In the Name of Allāh, the Entirely Gracious, the Exclusively Merciful

📩 Question:

The questioner says: Is the killing of the magician considered as one of the capital punishments that is obligatory upon those in authority?

📝 The answer:

Yes, its obligatory upon those in authority to kill the magicians, and this is what the companions of the Messenger of Allāh (ﷺ) did. ‘Umar Bin al-Khattāb (رضي الله عنه) wrote to Bajālah bin ‘Abdah, telling him to kill every magician, male and female. And Hafsa killed a slave girl who bewitched her. And ‘Uthmān (رضي الله عنه) didn’t rebuke her for killing her, although it didn’t sit well with him the fact that she didn’t inform him. And Jundub al-Khair, a man from the companions, killed a magician who bewitched people, so he killed him; he used to show people that he revives the dead, so he killed him and said: “Let him revive himself.” Hence, the killing of magicians is proven from a number of the companions (رضوان الله تبارك وتعالى عليهم). So its obligatory upon those in authority to kill the magicians. And if it did not come from the companions, then the ruling would have been taken from the Āyah. This indicates that he must be killed, because he is a Kāfir.

And should he be asked to repent or not? The companions did not ask the magicians to repent, so the magician is not asked to repent, he is killed directly, as the companions (رضوان الله تبارك وتعالى عليهم) did.

Some of the people of knowledge are of the view that he should be asked to repent, so whoever takes that view from amongst the judges, then he should not be rebuked. However, they lie and deceive. For he may claim to have repented and not repent, so based on this, what the companions did is the most correct, to kill them. Because he is a corrupter on earth, and you do not know his repentance, and if he repents sincerely, then it is between him and Allāh.

This case applies if it is raised to the ruler in the event of someone’s bewitchment, but if it is raised after the repentance that has been known about him, then he is not subjected to it.

📩 Question:

The questioner says: Is tawaf (circumambulation) around the graves Major Shirk?

📝 The answer:

If he intentionally does tawaf for the dead in the grave, then this is Major Shirk, for he is worshiping the dead by doing tawaf, and tawaf is worship for Allah جل وعلا, so it is not permissible to be done for other than Allah. If he does tawaf in worship, or to gain nearness for the one in the grave, then this is Major Shirk.

If he does tawaf, worshiping Allah by way of tawaf in that specific place, then this is Minor Shirk, a heresy, and a pathway to Major Shirk. For verily he is worshiping Allah with tawaf in the graveyards, and this is from the great heresies.

Tawaf in the graveyards is not worship, this is from the major heresies, and this is from the heretic actions which exits one from the Sunnah, it is an action, and it is in opposition with a principle from the principles of Ahluh-Sunnah wa al-Jama’ah. And for this reason the fundamental principles of Ahluh-Sunnah wa al-Jam’ah are not restricted to ‘Aqeedah! Because the evidences are clear cut and obvious that this action is Haram (impermissible).

And similar to this is praying by the graves, praying to Allah by the graves. The evidences are mass transmitted in the impermissibility of this action, and this person goes and worships Allah with this action. This heresy is also a major one and it leads to Major Shirk. It is not except footsteps from Shaytan, and before he knows it he is gaining nearness to the one in the grave, and he falls into Major Shirk.

Devoting oneself by the graves is also from the major heresies, and it is Minor Shirk, and Shaytan will cause him to slowly progress until he gains nearness to the one in the grave due to this devotion. Or he does certain acts of worship for the one in the grave, and by it falling into Major Shirk.

Shaytan comes to people through these methods; methods of gradual progression, footsteps, until he causes them to fall into Major Shirk. May Allah protect us and all the Muslims from this.

📩 Question:

The questioner asks: what is the ruling of following the scholars or the leaders in making halal that which Allah has made haram, or making haram what Allah has made halal?

📝 The answer:

If he follows them in that, whilst believing that which is haram is still haram, however he follows in action and did not change his beliefs with regards to it, and he believes the halal is still halal however he is merely following in action to please the creation, or to attain the worldly life by way of it, or the likes of this, then he is committing a great, major sin, however with the condition that it is in his actions and that he doesn’t verbalise disbelief, and he does not say that this is halal, and verbalise that it is halal, for if he says it is halal with his tongue, e.g. he says: intoxicants are halal, or riba is halal, this becomes apostasy. Rather that which is intended is following in actions only, the following is in action, such a person is committing a major sin.

As for if he becomes a follower of him in permitting and forbidding, and he makes haram that which Allah has made halal, or makes halal what Allah has made haram, so he follows him in this, making halal what Allah made haram, or making haram what Allah made halal, then this is major disbelief.

In regards to this Allah سبحانه states:
﴿اتَّخَذُوا أَحْبَارَهُمْ وَرُهْبَانَهُمْ أَرْبَابًا مِنْ دُونِ اللَّهِ﴾
“They have taken their rabbis and monks as well as the Messiah, son of Mary, as Arbaab besides Allah”

So them taking other Arbaab besides Allah, by making halal what Allah made haram, and making haram what Allah made halal, and they followed them in that. And it suffices that he verbalises with his tongue, if he enunciates with his tongue, and says with regards to what Allah has made haram: it is halal, and its imermissibility is from the clear cut well known rulings, and he makes it halal, then this suffices to excommunicate him from the religion. You should not say, what is his aqeedah? Rather the ruling is based on that which he made apparent.

📩 Question:

The questioner asks: What is the ruling of the one who says that the Prophet (ﷺ) did not convey everything he was commanded to convey?

📝 The answer:

The person who says this is a disbeliever due to rejecting the evidence in the Qur’an and the Sunnah. Allah says regarding the Prophet (ﷺ):
{ٱلْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِى وَرَضِيتُ لَكُمُ ٱلْإِسْلَـٰمَ دِينًۭا}
“This day, I have perfected your religion for you, completed My Favour upon you, and have chosen for you Islam as your religion.”

And in the Saheehayn on the authority of ‘A’ishah (رضي الله عنها) that she said:
من أخبركم أن النبي صلى الله عليه وسلم كتم شيئاً من الوحي فقد أعظم على الله الفرية ولو كان النبي صلى الله عليه وسلم كاتما شيئا لكتم هذه الآية:
Whoever tells you that the Prophet (ﷺ) concealed parts of the revelation, then they have uttered one of the worst lies against Allah. If the Prophet (ﷺ) was to conceal anything which was sent to him, then he would have concealed:
{وَإِذْ تَقُولُ لِلَّذِي أَنْعَمَ اللَّهُ عَلَيْهِ وَأَنْعَمْتَ عَلَيْهِ أَمْسِكْ عَلَيْكَ زَوْجَكَ وَاتَّقِ اللَّهَ وَتُخْفِي فِي نَفْسِكَ مَا اللَّهُ مُبْدِيهِ وَتَخْشَى النَّاسَ وَاللَّهُ أَحَقُّ أَن تَخْشَاهُ}
“And (remember) when you said to him (Zaid bin Harithah رضي الله عنه) on whom Allah has bestowed Grace and you have done favour "Keep your wife to yourself, and fear Allah." But you did hide in yourself that which Allah will make manifest, you did fear the people whereas Allah had a better right that you should fear Him.”
