Court Rules Former lawmaker Guilty of "'Assaulting two police officers with a loudspeaker"

During a civilian-police standoff in Yau Ma Tei on July 8, 2019, Au Nok-hin, a former lawmaker, was arrested for "assaulting the police" by speaking via the megaphone.

Au had pleaded not guilty at Kowloon City Court.

In delivering the verdict on April 6, magistrate Leung Ka-kie, however, said one officer's hearing was damaged. The magistrate also claimed that the other police officer was "afraid" due to Au's facial expressions and force, Au had "struck the police,shield with the loudhailer three times".

[Editor's note: Despite reports of police brutality, most police are unaffected by their misconduct. For instance, the police who rammed his motorcycle into the protesters is still serving the force.]

Hong Kong #NationalSecurityPolice arrest 6 under sedition law over ‘causing nuisance’ during court hearings

//Six people have been arrested by Hong Kong national security police under the colonial-era sedition law on suspicion of causing nuisance during hearings at various courts.

Sources told local media that the six people arrested included the former vice-chairman of the Hong Kong Confederation of Trade Unions (HKCTU) Leo Tang, who was reportedly brought in by police for questioning last week alongside three ex-leaders of the coalition.//

IPAC : It is absurd that mere applause during a court case can be construed as a seditious act

The Inter-Parliamentary Alliance on China (#IPAC) condemns the arrest of 6 individuals on suspicion of seditious intention to incite hatred, contempt or rebellion against the administration of justice in Hong Kong after applauding during the trial of Chow Hang-tung’s June Fourth memorial incitement case in early 2022. 

The individuals arrested include the vice-chairman of the now disbanded Hong Kong Confederation of Trade Unions (#HKCTU), Leo Tang, and citizen journalist Siew Yun-Long (Siu Wan).

The sedition charges were made under Sections 9 and 10 of the Crimes Ordinance – colonial era laws that have been criticised by the UN Human Rights Committee and frequently used by the Hong Kong authorities to crack down on legitimate protest.

The other individuals arrested were citizen observers at the courts who frequently witness political cases. 

"Not only are these charges wrong and to be condemned, but they also demonstrate how far the rule of law has deteriorated in Hong Kong," IPAC said in its statement.

IPAC also calls on governments to hold the Chinese and Hong Kong authorities to account for these abuses and appeals for all overseas judges to withdraw from serving on Hong Kong’s Court of Final Appeal in this further undermining of the independence and integrity of Hong Kong’s legal system.

Following China's imposition of the National Security Law in Hong Kong in July 2020, many book titles have subsequently been banned and taken off-the-shelf in public libraries.

These books are usually related to the June 4th Massacre in Beijing, the Umbrella Movement and the anti-extradition movement in Hong Kong. Even those written by pro-democracy authors were censored and restricted.

In response to a lawmaker's request for the list of book titles being removed off-the-shelf, the Hong Kong Leisure Cultural Services Department (#LCSD) refused to provide the list, saying that the list could be "maliciously used to criticise library collection." LCSD added that this is not beneficial to national security.

Based on media reports, at least 106 book titles have been taken off the shelf in the year after the National Security Law was imposed.

Among these book titles, 13 publications by the Hong Kong Alliance in Support of Patriotic Democratic Movements of China have been banned and "delisted" from the website of public libraries.

A staff member of a public library told reporters that these book titles are no longer available because they "could have violated the National Security Law."

Over 1,000 convicted for partaking pro-democracy movement in Hong Kong

According to the latest data released by the Hong Kong Police Force, as of January 31, 2022, a total of 10,277 people have been arrested in relation to the anti-Extradition movement in 2019. Among them, 2,810 have been prosecuted.

Of the 1,858 people who have completed judicial proceedings, 1,465 were found legally liable for their offences, including 1,158 being convicted.

297 agreed to bind-over order, 6 minors were subjected to child protection order, leaving the remaining 4 being charged of "contempt of court" in civil procedure.

Among those being convicted, some were sentenced to a prison term from 4 days to 12 years. While some were granted suspended sentence from 12 to 24 months, for others various penalties were imposed, including community service order, restorative order, detention center order, rehabilitation order, reeducation order or training centre order.

Besides, there were 85 cases linked to the National Security Law, the inquest of 64 cases have reportedly been completed.
