Hong Kong Police Verbally, Physically and Sexually Abuse Reporter: Threat of Gang Rape After Arrest

On 9 February at around 2am, Hong Kong police arrested a reporter from the City Broadcasting Channel (CBC) on the suspicion of theft. The reporter remained in police custody for 24 hours. In those 24 hours before he could be released on bail, he was exposed to repeated threats and was sexually harassed by police officers.

Police arrested the reporter in Tseung Kwan O while he was covering the conflict there. The reporter was hit by pepper spray from the police. As he attempted to clean the residue of the spray, an agitated police officer pointed at the reporter, exclaiming "this was the guy who was obstructing me, arrest him!”

CBC made a public announcement to denounce the violent and inappropriate actions of the police that night. CBC emphasised that their reporter was attacked despite carrying a press pass and wearing his reflective vest which clearly indicated the victim’s identity as a reporter.

Furthermore, before being arrested, the reporter did not obstruct the police while performing their duties in any way. Yet, the police still arrested the reporter and swote at him, branding him as a “corrupt reporter" during the arrest. These actions are not only extremely disrespectful to professional reporters, it is also a clear violation to the freedom of the press under the Basic Law.

In addition, while transporting the reporter to the police station, the policemen on board verbally abused and sexually harassed the reporter repeatedly. The policemen even went as far as calling the reporter “A damned gay cxxt” and threatened to gang rape the reporter multiple times.

These remarks are in clear violation of Section 2(5) of the Sex Discrimination Ordinance (Cap. 480, LHK), which states that a person (howsoever described) sexually harasses a woman if

(a) the person
(i) makes an unwelcome sexual advance, or an unwelcome request for sexual favours, to her; or
(ii) engages in other unwelcome conduct of a sexual nature in relation to her,
in circumstances in which a reasonable person, having regard to all the circumstances, would have anticipated that she would be offended, humiliated or intimidated; or
(b) the person, alone or together with other persons, engages in conduct of a sexual nature which creates a hostile or intimidating environment for her."

Although the CBC reporter is male, it is worth noting that the ordinance covers sexual harassment of both men and women, and the above definition shall have effect regarding sexual harassment of men with such modifications as are necessary. (Section 2(8) of the Ordinance).

The Police's abuse of power and threats made against the CBC journalist showed the utter lack of respect the Hong Kong Police Force have for the arrested.

Furthermore, according to Chapter 39-05 of the Police General Orders, all officers at the scene of an incident shall:-

(a) facilitate the work of the news media as much as possible and accord media representatives consideration and courtesy; and
(b) not block camera lenses.

This proves that the actions of the officers involved in this incident are not only illegal, but also breached the police general orders, which is a set of rules that the police must follow before exercising their powers in public in order to protect the interests of Hong Kong people.

This incident is just one of many where the police have been suspected of using excessive violence and abusing their power and authority while handling protests and other related events.

"A male riot police threatened me in a loud voice: 'Dare you not to answer Madam's (i.e. colloquial term for a female police officer) question? Do you want me to send you to San UK Ling Holding Centre?' (Editor's note: The police used the San UK Ling Holding Centre to process many protesters in August and September last year. It is alleged that the police tortured the arrestees inside but the police has denied this allegation.)

The female riot officer said in my ear: 'Once you are (at San UK Ling Holding Centre), I don't know what the officers taking over would do to you.'

While sitting on an iron chair the next day during my third search, two female arrestees were sitting next to me. A plaincloth police officer was chatting with the Duty Officer and said: 'Three female cockroaches were arrested?' (Editor's note: "Cockroaches" is a demeaning term used by the police to describe protesters.) The Duty Officer responded: 'Yes, you can pick the one you like and rape her.' Then they laughed together.

Another good friend was arrested another day. When she was in the police car, the police said to her: "Do you believe that I would put stones in your backpack and throw you into the sea?"

Pro-democracy restaurant received numbers of complaints and threats. T Tea House owner: Why do I have to be scared when I have done nothing wrong?

T Tea House, a restaurant in Tai Po, has been famous because of its pro-democracy stance. Since the restaurant spoke out last year, it has been crowded with customers every day. As the revenue boosted up, however, as well as the number of complaints and threats the restaurant received. The restaurant was also accused of violating the Trade Descriptions Ordinance and was required to make a statement at the police station a couple of weeks ago. Netizens were concerned that T Tea House was targeted because of its standpoint.

