days.
Yau Tsim Mong District Councilor Chu Kong-wai organized the Christmas card station on December 18, 2020 in Mong Kok, hoping that Hong Kong people would keep paying attention to the 12 detainees to protect them from inhuman treatment.
Candice, a secondary school student who joined the campaign said that she hopes to shoulder the pain experienced by the 12 HongKongers, so that they know that Hong Kong people have always been by their side,
"I hope that they can insist on their ideas, they have done nothing wrong." The HKSAR government earlier stated that the Liber Studies subject should be reformed. Candice said that the Liberal Studies teacher mentioned the 12 Hongkongers before in class but did not discuss it in depth, "I could feel the pressure borne by the Liberal Studies teacher, but s/he told us that s/he would teach us until nothing was allowed to teach."
Mr. Ho, who is in his 50s and works in the air transport industry wrote on the Christmas card the words, "May Heaven destroy the CCP".
Regarding whether his Christmas card can be delivered to the 12 Hongkoners, Mr. Ho said, "I didn’t expect this card could be successfully delivered when I wrote these words, but I will still say what I want to say.".
Mr. Ho said that his friend had been unjustly imprisoned in China for eight months, which has made him no longer believe in the judicial system of China.

On the Christmas Day of 2020, the families of the 12 pro-democracy Hongkongers detained in China not only could not see their loved ones; seven families also received a last-minute notice from the lawyers appointed by the Chinese Government that the trial of ten of the 12 Hongkongers would take place on Dec 28, 2020, which was in less than 3 days including the public holidays.
Among the 12 Hongkongers detained by the Chinese authorities since August 2020, ten of them will face trial on Dec 28, 2020 at the Yantian Court in China, but only seven families received such a notice.
The Chinese court told the media that it belonged to a "secret case" and no public and media would be allowed to audit. The trial is also not listed in the timetable of the Yantian People's Court.
The #Save12HKYouths Concern Group released a statement on Dec 25, 2020, demanding the delivery of confirmed, open and clear information of the trials of the 12 Hongkongers. They also demanded the presence of their families, the lawyers hired by their families, Hong Kong and international media and diplomats from different countries to be allowed in court.

Tang Kai-yin was sentenced to 3 years of jail and fined for RMB20,000. Quinn Moon was sentenced to 2 years of jail and fined for RMB15,000. The remaining 8 adult detainees were sentenced to 7 months of jail and fined for RMB10,000 each.
The Chinese authorities trialed them on Dec 28, 2020, claiming the hearing was "open" but foreign diplomats and reporters were refused entry. According to the Chinese court, all defendants pleaded guilty.
After more than 4 months of detention with trial, the Chinese authorities deported the two underaged Hongkongers to Hong Kong on Dec 30, 2020, claiming that the two had confessed. The Hong Kong police gave their response on the same day, "they can come back to face more serious charges."
Cheng Tsz-ho (鄭子豪)'s father:
"It doesn't matter if they sentence my son to 1 day or 7 months; every single day is a wrongful jailing. On August 23, the Hong Kong government sent two planes to take turns "escorting" the 12 of them to China. That's why I think every singe day he spends there is wrongful."
Wong Wai-yin's mother:
"I hope China can tell us soon about the visitation: how many minutes do we get? What's the procedure? Can we give them winter clothes? Can I buy food for my son? Please, China, tell us soon. As for the Hong Kong government, I'm not hoping for anything from them."
Li Tsz-yin (李子賢)'s mother:
"They said he'll be jailed for 7 months. I think it's too much. I saw that the two younger ones were allowed to come back [to Hong Kong] today; I thought my son would be allowed too.
Now that it's 7 months, we'll be planning to go visit them. I really hope the authorities could tell us how to arrange the prison visit."

US Secretary of State #MikePompeo called for the immediate release of 10 Hong Kong activists who were sentenced to between seven months and three years in jail by a Chinese court.
The ten Hongkongers were arrested by the Chinese authorities arrested at sea as they reportedly fled the city and tried to reach Taiwan by speedboat in August 2020.
On December 30, 3020, the Chinese court in Shenzhen sentenced eight of the Hongkongers to seven months in jail, one to two years and one to three years. Two underage Hongkongers were handed over to Hong Kong police, since they have been detained in China in August 2020.
Pompeo said, "The ‘Hong Kong 12’ who tried to flee this tyranny deserved a hero’s welcome abroad, not capture, a secret trial and prison sentences."
The United States strongly condemns the Shenzhen court’s actions and calls for the 10 members of the group who were sentenced to jail terms to be immediately and unconditionally released.”
“The CCP’s persecution of the Hong Kong 12 – two of whom were juveniles at the time of their arrest – exposes once again Beijing’s brutality, blatant disregard for the international treaties it has signed, and its disdain for the rights of the Hong Kong people,” Pompeo added.
Pompeo further expressed in the statement, " A regime that prevents its own people from leaving can lay no claim to greatness or global leadership. It is simply a fragile dictatorship, afraid of its own people."

