Enrolment in Self-defense Courses Rises Dramatically; Coach Says Police Collecting Data on Classes is White Terror

A boxing studio manager points out that after the Triad indiscriminate attack on citizens in Yuen Long on July 21, the enrollment in self-defense classes has increased by 3 to 4 times.

A student expresses that they started taking classes because they think that the police can no longer protect citizens. A boxing coach reveals that he knows the police is collecting data on self-defense coaches and that he is on the list. Fear of being targeted by the police, he has already stopped teaching.

#University Management Censors Students' Events to Commemorate Hong Kong's Pro-drmocracy Movement

On the eve of the one-year mark of the "CUHK battle", the management of Chinese University of Hong Kong (#CUHK) ordered the Students' Union (#CUSU) to remove publicity material of the commemorative events to be held between November 11 and 18, 2020 on campus.

During the 2019 Anti-Extradition Law Movement, the Hong Kong police attempted to siege the university with arms. The students' union, together with the eight colleges, now wishes to remind Hongkongers of the happenings of that day with an photo exhibition.

On Nov 4, 2020, one hour after the event details went online, the University management ordered the #CUSU to delete the promotional material for said event, citing the presence of the slogan "liberate Hong Kong, revolution of our times" and the appearance of the university's former and current presidents on the poster as the reasons.

The management proposed to "first delete and discuss later". The Students' Union disagreed and expressed discontent towards the university management, as the concerned photos are taken from the news.

The Students' Union challenged the decision, asking sartorially if the university will censor photos in the photo exhibition.

HK's Department of Justice: No further prosecution over #LammaFerry Tragedy

The Department of Justice (#DoJ) has decided not to initiate prosecution against individuals or companies involved in the 2012 Lamma ferry collision.

In a written reply to a question by the Legislative Council, the DoJ stated that the police force had submitted investigation reports and evidence against the individuals and organizations out of the Marine Department to the DoJ.

The Police was notified by the DoJ last month that prosecution over the maritime accident was ended.The Police had submitted 39 death investigation reports to the Coroner's Court, and had informed the Coroner about all investigation results and legal advice last month.

The DoJ stressed that only if the case had a reasonable prospect of conviction, and was in the public interest, prosecution would be commenced; and prosecution had earlier been initiated against the two ferry captains and the two Marine officers.

Television documentary leading to HK journalist’s arrest shortlisted for Asian Television Awards

On November 3, 2020, Hong Kong Police arrested RTHK journalist Choy Yuk-ling (a.k.a. #BaoChoy) for violating the Road Traffic Ordinance, concerning searches done at an openly accessible Transport Department database on car owner information. The searches were carried out for a television documentary about an alleged police-mobster collusion in July 2019.

The television documentary, titled "7.21 Who Owns the Truth", showed white-clad mobsters carrying weapons gathered in Yuen Long town area before attacking passengers of West Rail train at Yuen Long Station. Police officers sighted at neighbouring scenes failed to intervene and showed friendly gestures towards them.

A day after Bao Choy was arrested, the said television documentary she produced was reportedly shortlisted for the 25th Asian Television Awards, a substantial recognition of Choy's professionalism.

Defiant University Students Carry Out Pop-Up Protests on Graduation Day, Calls Attention to Persecuted Students

November 4 marked the annual graduation ceremony of the Chinese University of Hong Kong (#CUHK). Although no large-scale protests were seen this year under the iron grip of the National Security Law, traces of defiance still sprang up around the campus.

Large Banners Protest Admin Interference in Student Governance

As early as 6:30am, a large vertical banner with the words “Restore Student Autonomy「還我學生自治」” was spotted, as was another smaller one that said “Consultation Must Precede Staff-Student Collaboration 員生共治，必先共議」” . By 8am, both banners had been removed by school staff.

On the #WallofDemocracy, a large notice board created for students to voice opinion, multiple posters were seen with the call “OSA and subsidiary faculty committee, join the provisional Administration”, protesting the school's new requirement for student organizations to be registered with the school administration.

During the graduation ceremony, defiant graduates from Nursing showed protest handbills that wrote “Dare to be different; Be Faithful to your belief 「棱角分明，毋負期許」”. Some social work graduates wore white ribbons on their graduation robes, and carried handbills with slogans such as “Grieve our Student Union”.

Ex-Police Security Chief Disrupts Students Handing Out White Ribbons, But Chastised by Parents

At around 12:30, 5 CUHK students held up a banner that wrote “Grieve my CUHK” on the University Mall, and set up a counter to hand out white ribbons.

Although the group of students did not obstruct the proceeding of graduation ceremony, they were quickly encircled by more than 10 campus security and were ordered to leave. The students demanded the security guards for reasons that they were not allowed to hand out white ribbons, as they were not obstructing the ceremony.

Lee Wing-kwong, head of Campus Security and a former Police Superintendent, ordered his staff to remove the students’ protest materials immediately. He was, however, stopped by members of Student Affairs Office, who asked him to “calm down”.

Some parents on the site stepped in to show their support to the protesting students. Quoting the classic Confucian text "Great Learning", they criticized the campus guards for abusing their powers: "Don't you officials remember the Way of the Great Learning?"

"We've Graduated, But They Couldn't"

Scattered protest activities continued around campus into the evening. Nine graduates, wearing their graduation robes, held up signs with names of fellow students who had been arrested and jailed for their involvement in the 2019 anti-ELAB movement.

Their names are Cheung Chun-ho, Tang Hei-man, Ko Tsz-bun, Lau Chun-yuk, Fu Ngai-Ching, Chen Lik-sik, Hui Yi-shui, Li Chun-ho.

The last sign read poignantly: "We've graduated, but they couldn't."

"Joint Enterprise" Not Applicable to #Rioting, Hong Kong Top Court Rules; "Only Restoring What the Government Illegally Changed", Says Hongkonger

Hong Kong's Court of Final Appeal handed down a landmark verdict on November 4, 2021, ruling that people not physically present at a riot or unlawful assembly cannot be charged under the common law doctrine of "joint enterprise".

This ruling had far-reaching implications, as the government had charged large numbers of protesters in the Anti-ELAB Movement with these two offenses.

In September 2020, the Department of Justice (#DoJ) submitted an appeal to seek clarification on the principle of joint enterprise stemming from #ElaineTo and #HenryTong’s case, where the couple was acquitted of rioting.

If the principle were applicable, then supporters in roles such as sentries, drivers, and being in charge of supplies may become at risk to being found guilty for rioting as secondary offenders, even though they were physically far from the scene of the riot. The verdict ruled otherwise. However, the Court of Final Appeal also emphasized that those who “promote or act in furtherance” of an illegal assembly or riot may still be liable to face charges if they committed "secondary and inchoate liability offences", whether they were present or not.

Henry Tong, one of the two pro-democracy activists who submitted the appeal, said that the verdict was reasonable, and he was satisfied with the results. He noted that the successful appeal merely restores the law to what it was before the DoJ had tried to "make illegal changes" to it.

He admitted that he had been very nervous in the few days leading up to the verdict and had trouble sleeping, and is now quite tired. However, he was glad that today brought some positive energy to friends in these difficult times.

It had been more than a year since the DoJ made its appeal, and he had now finished what he could do, he said. However, he noted that the broader situation of Hong Kong is still changing. "It feels terrible to watch my hometown fall apart," he said.

He took a more positive tone in his Facebook post about the verdict, however, exhorting Hongkongers to keep on: "If we can restore what had gone bad in the areas in the reach of each of us, then Hong Kong has a chance to be restored."
