1) A Palestinian "prisoner" does not refer to someone tried & convicted in a normal court of law that follows due process. Palestinians are detained by Israeli soldiers, https://www.addameer.org/israeli_military_judicial_system/military_courts

No arrest warrant, no right to a phone call, no lawyers present. 2) Palestinians are interrogated without lawyers present & widespread abuses amounting to torture, are documented by human rights orgs. 3) Palestinian children are also tried in specially designed "juvenile military courts". Between 500 & 700 🇵🇸 kids are tried in these courts each year. 4) Israel widely uses "administrative detention" against hundreds of Palestinians. This allows for the indefinite detention of a Palestinian without charge - renewable every 6 months. Marah Bakr, released from Ofer prison on the 22 November, reunites with her family. The release is part of a temporary truce deal, through which at least 39 Palestinian women and children were released.

Bakr had been incarcerated since the age of 17 and spent eight years behind bars in Israeli prisons

To understand the context of the Palestinian prisoners’ stories, the Palestine Chronicle provides excerpts from Ramzy Baroud’s volume These Chains Will Be Broken: Palestinian Stories of Struggle and Defiance in Israeli Prisons.

Israa’ Ja’abis was born on July 22, 1984, in Al-Quds (Jerusalem), the fourth of nine sisters and brothers. She was arrested following an electrical system failure in her car which caught fire while she was still trapped inside. It resulted in first, second and third-degree burns on her face and all over her body, including the loss of eight fingers.

🇵🇸 Liberated prisoner Fadwa Hamada arrives at her home in Sur Baher, AlQuds, after 6 years in the occupation prisons following her release as part of the prisoner exchange deal.

This is #FadwaHammad and her five children Mariam, Sadeen, Ahmad, Muhammad, and Adam.

In one of the prison visits, Mariam picked flowers for her mom. However, an Israeli prisoner confiscated the flowers. Then when Fadwa appeared behind the glass, Mariam tried to hug her but she couldn't, so she broke into tears.

Now, Mariam will hug her mother whenever she wants because Fadwa is free.

🇵🇸 Israa Jaabis, a Palestinian woman who suffered severe burns and was charged with attempted murder after her car exploded near an Israeli checkpoint in 2015, has been welcomed home by her family.

Speaking to media after her release late on Saturday night, Jaabis said: “My wounds are visible and my struggles, I don’t need to talk about.”

She described the emotions of yearning to be with family as the price prisoners pay.

She also expressed concerns about other Palestinians she had been imprisoned with who were not released, including young girls who she said cried when she was released “because they’ve been subjected to a lot of things”.

“I’m talking about the small girls. They’ve been through things that nobody should witness,”

🇵🇸 Freed Palestinian captive Shorouk Dwayyat welcomed by family

Freed Palestinian prisoner #ShoroukDwayyat was welcomed by her family with tears of joy after she was released on the second day of a prisoner swap between Hamas and Israel.

Shorouk was 16 when she was arrested and sentenced to 16 years in an Israeli prison back in 2015.

Shorouq held the longest sentence among the female prisoners, having been sentenced 16 years in prison when she was only 16 years old. She was imprisoned for nine years.

🇵🇸 A released Palestinian female prisoner has claimed that female prisoners faced threats of sexual assault and that some were subjected to beatings which at times occurred when they were naked in prison bathrooms.

Ruqayah Amr, one of the Palestinian prisoners released as part of the truce agreement between Hamas and Israel made the claims during an interview with Al Jazeera Arabic TV.

She claimed Israeli guards would threaten prisoners, stating, “They would show us fabricated videos, but the girls would refuse to look at them. [The Israeli guards would say] look what we are going to do to you,” Amr added. “It’s something I can’t even talk about.”

Amr's claims add to previous ones reported by Middle East Eye that allege Israeli guards have threatened sexual assault against female inmates and assaulted them inside their cells.

🇵🇸 Freed Palestinian prisoner: 'I was explicitly threatened with rape'

Lama Khater, a #writer released in the sixth batch of Palestinian prisoners as part of the truce agreement, revealed that Israeli forces threatened to rape her and burn her #children. Describing the harrowing conditions, she stated: "Today, male and female prisoners are enduring what can be considered forced #starvation, in complete #isolation."

Khater describes how an Israeli solider told her that his rage would only be satisfied if he killed 50,000 children in Gaza.

Khater confirmed that at least 10 Palestinian females from the Gaza Strip were transferred to jail two days before the truce. She added that these women were arrested by Israeli forces while fleeing from northern to southern #Gaza. According to Khater, Israel seems to target mothers, forcing them to separate from their children.

🇵🇸 Special Rapporteur Says Israel’s Unlawful Carceral Practices in the Occupied Palestinian Territory Are Tantamount to International Crimes and Have Turned it into an Open-Air Prison | OHCHR - July 2023

Currently, there were 5,000 Palestinians in Israeli prisons, including 160 children, and approximately 1,100 of them were detained without charge or trial.  Her report did not condone any acts of violence committed by Palestinians, while living under an unlawful occupation or in their pursuit to end it. 

However, it must be acknowledged that most Palestinians had been convicted through a series of violations of international law, such as discrimination, persecution, and breaches of due process and for ordinary acts of life and in the exercise of legitimate civil and political rights. 

A widespread and systematic arbitrary deprivation of liberty of Palestinians was a structural component of their subjugation.

🇵🇸 Palestinians recount abuse inside Israeli prisons

Testimonies gathered by +972 Magazine from Palestinians released from Israeli prisons in recent weeks — both as part of the ceasefire agreement and independently of it — paint a picture of a surge in abuse and humiliation inside prison cells, in interrogation rooms, and during arrests. According to these testimonies, Israeli forces and prison authorities have used methods of #torture, threatened to #rape a female detainee and her young daughter, and beaten a prisoner to death — one of six Palestinians known to have died in Israeli custody since October 7.
