In the Name of Allah, the Entirely Gracious, the Exclusively Merciful


📩 Question:

What is the ruling of selling alcohol to the disbelievers in non-muslim lands? Some muslims sell it to them and they say: some scholars issued verdicts of its permissibility, and that I have good thoughts of Allah that he will forgive me?

📝 The answer:

Selling alcohol in non-muslim countries is haram, and it is not permissible, and it falls under the hadith:
(لَعَنَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْخَمْرِ عَشَرَةً: عَاصِرَهَا، وَمُعْتَصِرَهَا، وَشَارِبَهَا، وَحَامِلَهَا، وَالْمَحْمُولَةُ إِلَيْهِ، وَسَاقِيَهَا، وَبَائِعَهَا، وَآكِلَ ثَمَنِهَا، وَالْمُشْتَرِي لَهَا، وَالْمُشْتَرَاةُ لَهُ)
"Allah's Messenger (ﷺ) cursed ten people in connection with wine:
the wine-presser, the one who has it pressed, the one who drinks it, the one who conveys it, the one to whom it is conveyed, the one who serves it, the one who sells it, the one who benefits from the price paid for it, the one who buys it, and the one for whom it is bought."
Reported by Tirmidhi on the authority of Anas (رضي الله عنه).

And this verdict is false, that it is permissible to sell it to the non-muslims. This verdict is false and in contradiction with the legislative evidence. And no one from the companions of the Prophet, ever gave such a verdict, and the four famous schools of thought all said that it is haram, so it is not permissible for any muslim to rely upon such bogus Islamic verdicts which are in contradiction with the evidences.

Rather, ‘Umar bin al-Khattab (رضي الله عنه) used to take jizyah (tax) from the jews, and he told the companions:
إذا أعطوكم خمراً فلا تأخذوه، يبيعونه بأنفسهم
“If they give you alcohol, do not take it from them. Let them sell it amongst themselves”.
And he only took dinars and dirhams from them.

He said: “if they give you” i.e., alcohol as jizyah, don’t take it from them, “and for them is to sell it.” i.e they themselves will sell it. Then they will give you dinars in return for the jizyah.

And this shows that ‘Umar (رضي الله عنه) views the impermissibility of a Muslim selling alcohol or to receive it.

And if a Muslim is to do this, then his earnings are haram, and filthy, and the Prophet (ﷺ) said:
(لَا يَدْخُلُ الْجَنَّةَ لَحْمٌ نبَتَ منَ السُّحْتِ، النَّارُ أَوْلَى بِهِ)
“Flesh which has grown out of what is unlawful (i.e. income) will not enter paradise, but hell is more befitting for it”.
Reported by Ahmad on the authority of Jabir bin ‘Abdullah (رضي الله عنهما).

And it is not permissible for a Muslim to be persistent upon a sin, and to use forgiveness as a proof. For Allah (سبحانه وتعالى) says:
{ٱعْلَمُوٓا۟ أَنَّ ٱللَّهَ شَدِيدُ ٱلْعِقَابِ وَأَنَّ ٱللَّهَ غَفُورٌۭ رَّحِيمٌۭ}
"Know too that Allah is severe in punishment yet most forgiving and merciful."

So the one who is persistent upon sin without repentance, he is at threat for his sin, and as for the one who repents and has remorse, then Allah will forgive him.

As for staying upon the sin, persistant upon it, and to say: ‘Allah is The Most Forgiving, Most Merciful’, this is not allowed for him to do.

Is it allowed to indulge in zina (illegal sexual intercourse), and then say: ‘Allah will forgive me, I have good thoughts?’ or to disobey ones parents, and to hit ones father and mother, and then say: ‘Allah is Most Forgiving, Most Merciful’, or to indulge in zina with one's sister and then say: ‘Allah is Most Forgiving, Most Merciful, I have good thoughts of Allah’, we seek refuge with Allah from such speech, this kind of speech is bogus, contradictory to the legislative evidences, and it is not permissible for a Muslim to listen to such whisperings from the outcasted shaytan.
