The existing provisions in the Indian Penal Code and other enactments are not adequate to enable interested citizens and civil society groups to approach the courts.
The US Federal False Claims Act
empowers any person who has knowledge about a fraud committed by another person or entity,
to file a law suit on behalf of the Federal Government. And if the fraud is established in a court of
law, the person committing the fraud is penalized and the plaintiff is rewarded with a percentage of
recovery.
The whole procedure is governed by rules of civil litigation and the standard of proof needs
to meet civil court norms, and does not require proof beyond reasonable doubt, as in criminal cases
