๐Ÿ“ฉ Question:

The questioner says: Does the one praying behind the Imam prostrate the prostration of forgetfulness for leaving of an obligatory or a recommended action?

๐Ÿ“ The answer:

As for prostrating due to missing the recommended acts, then one should not prostrate for leaving of the recommended acts, not the imam, nor those following him. The correct view with regards to leaving off the recommended acts is that there is no prostration for it, rather the prostration is for leaving off the obligatory acts.

What remains is does the one following the Imam prostrate if he forgets an obligatory act, whilst this did not occur from the Imam?

The answer: He follows the Imam with the tasleem (exiting the prayer). The majority of the scholars are of the view that he should not prostrate the prostration of forgetfulness, rather he exits the prayer with his Imam. And as for the deficiency in his prayer, then the congregation is a compensation for it.

The Prophet (๏ทบ) said:
(‏ูŠุตู„ูˆู† ู„ูƒู…ุŒ ูุฅู† ุฃุตุงุจูˆุง ูู„ูƒู…ุŒ ูˆุฅู† ุฃุฎุทุคูˆุง ูู„ูƒู… ูˆุนู„ูŠู‡ู…‏)
"Your Imams will lead you in prayer. If they conduct it properly, you and they will be rewarded; but if they make mistakes you will earn the reward and they will be held responsible (for the mistakes).โ€
Reported by al-Bukhari on the authority of Abu Hurayrah (ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡)

However, if there remains upon the follower some rakโ€™aat, then he completes his prayer and he prostrates the prostration of forgetfulness. And as for if he exits the prayer with the Imam, then it is obligatory upon him to follow the Imam.
"ุฅู†ู…ุง ุฌุนู„ ุงู„ุฅู…ุงู… ู„ูŠุคุชู… ุจู‡"
"The Imam has been appointed only to be followedโ€

And it hasnโ€™t been reported from any of the companions that he prostrated the prostration of forgetfulness after the tasleem of the Prophet (๏ทบ), whilst forgetfulness is from the nature of the human, and with that it hasnโ€™t been reported in any hadith at all, that anyone from amongst the companions prostrated the prostration of forgetfulness after the tasleem of the Prophet (๏ทบ).

And Imam al-Albani (ุฑุญู…ู‡ ุงู„ู„ู‡) said in โ€˜al-Irwaโ€™ that which means:
โ€œVerily this concept suffices us off the weak hadith.โ€
And that is:
"ู„ูŽูŠู’ุณูŽ ุนูŽู„ูŽู‰ ู…ูŽู†ู’ ุฎูŽู„ูŽููŽ ุงูŽู„ู’ุฅูู…ูŽุงู…ูŽ ุณูŽู‡ู’ูˆูŒ ููŽุฅูู†ู’ ุณูŽู‡ูŽุง ุงูŽู„ู’ุฅูู…ูŽุงู…ู ููŽุนูŽู„ูŽูŠู’ู‡ู ูˆูŽุนูŽู„ูŽู‰ ู…ูŽู†ู’ ุฎูŽู„ู’ููŽู‡ู"
"There is no (prostrations of) forgetfulness for one who is led (in prayer) by an Imam, but when the Imam forgets, both should then make prostrations due to forgetfulness."
For it is a weak hadith, however he (Imam al-Albani) said that which means: โ€œIt is sufficient for us that it hasnโ€™t been reported from any of the companions, that he prostrated the prostration of forgetfulness after the tasleem of the Prophet (๏ทบ)โ€

As for if there are some rakโ€™aat remaining upon him, then we mentioned that he prostrates the prostration of forgetfulness, because he has now separated from the Imam in his prayer, so there is no opposition of the Imam, so upon him is to compensate for the deficiency that occurred in his prayer by prostrating the prostration of forgetfulness, and this is what Imam ibn Uthaymeen (ุฑุญู…ู‡ ุงู„ู„ู‡) informed of.

๐Ÿ“ฉ Question:

The questioner says: Is it permissible to pray behind the one who says that Allah is in every place?

๐Ÿ“ The answer:

The one who says that Allah is everywhere is a heretic, because this speech is in opposition with the evidences for the affirmation of the attribute of highness for Allah ุฌู„ ูˆุนู„ุง and they are many mass transmitted evidences. Evidences that no human can restrict or count, in the Book of Allah and the Sunnah of the Messenger of Allah (๏ทบ), that which proves the Highness of Allah ุฌู„ ูˆุนู„ุง

So his rejection of these evidences, if it wasnโ€™t for allegorical interpretation, he would be a disbeliever, however due to the mistake of allegorical interpretation, the scholars deemed them to be heretics only. So this person is a heretic, and if there is no other clear cut kufr (disbelief) with him other than this speech, then the prayer behind him is correct.

