The US’ Hong Kong Human Rights and Democracy Act strikes Beijing exactly where it hurts

Editor’s note: The act declares U.S. support for protesters in Hong Kong and, if signed into law, gives the U.S. license to introduce sanctions and take other diplomatic action if it finds Hong Kong not sufficiently autonomous.

(20 Nov) #HitWhereItHurts Seven departments of the Beijing Government voiced opposition to the US’ Hong Kong Human Rights and Democracy Act ​within ​the same day, ​followed by a 10-minute rebuttal ​from Xinwen Lianbo, which showed that the US’ latest bill on Hong Kong has hit a raw nerve in Beijing​. Some scholars considered this the beginning of a Sino-US co-governance, which ​was exaggerated, but Beijing’s ​underlying values ​of overall jurisdiction and national security in​ recent years would definitely be threatened.

The US reaffirmed in the first ​clause o​f the Act that the US treatment of Hong Kong, which is different from that of Mainland China, is conditional. One of the conditions is that “​Hong Kong must remain sufficiently autonomous from the People’s Republic of China” so as to ​manifest ​the Sino-British Joint Declaration, the International Covenant on Civil and Political Rights, and the Universal Declaration of Human Rights.

The other clauses of the Hong Kong Human Rights and Democracy Act concern democracy and human rights. However, the emphasis is on the Sino-British Joint Declaration and not Basic Law. Perhaps American experts on Hong Kong Affairs have long realized that the bulk of the Basic Law articles are favourable to the authorities, and the power of the authorities are derived from the Chinese Constitution and the National People’s Congress. If the US can force Beijing to abide by its international obligations, it would be difficult for Beijing to have the standing to undermine Hong Kong government’s power on the basis of ''combine the upholding of the Central Authorities' overall jurisdiction with the safeguarding of a high degree of autonomy of the special administrative region''.

From the recent ruling that the Emergency Ordinance is unconstitutional, it can be seen that Beijing considers the Chinese Constitution takes precedence over Basic Law and whether it is constitutional or not depends entirely on Beijing. However, the right to judicial review is protected by international treaties. The US in enforcing the Sino-British Joint Declaration can avoid being led by the logic of the Chinese.

In short, the Hong Kong Human Rights and Democracy Act strikes Beijing exactly where it hurts in relation to the governance of Hong Kong.

The UK Stressed the Legitimacy of the Sino-British Joint Declaration and Determined to Safeguard Hong Kong's Autonomy

The UK expressed deep concern over the Hong Kong Protests and said it is "fully committed to upholding Hong Kong's high degree of autonomy and rights and freedoms underpinned by the legally binding Joint Declaration of 1984 and the "One Country, Two Systems" framework set out in the Hong Kong Basic Law.

The UK will support peaceful resolution to calm the ongoing violence in Hong Kong, it has prohibited exporting crowd management equipment to HK since 25-Jun, regularly raise concerns directly to both Hong Kong Chief Executive, Carrie Lam and Chinese Foreign Minister, State Councillor, Wang Yi, meet with the Chinese Ambassador in London and raised HK in national statement in the United Nations and with other counterparts, including the US, Australia, Canada and Europe.

Last but not least, the UK is now researching on the best support for the BN(O)s holder on their rights and status, which it believes the high degree of autonomy and rights and freedoms set out in the Joint Declaration and enshrined in the Basic Law must be upheld.

Italian Senators promise to file motion in support of Hong Kong universal suffrage next week

(28 Nov) The Hong Kong Human Rights and Democracy Act was passed this morning in the United States. A related rally will be held at Edinburgh Place in Central tonight. We are now opening up a new frontier in gaining international support.

Hong Kong’s High Court denied my application to visit Europe earlier on the basis of this being an "insignificant” schedule. However, the travel ban has neither deterred our determination to deliver the message of Hong Kong to the world nor diverted international audience from focusing on democracy and freedom in Hong Kong and China.

I am currently testifying at the Foreign Affairs and Human Rights Hearing in the Italian Senate through video conference. I received a round of applause when I proposed to ban all Italian companies from exporting any equipment for repression to Hong Kong.

Meanwhile, Italian Senators have promised to file a motion next week in support of implementing universal suffrage in Hong Kong, which will be followed by a debate within the Senate. I will notify everyone of further updates soon.

US lawmakers step up call for action on Hong Kong

US lawmakers on January 8 renewed their call for the Trump administration to put pressure on Beijing to ensure that Hong Kong's autonomy is preserved.

In a wide-ranging annual report, the Congressional-Executive Commission on China, which tracks human rights in the country, also voiced alarm at Beijing's incarceration of more than one million Uighurs and other Muslims in the western region of Xinjiang.

In a section on Hong Kong, the commission said it had "observed a further erosion of Hong Kong’s autonomy and fundamental freedoms under the 'one country, two systems' framework.

It urged the US administration to communicate to Hong Kong and Beijing officials that the undermining of the SAR's autonomy would threaten its separate treatment under US law and called on the White House to fully enact the Hong Kong Human Rights and Democracy Act.

The Hong Kong government issued a lengthy statement refuting the report and expressing its strong opposition towards the enactment of the "Hong Kong Human Rights and Democracy Act" in the US.

"The Act clearly intervenes in Hong Kong's internal affairs. It is unwarranted, sends an erroneous signal to violent protesters, and harms the relations and common interests between Hong Kong and the US."

Senator Marco Rubio, a co-chair of the commission, said lawmakers across the partisan divide wanted to prioritise human rights but acknowledged that the White House was also concerned about trade. "I do think that, by and large, they are supportive of what we are saying but, again, the proof will be in the implementation" of the act, Rubio said.

It is all about the party committee system. The Liaison Office is NOT a government department. It is actually the “Hong Kong and Macau Work Committee of the Chinese Communist Party” (CCP). In other words, it is the CPP branch in Hong Kong. It has operated in Hong Kong since the 1920s, called “Xinhua Hong Kong” after 1949 and re-named as Liaison Office in 2000. The Liaison Office has intervened Hong Kong's autonomy as a “second government team” (a term coined by Cao Erbao); now it declares that it is standing above the Basic Law, trying to formally establish a “party-lead-all” committee system that the in Hong Kong.

When the US is about to release its certification report, China takes this move aiming to test the resolve of Washington. If the US fails to respond forcefully, the “Hong Kong Human Rights & Democracy Act” will become nothing more than just a piece of paper and Hong Kong will be transformed from “West Berlin” to “East Berlin”.
