#DV2023 update- so this is your first visa bulletin. This tells us who is eligible for October interviews. If your case number is higher than case number caps here, that means your DV2023 interview will not be before November.

#DV2023 note: We recommend that you review this previously shared declaration by KCC Director Morgan Miles explaining how KCC determines the sequence of interviews.

In a nutshell:
(1) It is very important that DS-260 is submitted early, as the date processing is completed of that form in part, determines when or IF you can be interviewed.
(2) Do not request that KCC unlock your DS-260 for changes. Wait until your interview is scheduled and make that request to the embassy.

#DV2023 Tip: often DVs change their interview location with KCC and then KCC recommends unlocking DS-260 to update address. Until recently, we recommended against this unless there was a legitimate change of address because you generally don’t want to provide misinformation to State Department.

However, we have recently became aware of a case with a UAO plaintiff where KCC reversed the interview location to the original when the address was not changed in the DS-260, even though the selectee moved to the new country and is even a citizen of that country.

This has us scratching heads because it’s a situation where KCC seemingly wants applicant to provide misinformation.

Thus, we now recommend when you change your interview location, change your address in DS-260 to an address in the country where your new interview location will be. 🤷🏻‍♂️

August 25,2022 Update: after posting this, government attorneys informed me that the Interview location for the UAO plaintiff at issue had been changed to the desired embassy.
On Tuesday, we filed a lawsuit against State Department to find out whether they were requiring #DV2023 selectees to submit documents to KCC.

Today, they updated the Visa News website to say they are not requiring document submission to KCC.

#DV2023 #DV2024 Tip: While KCC processes DS-260 applications, they do not stop an application due to an obvious ineligibility.

For example, the DV applicant who entered multiple entries or omitted eligible spouse or children on entry, is not eligible to be issued a visa. However, the refusal is not automatic. Every year, KCC invites many DV applicants to interviews that they know are ineligible and that they will refuse for this reason, and take their money ($330 per applicant), even though the refusal is imminent.

I think this happens because, by law, only consular officers can make decisions on visa applications. However, it is frustrating for the DV families who think an invitation means the DS-260 processing went ok.

This is one more reason why reading and following DV instructions is critical! 📖
#DV2023 FAQ: What is my AV stage date and why does it matter?
Answer: AV stage date is date that KCC completed processing of your DS-260, and enters you in the AV queue.

It matters because it is important factor on issue of if and when you are scheduled for interview. It is also a reminder that asking KCC to unlock DS-260 can lead to a later AV stage date, and thus, put you further back in the queue. Don’t do that. If you made mistake on DS-260, wait until you are scheduled for interview and ask embassy to unlock DS-260 to make corrections then.

#DV2023 FAQ: what is the AV stage date, and why is it relevant?

Answer: KCC Director Miles tried to explain AV in declarations in DV22 litigation. As we understand it, only after processing of DS-260 is completed, and case number rank is current in upcoming visa bulletin, will DV case be put in queue for interview at a specific post.

This is relevant because it shows that unlocking DS-260 can cause delay in processing of your DS-260, thus allowing other cases whose DS-260 is processed before yours, to enter queue before yours, because they have an earlier AV stage date. Not a good idea.