And if he is able to find another Masjid, where the one who leads is a man from Ahluh-Sunnah, then this is better for him than to pray behind such a man. However, if the Masjid of Ahluh-Sunnah is far from you, then it is permissible to pray behind this heretic, and his heresy is upon him, as long as he is from the Muslims.

And All Perfect Praise with Love and Veneration is Exclusively for Allah.

๐Ÿ“ฉ Question:

The questioner says: A man was in the state of janabah (Major Impurity), he went to his work forgetting he was in the state of janabah, then he called the Adhaan for Dhuhr, and he led the people in prayer forgetting that he is in the state of janabah, so what is the ruling of this?

๐Ÿ“ The answer:

As for the Adhaan then it is correct by unanimous concensus, purity is not a condition for it. And similarly their prayer is correct, and they do not have to repeat their prayer. Upon him is to do ghusl and repeat the prayer.

It has been established in the Muwattaโ€™ of Imam Malik on the authority of โ€˜Umar bin al-Khattab (ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡) that he led the people in Fajr prayer whilst being in the state of janabah, whilst he didnโ€™t realise, and after he came to realisation he repeated his prayer and he did not command the people to repeat the prayer. So their prayer is correct, and for him is to repeat.

And as a benefit, if he was to remember whilst being in the prayer that he is the state of janabah, what should he do?
The answer: he should return and someone other than him should step forward to lead them in completing the prayer. And he should go and do ghusl then repeat the prayer. And if he was to carry on then he is partaking in a great sin. Such so that some scholars deemed the one who did so intentionally; a Kafir (disbeliever).

And the correct position is that it doesnโ€™t reach the level of Takfeer (excommunication from the religion), this is far, because it may be that he is only embarrassed and not belittlement. The one who prays without being in the state of purity due to belittlement, disdain and a mockery of worship, this reaches the level of Kufr (Disbelief), however this person is embarrassed, so he doesnโ€™t reach the level of Kufr however he is partaking in a grave sin due to this action. And their prayer is correct due to the fact that he conned them and deceived them whilst they did not know. And if they knew of his situation during the prayer then it would not have been permissible for them to follow him. So with doing it intentionaly then it is a sin and disobedience, and Allah has made a way out for him, such so that he can go back and someone else can come forward in place of him to lead the people in prayer.

๐Ÿ“ฉ Question:

If someone comes whilst the Imam is praying, and to his right is a person praying with him, does he push the Imam forward or does he pull the follower back?

๐Ÿ“ The answer:

He should see that which is best. If the place is more befitting for the Imam to move forward, then there is no problem in him moving the Imam forward, and if the place is befitting to bring the follower back, then he should pull the follower back. The affair is extensive, and he should look to that which is most befitting.

๐Ÿ“ฉ Question:

The questioner says: If the Imam doesnโ€™t sit for a pause/rest (before getting up from sujood), can the one following sit?

๐Ÿ“ The answer:

Yes, if he is negligent with regards to the supererogatory actions then it is allowed for the one following to do the supererogatory acts, such as the sitting of rest, the sitting on the hips whilst spreading out the feet in the final sitting (the final tashahud), spreading out the left leg in the first tashahud, the raising of the hands in its four appointed places, and from the likes of these supererogatory actions, if the Imam is negligent then the ones following can perform them.

As for the hadith that the Prophet (๏ทบ) said:
(ุฅูู†ู‘ูŽู…ูŽุง ุฌูุนูู„ูŽ ุงู„ู’ุฅูู…ูŽุงู…ู ู„ููŠูุคู’ุชูŽู…ู‘ูŽ ุจูู‡ูุ› ููŽู„ูŽุง ุชูŽุฎู’ุชูŽู„ููููˆุง ุนูŽู„ูŽูŠู’ู‡ู)
โ€œThe Imam is (appointed) to be followed. So do not differ from himโ€.

Then the intent is in the apparent actions, do not precede him and do not differ from him. The apparent actions such as the standing, sitting, bowing, prostrating, the opening takbir and the tasleem. These are the apparent actions whereby it is not allowed to precede or differ in. and as for the supererogatory actions, then if he is negligent it must not be left off.

And similarly he should not be followed in things which are not prescribed, so if he recited the qunoot in the Fajr prayer then you are not obliged to say โ€˜ameenโ€™.

๐Ÿ“ฉ Question:

Is it permissible for a man to pray alone if he arrives and the congregation has ended and there is a second congregation taking place?

