Hong Kong Government to Beijing : Carry Out Political Retribution on Medical Staff

The recent epidemic report submitted by the Chief Executive’s Office to the Central Government has specifically mentioned the largest medical staff strike in Hong Kong history. The report described the medical union that initiated the strike as “black sheep”. They were also falsely labeled as affiliated with anti-extradition protestors. It was also mentioned in the report that the government has demanded the Hospital Authority to take action against those who organized the strike, stating that these “black sheep should not be allowed to continue working in the hospitals”.

In the submitted report, the Chief Executive’s Office criticized the union’s demand to close the border, saying it was only a “slogan” and that many citizens were being misled in forming this mainstream opinion. The report mentioned that the SAR government has refused to be involved, and that Chief Executive Carrie Lam has turned down meetings with unions. They emphasized SAR government’s strong stance by reiterating they will not enforce a total border shutdown, will not impose travel restrictions on mainland residents and will respect mainland authorities in handling immigration matters.

Ivan Law, the Vice-Chairman of the HA Employees Alliance criticized the report as not reflecting the facts and believed that it was meant to discredit the union. He pointed out a few false descriptions in the report: that the reason for terminating the strike was not due to public dissatisfaction; the reason for the strike was not political; and the demand for border shutdown was not discriminatory against mainland citizens.

Law stated that although the members of the union were prepared to face political retribution and funds have been reserved to aid those members on strike. He said he “did not expect that the government would issue a written statement explicitly asking the Hospital Authority to take action against striking members.”

The Finance Committee of the Legislative Council held special meetings for four consecutive days to discuss the "Budget" and the government's fiscal expenditure for the next year. At the meeting on 8 Mar 2020, Regina Ip, a former security chief who now heads the pro-Beijing New People's Party, proposed to settle accounts with the strikers: She advised the Hospital Authority (HA) not to issue specialist qualifications to doctors who had participated in the strike.

The remarks drew the ire of pro democracy legislators, who criticized Ip for using "Cultural Revolution-style denunciation" by advocating retribution and smearing of medical staff. They emphasized that the medical workers’ strike was called to request for a comprehensive border closure so as to avoid a collapse of the medical system.

On the same day, Carrie Lam announced relief measures including the waiver of licence and registration fees for medical workers for three years. A reporter pointed out that medical workers are not asking for a waiver of registration fees. A number of labor unions including the Hospital Authorities Employment Association (HAEA) have plans to go on strike in protest of the national security law in Hong Kong.

Fan Hung-Ling, chairman of the Hospital Authorities (HA) called the plan to strike "political", violating the neutrality of the HA, and that would not succeed.

The Hospital Authorities even hired a team of lawyers to study the legal issues related to the strike back in February.

Fan said that the human resource department would be responsible for following up on the previous strike, but he did not disclose the costs associated with hiring the lawyers.

According to Law Cheuk-Yiu, the vice-chairman of HAEA, many are concerned that after the implementation of the national security law, medical personnel will not be able to speak freely. The situation might get worse like what happened to the late Dr. Li Wen Liang in Wuhan China. Dr. Li was a whistleblower warning of the Covid-19 outbreak in China. He was accused by the Communist government for disseminating fake news and eventually died of the disease.

Similarly, Hong Kong microbiologist and SARS expert Professor Yuen Kwok-yung has been heavily criticized in China, after he criticized China’s handling of the pandemic in a paper. With the implementation of the national security law, Law said, no one can guarantee if medical staff can tell the truth in the future.

Law also criticized Fan, the chairman of the HA, for having a double standard when Fan claimed that medical staff should not talk about politics nor have a political stance. Law pointed out that how Fan hastily characterized potential strikes as "political strikes" is precisely being political and suppressive. Law reiterated that if medical staff are afraid to tell the truth because of the national security law in the future, it will ultimately affect the treatment of the patients.
