Authorities Demand All Civil Servants to Pledge Allegiance; Refusal will Jeopardize Chances of Promotion

The Hong Kong Government announced new guideline recently requiring all new civil servants who joined on 1 July, 2020 or after to swear allegiance to the city and its mini-constitution, “Basic Law”.

On November 26, 2020, Secretary of Civil Service Patrick Nip Tak-Kuen clarified that all existing civil servants should sign declaration or take an oath of loyalty in one round.

Nip also stated that chances of promotion would be affected for those reject signing the declaration.

Nip stressed that he is in consultation with the Department of Justice (#DOJ) to discern whether those refused to sign the declaration of loyalty will be terminated.

Patrick Nip pointed out that advocating “Basic Law” and pledging loyalty to the Hong Kong government is an essential requirement and responsibility of a civil servant, which is also in line with social expectation.

Senior civil servants, including Director and permanent secretary of a department might be asked to take oath separately. In due course, details of the arrangement will be communicated to the Civil Service Union.

#NewZealand newly elected MP #JamesMcDowall vows in Cantonese at the Commission Opening as a nod to his family

As the new term begain in New Zealand's parliament on November 25, 2020, members of parliament (#mp) took their oath.

Members are allowed to state their oath in two languages if they wish, James McDowall from ACT New Zealand chose to take his vow in English and Cantonese.

McDowall explained his use of Cantonese as a nod to the other half of his family. McDowall uploaded his swearing-in video on his Facebook page, the video then went viral in Hong Kong.

In the video, McDowall firstly stated his oath in English, "I, James Samuel McDowall, swear that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, Her heirs and successors, according to law. So help me God."

He then repeated it in Cantonese:

"本人James Samuel McDowall,真誠發誓,定當依據法律,對女皇陛下伊麗莎白二世,及其繼承及繼位人效忠,並會盡忠職守。願上帝助我。"

Civil servants plan to file a judicial review of loyalty declaration requirement

The HKSAR government plans to issue a notice at the end of this month or early next month, demanding current civil servants to sign an oath declaring that they would uphold the Basic Law and pledge allegiance to the SAR. Those who refuse to sign may be dismissed or forced to retire. Secretary for the Civil Service Patrick Nip Tak-kuen said that refusing to sign the oath will be treated as cases of inappropriate action or harming public interest.

The chairman of the Union for New Civil Servants Ngan Mo-chau, who has previously stated that he will not sign the declaration, said that under the pretext of national security law, it is difficult to challenge the government's decision to require civil servants to sign the oath. However, they can still request a judicial review of the methods and procedures of the oath-taking adopted by the government.

On December 16, all 12 under secretaries and 14 political assistants sworn allegiance to the SAR and the Basic Law, setting the stage for the city's 180,000 civil servants to follow suit.

The oath-taking ceremony was held at the Central Government Offices and witnessed by Chief Executive Carrie Lam. The officials sang the national anthem and read out the oath, holding up their right hand.

Hong Kong Government Requires Civil Servants to Promise Political Allegiance

The Hong Kong SAR Government's Civil Service Bureau issued a notice to all different policy bureaus and departments on 15 Jan, 2021, requesting all civil servants hired before 1 July 2020 to sign a declaration.

Civil servants need to promise advocating the “Basic Law’ and Hong Kong Special Administrative Region (HKSAR) in four weeks. The authority stated clearly that if any civil servant rejected and ignored the declaration, they would be challenged and questioned their willingness to take basic responsibilities. The government will review case by case and decide if specific employment contract will be terminated.

About 200 civil servants asked to leave for refusing to pledge loyalty to the government

In a media interview, Secretary for the Civil Service #PatrickNip Tak-kuen said if public servants refuse to take the oath of loyalty, “it is up to them if they choose to leave the government. It is not a bad thing for our team of civil servants.”

During a press conference on March 8, he was asked again to confirm if there were already 200 public servants who refused to take the pledge, which was a new requirement added by the government in January.

He admitted there were “about 100-200 who did not pledge”. He said that he felt disappointed in them, and will follow the procedures to terminate those staffers.