๐Ÿ“ The answer:

From the mistakes is that he prays alone whilst there is a second congregation taking place. The Prophet (๏ทบ), when a man entered the Masjid and the Messenger of Allah (๏ทบ) had already prayed, the Messenger of Allah (๏ทบ) said:
(๏ปฃ๏ปฆ ๏ปณ๏บ˜๏บผ๏บช๏ป• ๏ป‹๏ป ๏ปฐ ๏ปซ๏บฌุง ๏ป“๏ปด๏บผ๏ป ๏ปฒ ๏ปฃ๏ปŒ๏ปช)
โ€œWho will give alms to this man and pray along with him?โ€
Reported by Ahmad and Abu Dawud on the authority of Abu Saโ€™eed al-Khudri ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡ with an authentic chain of transmission.

And this man sees the congregation and chooses to leave it off, this action is not correct. The prayer in congregation is better than the prayer alone by twenty-seven degrees. As has come in al-Bukhari and Muslim on the authority of ibn โ€˜Umar ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡ู…ุง

And the first congregation is obligatory, and this action is severely disliked, and Allah knows best.

๐Ÿ“ฉ Question:

The questioner says: Is the reward for the second congregation in the Masjid the same as the reward for the first congregation, twenty-seven degrees?

๐Ÿ“ The answer:

The congregation for which this reward is achieved is the first congregation, and the second congregation attains a reward an amount which is known to our Rabb ุณุจุญุงู†ู‡. Allah knows best how much reward they will attain.

We are certain of the reward mentioned in the hadith being for the first congregation as if this was not the case then people would stay behind and miss the first congregation. Someone would come to pray with the second congregation, and another for the third congregation, and all of them attaining the same reward. Without a doubt this is not allowed for the Muslim.

The people are all commanded to pray with the first congregation, and as for the remaining congregations, then their rewards are not like that of the first congregation. Rather it is obligatory upon Muslim men to attend the first congregation and to not intentionally delay it. The evidence reported which commands with the congregation, and mentioning its reward, are all with regards to the first congregation.

That being said, it is not appropriate for the one who misses the first congregation to leave off the second congregation as he will get rewarded by it with what Allah wills.

๐Ÿ“ฉ Question:

A man caught two rakโ€™ahs of the โ€˜Asr prayer. He then thought that he had caught three rakโ€™ahs, so he completed by making up one rakโ€™ah and then he made the tasleem. He then spoke to his companion and asked him: how much did I catch? He replied: two rakโ€™ahs.
Does he stand up and come with a complete rakโ€™ah and then prostrate the prostration of forgetfulness, or does he repeat the prayer due to speaking?

๐Ÿ“ The answer:

This speech does not nullify his prayer because he is still in doubt whether he is in prayer or not in prayer. The Prophet (๏ทบ) spoke and the companions heard it, when he Dhul Yadayn said to him:
ุฃู†ุณูŠุช ูŠุงุฑุณูˆู„ ุงู„ู„ู‡ ุฃู… ู‚ุตุฑุช ุงู„ุตู„ุงุฉุŸ
โ€œdid you forget O Messenger of Allah or has the prayer been shortened?โ€
So he said:
(ู„ู… ุฃู†ุณ ูˆู„ู… ุชู‚ุตุฑ ุงู„ุตู„ุงุฉ)
โ€œI havenโ€™t forgotten, nor has the prayer been shortenedโ€
Then he said to the companions:
(ู…ุง ูŠู‚ูˆู„ ุฐูˆ ุงู„ูŠุฏูŠู†ุŸ)
"What is Dhul Yadayn saying?"
So they replied that the matter is as he mentioned. And so he stood up and completed his prayer and then he prostrated the prostration of forgetfulness after the Tasleem and then he made the Tasleem.

So it is upon you to also do the same, you must come with the extra rakโ€™ah which was left off, then you make the Tasleem and prostrate the prostration of forgetfulness and then you do the Tasleem due to the hadith of Dhul Yadayn which has come in the Saheehayn on the authority of Abu Hurayrah (ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡), and reported by Muslim similar to this on the authority of โ€˜Imraan bin Hussayn (ุฑุถูŠ ุงู„ู„ู‡ ุนู†ู‡).

The questioner:
And if he didnโ€™t ask until the time for the prayer had come to an end?

The answer:
If he repeated it then In Shaa Allah the repeated prayer is sufficient, and as for the deficient prayer, then it is not sufficient.
And if he didnโ€™t repeat it, then upon him is to repeat as soon as he becomes aware of the ruling according to majority of the scholars, even if the time has come to an end. And all aid and assistance is sought from Allah alone.
