Nathan Law writes to New Zealand PM to Urge Implementation of "Lifeboat Scheme" to Help Hong Kong Protesters

#NathanLaw, former Chairman of Demosisto, said on Facebook on Oct 22 that he had written to the recently re-elected Prime Minister of the New Zealand Labour Party, Jacinda Ardern, in the hope that New Zealand would follow the lead of other members of the #FiveEyesCoalition and open up the "#LifeboatScheme" to Hong Kong's protesters, so that those who face political challenges would be able to enjoy the benefits of the scheme. The young people who are being persecuted have another way to find safety. The New Zealand Prime Minister's Office said it has received the letter, which was sent to the Ministry of Foreign Affairs for consideration.

Law has been in exile overseas since the implementation of the Hong Kong National Security Law. He hoped that New Zealand would respond quickly to the proposal, and work with democratic countries to defend human rights and freedom against the expanding authoritarianism of the Chinese Communist Party. He said he would work with legislators from different countries to promote various initiatives in support of Hong Kong, so that a consensus of global solidarity against China could soon be established.

New Zealand's attitude towards China has become tougher in recent times. Although not as high-profile as other countries in the Five Eyes alliance, New Zealand has gradually adopted various measures to deal with the threat from the Chinese Communist Party. Law says that apart from helping protesters, increasing diplomatic pressure on China is also an important tactic. He noted that more and more countries are lending a helping hand to Hong Kong protesters due to the National Security Law undermining the rule of law in Hong Kong. "This trend lends even more legitimacy to stronger international pressure" against China, he says.

UK Launches Immigration Route for Hong Kong's BNO Holders and Families, Welcoming Pro-democracy Protesters

The British government announced on October 22, 2020, that the Hong Kong BNO Visa will open for application from January 31, 2021, with no quota being set.

British Consul-General Andrew Heyn stressed in his statement that no attempt would be made to reject applications from those being convicted for involving in non-violent protests or exercising the freedom of expression.

London originally planned to extend the immigration rights of BNO holders on July 1, 2020 the day after China imposed a draconian national security law on Hong Kong. The British government explained that the attempt to alter BNO status was a response to the Chinese Government's hindrane of the rights, freedoms and autonomy of Hong Kong citizens which was also a violation of the Sino-British Joint Declaration.

“The imposition of the National Security Law on Hong Kong marked a clear erosion of the rights and freedoms towards the people of this city,” said Andrew Heyn in a statement. “This new route to the UK is part of our commitment to the people of Hong Kong. The UK is ready to welcome BNO citizens and their dependents to the UK.”

5 Unaccredited Labs Appointed for Hong Kong's COVID-19 Mandatory Testing

The Hong Kong Government has been requesting specific high-risk groups to undergo mandatory COVID-19 testing. An investigation by Apple Daily revealed that among 69 high-risk groups, 35 were tested by 5 appointed testing laboratories. However, none of these 5 providers were accredited under the Hong Kong Laboratory Accreditation Scheme (HOKLAS).

More alarming is the fact that some of these laboratories boasted of having “hospital-level laboratory equipment”. This is potentially misleading.

A staff member at one of the appointed laboratories acknowledged that the company is seeking ISO accreditation, although he insisted its operation is “meeting the requirements”.

A professional medical technologist pointed out that HOKLAS accreditation is a basic-level requirement of testing laboratories. He opined that it is absurd for the government to appoint a testing lab without HOKLAS certification to carry out COVID-19 mandatory tests for citizens of Hong Kong.

HK Police suspected of using encrypted devices without recording function during enforcement operation; Lawmakers: a deliberate attempt to ditch legal liability

Since last year, massive deployment of Hong Kong Police was often seen on public occasions for various operations. However, none of the Force's mobility and instructions concerning these operations have been disclosed to public, with recordings of their intercom devices be the only source.

An Apple Daily’s investigation revealed that some police officers were suspected of using “privately encrypted” devices without recording function during enforcement operations to avoid communications being recorded.