Ben, owner of T Tea House, said the government department in charge even jokingly said they were the "No.1 in Tai Po" because of the overwhelming number of complaints they received. The restaurant's service had to be suspended for some time because of that. T Tea House has also received threatened phone calls and was splashed with red paint before.

"There's no reason I have to be scared", said Ben, "I've done nothing wrong". When being asked if he was worried about getting revenge when the movement cools down, Ben said "That's out of my hands. The government is so dirty, they can arrest anyone they don't like in just one word".

Estonia condemns Beijing for implementing National Security Law in Hong Kong,
Eastern Europe sees China and Russia as foremost
threats

At a time of increasing tension between China and the United States, many Eastern European countries are gradually changing their attitudes, equating China with Russia as their main threat, openly criticizing Beijing, and even withdrawing cooperation on infrastructure projects.

At the United Nations, Estonia joined other countries in condemning Beijing's push for the National Security Law in Hong Kong, and opposition parties called for a stronger government towards China.

The Chairman of the Foreign Affairs Committee of the Estonian parliament, Enn Eesmaa, said he joined other lawmakers in condemning China's push for the National Security Law in Hong Kong. Estonia joined more than 20 countries in a similar statement at the UN Human Rights Committee late in June 2020.

The Estonian president visited China in September 2018 to meet with Chinese President Xi Jinping, Premier Li Keqiang and others but mentioned the "Chinese threat" three times in the past year. She said it may even be more significant than Russia's and called for vigilance against China's expanding influence.

The leader of the Estonian Reform Party, Kaja Kallas, criticized China's persecution of Uyghurs in Xinjiang as equivalent to the Nazis' treatment of Jews in Germany and called on the government to be tougher to China and to criticize Russia for human rights violations. She also mentioned that the Estonian government did not even dare to publicly and formally thank Taiwan for providing health care supplies to Estonia.

HK Journalist Reporting Police Brutality Does Not Back Down Despite Threats

Wanchai district councilor #LeungPakKin was a journalist for #RicePost on the scene of the 8.31 Prince Edward Attack, and had recorded video of the attack as it unfolded in 2019.

Earlier in August 2021, someone had mailed him a box cutter blade, along with a threatening letter: "Shut up about 8.31, and your family will stay safe".

In response to inquiries by Stand News, Leung saif that he will not keep quiet because of the letter. He says that the attack had been a collective memory of everyone, and it will not disappear simply because he stopped talking.

He elaborates on his thoughts on the letter on his Facebook page, stating that it didn't have to be him talking about the 8.31 attack by the police. "The video already showed everything. The people and events in the video are the most important [proof]. The violence dealt by the armed men in the video, whether they're reasonable, whether they're proportional - there's no need for me to say more."

Leung said that he had turned down all interviews since last year.

Hong Kong Ex-Policeman pleaded guilty to threatening and abusing his own daughter

A 42-year-old former policeman allegedly demanded his ex-wife to see him within 30 minutes, otherwise he would kill their 8-year-old daughter.

Over the phone, the wife could hear her daughter crying and begging the father: "Daddy, please don't. Daddy, please don't. I don't want to use the knife."

The daughter testified in court, and recounted that the man asked her if she wanted to "go with him", which she understood to mean dying. She answered yes at the time, though she didn't want to die.

Later on, when police arrived at the scene, they caught the man attempting to strangle his daughter with a leather belt around her neck and threatening her with a knife.

The man appeared in court on April 21 and pleaded guilty to criminal intimidation and child abuse. He is remanded until his sentencing on May 11.

#China Intervenes #UN Human Rights Report on Xinjiang

According to #Reuters report on July 22, 2022, China, through a letter written by the Chinese mission, has asked the U.N.’s Office of the High Commissioner of Human Rights to halt the release of the report on the human rights situation in #Xinjiang. This has been confirmed by three diplomats who received the letter.

U.N. High Commissioner for Human Rights Michelle Bachelet was widely criticized for her tepid performance during her visit to China in May 2022. Bachelet has since announced that she will not be seeking a second term as High Commissioner, citing personal reasons. However, she has promised to release a human rights report on Xinjiang before her tenure ends at the end of August.
