HSBC in Hong Kong Reportedly 'Embezzles' the Asset Owned by Exiled Lawmaker and his Family

On Jan 2, 2021, The Hongkong and Shanghai Banking Corporation (#HSBC) has cancelled all the credit cards under the name of Ted Hui and his family, claiming it a "commercial decision". On the onr hand, the bank charged the outstanding balance on the credit cards from their account; on the other hand, the bank claimed that it "may not be possible" to return any remaining balance, which amounts to around a few tens of thousands of Hong Kong dollars, to the account holders.

According to Ted Hui, the bank asked him to "call them later and see what the bank can do about it." Hui comdemned this as the bank's unlawful embezzlement of private property which is supposed to be protected by Hong Kong’s Basic Law.

Ted Hui, a former lawmaker who is currently in exile, points out that the incident is a result of "HSBC’s own political consideration, with a view to aiding the regime to crack down on opposition voices. This deed has no legal basis at all."

It "reflects the business community’s attachment and obedience to the regime under the National Security Law, which can completely override law and policies, and the regulators can only be 'politically correct' and helpless."

Hui also stated that Hong Kong officials and their families under international sanction actually can keep their bank accounts as well as credit cards

Political pressure weighs on HSBC over Hong Kong activists

Carrie Lam revealed in late 2020 that she received cash for her salary after being targeted by US sanction. That not only presented a problem for Ms Lam, but also a compliance nightmare for international banks in Hong Kong.

HSBC freezing of a bank account of Ted Hui, former pro-democracy lawmaker, over the new year has shown more fraught for the banks on the compliance problems.

Lawyers say banks are increasingly incentivised to avoid offering services to any Hong Konger who could get them into hot water.

One compliance officer at an international bank in Hong Kong said employees were worried and tried to avoid having their name attached to decisions on individual accounts considered political, even attempting to get closure decisions signed off offshore. “We are all on edge,” the officer said.

#HSBC chief defends freezing accounts of democrats as “legally obliged”

Following thr Chinese Authorities’ imposition of National Security Law in Hong Kong, the HSBC, the city’s leading bank has been criticized for assisting the National Security Police and freezing the bank accounts of pro-democracy activists’, such as #TedHui and his family and the Good Neighbor North District Church.

In a meeting scheduled on January 26, 2021, the Bank’s CEO Noel Quinn told the Foreign Affairs Committee in the UK that the bank was "legally obliged to take action" on accounts after being notified by Hong Kong police.

In a Facebook post on January 24, 2021, former lawmaker Ted Hui Chi-fung, now in exile, said that he has provided the Committee with detailed information on the cases where his and his families accounts were frozen.

Ted Hui added that any bank, business or institution that assists in repressing the freedom of Hong Kong people would have to pay a heavy international price and that he would do everything possible to make them face the consequences.

In a letter to Hui in early January, Quinn explained that the bank was "forced" to freeze the accounts at the request of the police. Hui, however, rejected Quinn’s explanation, saying he “failed to provide the legal basis” for the account lockdown.

"I hope that my lobbying work will bring tougher stance among Australia and New Zealand against China," Hui wrote in the post.

Hui said that he “took in many considerations” before making the move. Among them were strategies for advocacy work and the long-term development of his family.

Hui’s wife, his son and daughter have been in exile with him since he fled Hong Kong three months ago.

Ted Hui Granted a Visit to Australia as an Exemption Under the Pandemic

A former legislative council member Ted Hui, who fled Hong Kong to the UK through Denmark in December last year, has relocated to Australia on Mar 9 to continue his job at international lobbying. During an interview with local media, Hui thanked the Australia government’s help to allow his visit to the country as an exemption under the closed border situation. He was allowed to board on an Australian citizens-only flight from London to Australia. According to ABC News, Hui was the first Hong Kong activist to be granted a visit to Australia since the pandemic. A response from the Minister for Immigration, Alex Hawke, was still pending.

An Australian local media reported that Hui was granted a 12-month tourist visa. He arrived in Australia on Mar 9 morning and will self-quarantine for 14 days in a hotel. Antony Dapiran, an Australian lawyer in Hong Kong, said that Hui’s move will be welcomed by the dissidents in Hong Kong but will be criticised by the Beijing government.

UK House of Common Raises Concerns on the Severe Downturn in Hong Kong’s Situation. Minister of State for Asia Refuses to Comment on the Freezing of Former HK Legislative Councillor Ted Hui’s HSBC Bank Accounts

The House of Common of the British Parliament hosted an urgent inquiry on the imprisonment of Demosisto’s Secretary-General Joshua Wong, Chairperson Ivan Lam, and party member Agnes Chow on 7th December. Responding on behalf of the UK government, Minister of State for Asia Nigel Adams expressed his concerns on the issue of Hong Kong and the series of cases targeting pro-democratic activists, including the arrest of the three youngsters mentioned above and the media mogul Jimmy Lai from Next Media.

Adams had already expressed his concerns for the aforementioned cases to the Hong Kong government as well as to Beijing senior officials, asking them to adhere to their international obligation. At the time of the inquiry, there were judges from UK’s Supreme Court amongst the group of overseas judges at Hong Kong’s Court of Final Appeal. Adams reiterated that UK judges had always played an important role in supporting judicial independence in Hong Kong, and that this independence was key in the success of Hong Kong. As a result, the UK government had wished to carry on in this aspect. However, the implementation of the Hong Kong National Security Law in July had brought up real problems and contradicted with China’s promise to protect Hong Kong’s fundamental rights and freedom under the Sino-British Joint Declaration. UK’s Supreme Court had been in constant communication with the UK government, examining the situation in Hong Kong and the stand from UK judges.

Parliament members questioned Adams why the UK government was not doing more when the situation in Hong Kong was becoming increasingly severe. They used the freezing of the bank accounts of former Hong Kong LegCo member Ted Hui as an example, suggesting that the UK government could perform countermeasures and sanction Beijing’s banks in return. In his response, Adams reiterated the government’s original stand, stating that he would not comment on individual cases and believed the business community would have their own judgement on Hong Kong’s situation under the newly imposed National Security Law.

Dissatisfied with the response from Adams, former Conservative Party Leader Iain Duncan Smith described the freezing of the bank accounts of Ted Hui and his family as an “outrage”, and that the UK government should stop these actions at once. However, Adams still did not respond directly but reiterated instead that China had made historical promises and would like to see China adhere to those promises.

Help Hong Kong residents flee before it's too late, fugitive democracy figure urges

Time is running out to help Hongkongers before the expected introduction of powers banning people from leaving as China tightens its grip on the city.

A pro-democracy politician Ted Hui, who exiled to the UK while on bail before moving to Australia, said world must provide ‘lifeboat plans’ ahead of expected travel bans.

The Hong Kong government recently unveiled proposed legislation to give the immigration department “unfettered powers” to stop people leaving. With no remaining opposition in Hong Kong’s legislature, the amendment is likely to pass and would take effect on 1 August.

MPs to question HSBC chief over freezing Hong Kong pro-democracy accounts

HSBC's chief executive will be hauled in front of MPs next week to explain why the bank has frozen the accounts of pro-democracy activists in Hong Kong.

The bank has avoided public comments on the deepening crisis since it backed Beijing's controversial security law for the former British colony last year. HSBC's profits are heavily dependent on China.

The crackdown criminalises anti-government movements in Hong Kong, resulting in the arrest of dozens of pro-democracy figures since it was imposed last summer.