On Dec 30, 2020, the Chinese court in Yantian, Shenzhen sentenced 10 pro-democracy Hongkongers to Chinese prison for seven months to three years. Another two Hongkongers, who were also captured and detained with the rest of the group since August 2020, were repatriated to Hong Kong, for they were under 18 of age. During their detention so far, the Chinese authorities have barred the 12 Hongkongers from having any external contacts including family and lawyers' visits.
Some detainees' families set off to Shenzhen on the morning of Jan 3, 2021, hoping to complete the quarantine isolation procedure and visit the prisoned as soon as possible.
However, the Justice Bureau of Shenzhen in China amended the visit arrangement in Dec 2020, by "temporarily suspending" the acceptance of foreign personnel on-site visits.
Ms. Chow Hang-tung, a barrister who has assisted the Hong Kong youths’ families, predicted that the families would be considered as foreign personnel, while concrete arrangements need to be further understood.
Former pro-democracy lawmaker Eddie Chu Hoi-dick, who has been supporting the 12 Hong Kong youths’ families, said that the family have departed and arrived in Shenzhen as of 5pm on Jan 3, 2021.
The “12 Hongkonger Concern Group” also stated on the same afternoon that three family members have arrived at Shenzhen and will undergo the 14-day quarantine period. They are going to seek for prison visit right after the first trial’s 10-day appeal period is over, and the judgement has taken effect.

British Lawmakers Condemn China for Breaching Sino-British Joint Declaration
In the 12 Hong Kongers case, 10 adult defendants were sentenced to seven months to three years in prison in Yantian, Shenzhen on December 30, 2020. The other two minors were handed over to the Hong Kong police. The Hong Kong police stated that they could charge them with offence of failing to surrender to custody as shall have been appointed.
The “All-Party Parliamentary Group Hong Kong” of the British Parliament issued a statement on Dec 30, 2020, criticizing the incident as a fierce attack on Hong Kong people’s freedom and is a repeated violation of the "Sino-British Joint Declaration”. The group reiterated that Britain will continue to fight for freedom for Hong Kong people.
Baroness Bennett and Alistair Carmichael, co-chairs of the "All-Party Parliamentary Group Hong Kong” of the British Parliament, said that the arrests represented how Hong Kong people’s freedom were being attacked and was another "shocking" violation of the Sino-British Joint Declaration. “It seems likly they are hoping to warn all the pro-democracy activists, politicians and leaders and show that these people cannot escape the strict National Security Law through these arrests,” they said.
The group states that they hope to send a clear and firm message to Hong Kong people: "We in the UK will not stop fighting for your freedom. We welcome BNO passport holders to live in the UK, where your rights and freedoms will be protected instead of being weaponized.”
The organization "Stand with Hong Kong" also stated that the sentence was unacceptable. They believed that the only "crime" committed by these brave young people was to speak out for democracy and freedom and to protect their own safety. The organization calls on the international community to hold the Chinese and Hong Kong authorities responsible for their violations of the international human rights law.

Albert Ho, vice-chairman of Hong Kong Alliance in Support of Patriotic Democratic Movements of China, with 9 other members of the Democratic Party were accused of organising and knowingly taking part in an unauthorized assembly and other charges on October 1, 2019.
All 10 pro-democracy figures pleaded guilty before the hearing. They were then remanded and the sentencing was set to be announced on May 28, 2021.
Ho’s former assistant and currently Tuen Mun District Councillor, Beatrice Chu, posted on her Facebook page that Ho was unwell when she visited him.
Ho said that he has been lacking sleep because he was put in an individual cell that was poorly ventilated.
On May 23, 2021, Chu posted an update on her page that Ho had been moved to a cell with better ventilation, but he still had poor appetite and looked depressed.
She mentioned that Ho’s grandchild wrote a letter to cheer up Ho on May 22, 2021. His grandson said he missed Ho much and that he understood Ho’s life in the cell is “bored and hot, but you have to stay strong! We all love you!"
Ho's grandson also told Ho that he would take good care of Grandma and not to worry.
