15 Pro-Dem Legislators' Stay in #LegCo to be Decided by Public Opinion Poll

The pro-democracy legislators' decision of whether or not to stay in the Legislative Council for the next year has been up to debate, after the Carrie Lam adminstration postponed the Legislative Election by a year.

15 pro-democracy legislators had decided to use a public opinion poll to determine their stay in the Legislative Council, with the Democratic Party entrusting the Hong Kong Public Opinion Research Institute (#HKPORI) to conduct one.

Chairman of Democratic Party Wu Chi-wai stated that they would leave if half of all participating supporters believes that the pro-democracy camp should leave the Legislative Council.

Participating legislators include seven from the Democratic Party, five from the Civic Party, Claudia Mo from HK First, Fernando Cheung from the Labour Party and Shiu Ka-chun from the Social Welfare functional constituency. Leung Yiu-chung from the Neighbourhood and Worker's Service Centre also expressed that he would take the polls to account.

HKPORI Director Prof. Robert Chung believes that the Institute had decreased the gray area in the current threshold, but stated that "politically neutral" participants would also be taken in account, causing the percentage for those in favour or against the stay to be both not more than half.

When asked about the protocol for such an event, Wu stated that they would take different information into account before making a political judgement.

As for why they were only taking supporters of the participating legislators into account, and not towards all pro-democratic supporters, the Democractic Party stated that it had once considered for all supporters of the pro-democratic camp to participate, but Prof. Chung denied the request stating that the legislator's citizen authorisation came from their supporters.

Prof. Chung had been adamant on Friday, stating that were pro-democratic legislators not tied down, they should not have asked for authorisation.

The #DemocraticParty suggested a ’35+ #PrimaryElection scheme’, hoping to secure over half of the seats in the #2019LegislativeCouncilElection, yet the election was cancelled later. The #NationalSecurityDepartment of Hong Kong Police Force arrested around #50Democratics.

At around 6 in the morning, the Democratic Party stated on their Facebook that ex #LegCoMember #JamesTo Kun-sun, #AndrewWan and #LamCheukTing were arrested at their homes for #IncitingSubversinoOfStatePower through suggesting the ’35+ Primary Election scheme’. #GaryFan Kwok-wai from the #NeoDemocrats was also arrested, and he stated on his personal Facebook that ’The Charge is joining the Primary Election’.

Police ordered Stand News to submit documents to assist investigation into alleged national security law case

Police arrived at the office of Stand News this morning and issued a court-mandated production order, demanding documents for investigation into an alleged national security law case, to be submitted within 7 days. This came on the morning of more than 50 arrests related to the pro-democracy primary election last July.

Police did not search the premises nor made arrests at this point. Stand News' chief editor said that he will consult their lawyer before deciding on their course of action.

#MassArrest continues in Hong Kong as more pro-democracy activist arrested suspected violation of security law

Multiple sources stated that Gordon Ng Ching-Hang, who promoted the movement of “3 votes and 3 not vote” with his Internal nickname, Lee Bank-Lou, has been arrested.

At around 11am, a write-up was posted on the facebook of Mike Lam, owner of AboutThai, saying "my boss has been arrested."

Lam was one of the candidates of 35+ Primary Election.

Around 50 people linked to the polls in one way or another were arrested on Wednesday morning, including several former lawmakers.

Treasury of Power of Democracy John Clancey arrested, Police searched Ho Tse-Wei & parents firm


On Jan 6 (Wed), police had conducted mass arrest of pro-democracy candidates of “35+ Primary Election” for violating National Security Law. Fifty people were arrested. According to sources, a large number of police officers arrived at Ho Tse-Wei & partners firm. Police were in the firm when reporters came.

Reports of “Ming Pao”, “Hong King Citizens News” and other sources stated that Clancey John, Treasury of Power for Democracy , was arrested. Police went to his office, Ho Tse-Wei & Partners, to conduct searching.

Clancey John is a HongKonger holding an American passport, and also a human-rights lawyer. He is Treasury of Power of Democracy, which has assisted pro-democracy camps for LegCo and district council elections, including “35+ preliminary election” held in early 2020. Also, he is Secretary of International Affairs of China Human Right Lawyer Concern Group and Chairman of Asian Human Right Commission.

Besides the mass arrest of the organiser and candidates of the "35+ Primary Election", the police also searched the office of the Hong Kong Public Opinion Research Institute (PORI) located in Wong Chuk Hang.

PORI assisted in the technical operation of the Primary Election held last July.

Vice president of PORI, Kim-Wah Chung, indicated that the personal data of the roughly 600,000 voters was already completely destroyed a few days following the Primary Election.

According to Chung, hard disks that stored the first 4 digits of the voters' HKID card and all related data were crushed by machines and no data was left behind, therefore voters should not worry about their information being compromised.

Chung criticised the government's intention to create white terror and intimidate everyone. He also thought that if a country is so fragile that even organising a primary election is considered "inciting subversion of state power," the country should review its system, rather than just arresting everyone who took part in the primary election.

He emphasized that the primary election was held only as a solution to an internal issue of a certain party, and the results had no legal effect; rather, it was just a gentleman’s agreement among candidates. He added that every individual, group or organisation should have the right to use various methods to address internal affairs; and the idea that the primary election incited subversion of state power was unconvincing.

The #EuropeanUnion Office to Hong Kong and Macau posted on Twitter on the evening of April 1, 2021 to express great concern about the ongoing prosecution of political figures in Hong Kong.

The Office also said that it had sent staff to listen to the hearing of the 7 democratic activists who were found guilty on April 1, 2021 and would continue to monitor the development of the situation for possible future actions.

On August 18, 2021, the Civil Human Rights Front (#CHRF) held a "running assembly" in #VictoriaPark in Hong Kong. Martin Lee Chu-ming, founding chairman of the #DemocraticParty, Jimmy Lai Chee-Ying, founder of #AppleDaily, were among the 7 pro-democracy activists who have been convicted of organizing and participating in unauthorized assembly.

Charles Whiteley, Deputy Head of the European Union Office of Hong Kong and Macau, was also present in court on April 1, 2021. He mentioned that the EU is highly concerned about these cases and will closely monitor the situation in Hong Kong.

On August 7, 2021, Wen Wei Po, a newspaper controlled by China's Liaison Office in Hong Kong, claimed that the Vice Chairman of the Democratic Party in Hong Kong #LEEWingTat were seen in the airport boarding a Cathay Pacific flight to London on August 6. The pro-China newspaper said Lee "will not return shortly".

LEE's wife #CHANShuYing confirmed the news but didn't give more details. CHAN said Lee would speak for himself, when necessary, "I won't speak on his behalf, even though I am his family". Chan is currently in Hong Kong..

LEE, aged 65, is a former legislative and district councilor in Hong Kong. He was also a co-founder of the United Democrats of Hong Kong, an initial body of Democratic Party, in 1991, together with SZETO Wah and HO Chun-yan Albert,

Lee was a legislative councilor until 2012, when he lost in the election repesenting the New Territories West. The defeat marked his step-down from his previous prominent position.

In April 2019, LEE was convicted for one count of "Incitement to Public Nuisance" during the Occupy Central Movement in 2014. He was sentenced to a 8-month imprisonment, with a 2-year suspension.

In June 2021, LEE "returned" yo the political scene by taking up the Vice Chairman role of the Democracy Party. He said he wanted to stablize the Party and its members.

Lee opposed the Democratic Party to organize candidates to participate in the coming Legco election in December 2021. In the political sphere, it was rumoured that Lee's return aims at barring the few young members of the Party from candidating themselves in the election.