Earlier in 2021, an oath of allegiance with no way back was sent to the 180,000 civil servants in Hong Kong. They had until the end of February to decide whether to remain loyal to the regime or to resign and leave. 

In February, there were rumours of waves of resignation in the government. The majority of those resigned were professionals such as health care workers in the Department of Health, social workers in the Social Welfare Department and engineers in the Housing Department.

In an interview with the media, the Secretary for the Civil Service, Nip Tak-kuen, revealed that about 200 people had not signed the statement of allegiance and the exact number would be reported to the Legislative Council later.

In Hong Kong, pro-democracy District Councillor To Ka-lun of the Yuen Long District Council resigned on April 6, 2021, as he refused to take the oath required by the government.

Hong Kong Government Questions the Oath of Seven Pro-democracy District Councillors

On September 10, 2021, the Hong Kong SAR government demanded directly elected district councillors on Hong Kong Island to take oath, pledging allegiance. They are the first batch of district councillors scheduled for oath-taking.

The authorities accused seven pro-democracy district councillors who swore oaths of allegiance of being "questionable".

The seven councillors are Clarisse Yeung and Leung Pak-kin from the Wan Chai district council; Wei Siu-lik, So Yat-hang, Chan Wing-tai and Lai Tsz-yan from Eastern district; and Southern district's Michael Pang.

Peter Choi, a pro-democracy district councillor who didn’t show up, has been immediately 'disqualified' and removed from his seat by the authorities.

16 pro-democracy district councillors have been disqualified from office after authorities ruled that their government-required oaths were invalid.

They are from New Territories West, and are the last batch of councillors to take their oaths, a new requirement created after the pro-democracy camp's landslide victory in 2019.

Across all 18 districts in Hong Kong, a total of 49 pro-democracy district councillors have been ousted due to their oaths being ruled as invalid. 6 councillors directly lost their seats.

In the district council elections in 2019, the democrats had won a historic victory, winning 389 seats among the 452 elected seats in the 18 districts.

However, the number of members of the Democrats has gradually decreased in the past 2 years, some due to prison sentences longer than 3 months, some due to the councillors themselves leaving Hong Kong.

It was the government's oath-taking requirement, however, that led to the largest drop in numbers of democratic councillors.

In July this year, the government made use of the media to indicate their intention to disqualify large numbers of district councillors, and those disqualified would have to pay back all of their salaries since taking office in 2020, a sum exceeding $1M HKD. In light of this threat, 260 district councillors have resigned.

US and EU Responded to the Mass Disqualification of District Councillors

#HKSAR government demanded all #DistrictCouncillors (DC) in Hong Kong to take an oath earlier. 55 DC lost their seats in total as 49 councillors in democratic parties were disqualified due to invalid vows. 6 directly lost their seats due to the absence of #oath. More than 200 DC had resigned earlier due to the oath request.

The US State Department issued a statement on Oct 21, keeping their concerns to the #HumanRights and the #Freedom in Hong Kong, including the continuous erosion of political participation, especially under the National Security Law (#NSL) which increases prosecution with political motivation.

The statement also said that the prosecution was directed to teachers, unions, lawyers, journalists, medical staff, student unions and citizens. The mass DC disqualification is simply to stop HKers to manage their homeland meaningfully.

US State Department again called Beijing and the Hong Kong authority to release people who are detained unfairly, and stop the suppression of peaceful civil organizations. They also pointed out that HKers and the energetic civil society are always the biggest resources in Hong Kong, as well as the foundation of being a successful international finance hub. The US will continue to support HKers, their rights and their freedom.

EU: Chilling effect occurs under NSL

The #EU External Action Service issued another statement on the same day, saying that HK government disqualifying most of the democratic councillors means denying the DC #election result in 2019. And that excluding the democratic parties from the political participation would weaken Hong Kong democratic governance structure.

The EU indicated that the pressure of civil society is increasing as many unions and organizations in Hong Kong have disbanded. This, again, shows the chilling effect on the rights and freedom in Hong Kong under the NSL and becomes the core of suppressing dissidents.
