"Glory to Hong Kong" in the City's Annual Pride Parade

Hong Kong Pride Parade 2019 took place on November 16 this year. The letter of no objection granted by the police lasted until 6 p.m. Near the end of the assembly, participants sang “Glory to Hong Kong” together. They also presented the five-finger gesture and chanted protest slogans such as “Five demands not one less” and “Free Hong Kong”.

Chinese Government Lists "Homosexuality" and "Anal Sex" as "Unhealthy Sexual Behaviour" in Epidemiology Textbook

In a Chinese textbook of Epidemiology issued by the Chinese Communist Party government, under the definition of "unhealthy sexual behaviour", homosexuality was listed alongside "multiple sex partners" and "early exposure to sex".

In another version of the textbook, under the same category "unhealthy sexual behavior", "anal sex" replaces "homosexuality".

In sum, the Chinese state approved textbook has raised concern over the CCP's discrimination and misrepresentation of the GRSM groups.

LGBT+ organizations: Hong Kong Court Only Willing to Consider Same-sex Marriage Rights in Split Scenario and in Judicial Review

The High Court in Hong Kong issued a verdict where the denial of inheritance rights of spouses in a homosexual marriage were ruled unconstitutional on Sept 18, 2020.

Judge Anderson Chow Ka-ming stated that the regulations discriminate between heterosexual couples and same-sex couples and lack a reasonable explanation, which constitutes as illegal discrimination.

The Attorney General claimed that local marriage law grants heterosexual couples a special status, and the members of heterosexual couples must bear the legal responsibility to support their spouse, so they cannot be treated the same as same-sex couples.

Judge Chow disagreed with the claim, stating that the original intention of the law is to prevent the deceased from evading the responsibility of supporting others. These include those who the deceased has to take care of in terms of legal responsibilities and moral responsibilities, such as their parents and brothers and sisters.

Chow stated that the Attorney General's view is wrong and reflects that the law treats opposite-sex couples and same-sex couples differently.

However, the judicial review filed by Jimmy Sham, vice convener of the Civil Human Rights Front (#CHRF) was shot down by Judge Chow on the same day.

Sham challenged previous ruling of the court, arguing that the refusal to recognise overseas same-sex marriages is in violation of the Basic Law.

Some LGBT+ organizations believe that Sham's lost case is extremely unfair and ironic, criticising that same-sex couples could only submit judicial review on various marital rights one at a time, that "you could only win if you cut the case." They asked, "Is it impossible to enjoy these rights without judicial reviews?"

HK Court Denies Bail for 36 in
#47Activists Case, Assigned Judge: "Five Demands" Endander #NationalSecurity

Among the 47 pro-democracy activists facing allegations of “conspiracy to commit subversion” in connection with a legislative primary election in Hong Kong in 2020, 36 of them have been denied bail.

'#LongHair' Leung Kwok-hung and Jimmy Sham Tsz-kit, who are the vice-chairmen of the League of Social Democrats, were among the 36 who were denied bail.

Both of them applied for bail at Hong Kong's High Court earlier, but Judge Esther Toh Lye-ping , the designated judge of the #NationalSecurityLaw, refused to grant them bail and ordered to hold them back in custody.

The senior counsel Hectar Pun representing Leung and Sham pointed out that they have never advocated "Hong Kong independence", colluded with foreign forces or requested sanctions against the Chinese and Hong Kong governments, nor did they sign the "No Regrets" online statement.

Pun also said that Leung's local ties are strong, he has recently gotten married and is suffering from coronary heart disease, so the risk of absconding is low.

Moreover, Sham has always been active in the local #LGBT community, he married his partner who is also a Hong Kong resident in 2013, so Sham has no interest in leaving Hong Kong.

The judge issued her reasons on May 13, 2021, claiming there was no good reason to believe the two would not continue to act against national security.

The judge cited that the Department of Justice's arguments against bail, saying that Sham still stated he would continue to fight for the "#FiveDemands", in front of the police station upon his arrival on Feb 28, 2021. This indicated that there was no reason to believe he would not continue to endanger national security.

WeChat deletes Chinese university LGBT accounts in fresh crackdown
 
Chinese tech giant Tencent's WeChat social media platform has deleted dozens of LGBT accounts run by university students, saying some had broken rules on information on the internet, sparking fear of a crackdown on gay content online.

Members of several LGBT groups told Reuters that access to their accounts was blocked late on Tuesday and they later discovered that all of their content had been deleted.

"Many of us suffered at the same time," said the account manager of one group who declined to be identified due to the sensitivity of the issue.

Shanghai University has claimed the college to report LGBT student list, including their political perspectives and psychological condition 
 
Recently the sex niche in mainland universities and colleges has been repeatedly suppressed. After the LGBT student WeChat groups in multiple universities have been deactivated, the Shanghai University has announced to claim all colleges report LGBT student list with their information like political perspectives for “school investigation”. Some LGBT groups concerned, sex niche students will be continually supressed, the law scholars questioned the relevant investigation may illegal.  
 
In the recent days there was an online internal document from Shanghai University, which showed the school is using reason of “school investigation” to claim, “colleges have to reflect all information of LGBT student”.  
 
That form claims to report the gender and education background of LGBT student, but also claim to report their state of mind and psychological condition, including political position, study and research, daily life, interpersonal relationship, life plan, health condition, bad condition, mental disorder, and illnesses.

Natalie Geisenberger: I’d never returned to China

#NatalieGeisenberger, Germany’s #luge champion who took home a sixth gold medal at #WinterOlympic Games this year. She went to Beijing having previously criticised China and even considered boycotting.

“When there’s #HumanRights and the country’s stance on #LGBT, those issues should be taken into consideration by the #IOC (in selecting host nations).”

Geisenberger refused to speak about the human rights issue during the Games.

“You have to be careful when you say what, and where you say it, and I think many are feeling this way. Here on location, I think it’s better not to say too much,” she said on February 8.

Having now returned to Germany, she told newspaper Süddeutsche Zeitung that she will never return to China.

“It’s just not a holiday destination for me, and I wouldn’t go to China for a World Cup either,” Geisenberger continued saying, “it has nothing to do with the pandemic. I wasn’t there because I really wanted to go to China, but because the IOC decided that the Olympic Games would take place in Beijing.