These devices are available for sell in street stalls in Hong Kong and online stores in China, costing only several hundred Hong Kong Dollars. Anyone using the same model of device can pick up the communication channel to talk and listen.

Legislators condemned such suspected practices of Hong Kong Police a deliberate attempt to ditch legal liability of their unlawful actions. The Force, in the meantime, has not responded to Apple Daily’s inquiry, saying only that they would look into the matter.

DoJ Applied to Transfer Reporter's Damage Claims to High Court, Rejected by Judge: "Out of Touch with Reality"

A student reporter from Polytechnic University Campus Radio was hit by a police pepper shot while covering a police dispersal operation in Mongkok last November. His mobile phone was damaged, for which he filed a case in the Small Claims Tribunal for $788 to cover repairs and litigation costs.

However, when the case was heard again on October 21, the Department of Justice (DoJ) applied to transfer the case to the High Court, claiming the details were complicated, and that a trial would be more fair and impartial with legal representatives for both sides. The judge denied the application, and criticized the DoJ's claims as "out of touch with reality". The judge further stated that the student journalist may not be able to afford the High Court's legal fees, and legal aid might not be granted due to the low value of the claim.

The judge also pointed out that the DoJ had earlier applied to dismiss this case, claiming it was frivolous and vexatious, but now it was applying to transfer the case to the High Court. If the transfer was granted, the claimant would have to draft a statement of claim; the judge questioned the waste of litigation fees to send the case to the High Court: "Why not simply deal with it here in the Small Claims Tribunal?"

Editor's note: Hong Kong's Small Claims Tribunal deals with monetary claims not exceeding $75000. No legal representation is allowed.

US State Department approves US$1.8bn weapons sale to Taiwan amid tension with China

The State Department of the United State formally notified Congress the approval of US$1.8 billion (around NTD 13.95 billion) sales of weapons to Taiwan on Oct 21 (Wednesday), including missiles and rocket systems.

The formal notifications to Congress covered 11 truck-based rocket launchers made by Lockheed Martin Corp, 135 Standoff Land Attack Missile Expanded Response (SLAM-ER) Missiles and related equipment made by Boeing Co, and six new external sensor pods for F16 fighters made by Collins Aerospace, for enhanced intelligence gathering ability of F16 fighters.

Further congressional notifications are expected to follow, including drones and land-based Harpoon anti-ship missiles to serve as coastal defense cruise missiles. Sources told Reuters news agency the weapons would cost about US$2 billion.

The formal notification gave Congress 30 days to object to the eighth sales of weapons to Taiwan during Donald Trump’s presidency, but there is broad bipartisan support for the defense of Taiwan.

12 U.S. Universities Received Over a Billion Dollars in Anonymous Donations from China and Russia, Which Could Lead to Technology Transfer Leakage

The U.S. government has been very concerned about Chinese communist infiltration on campuses in recent years. The U.S. Department of Education has just released a survey on 12 famous U.S. universities, saying that many of them did not declare funds from China, Russia and other "hostile countries against the U.S.". The survey also indicated that the corresponding universities received US$1.14 billion in anonymous donations from countries such as China and Russia since 2012, most of which have financial ties to high-risk national security organizations, such as Huawei.

The Department of Education stated that because of the lack of transparency and supervision of the details of the donations, these foreign funds would be subject to conditions that allow foreign governments to gain access to sensitive research technologies, restrict academic freedom, and expand their soft power or publicity. The 12 universities, including Harvard, Yale, Stanford, MIT and other famous universities, are under investigation.

In fact, since last year, U.S. politicians have begun to criticize the CCP infiltration of campuses. The U.S. Senate Homeland Security and Government Affairs Committee released a cross-party report at the beginning of last year, reprimanding the CCP for conducting political propaganda on U.S. campuses through Confucius Institutes. As a result, the Department of Education stepped up its investigation of universities. At the middle of last year, they announced in the middle of last year that 12 universities involved in undeclared foreign funds of US$6.5 billion.

It is worth noting that the report specifically listed two major issues. One of them was "national security". Many universities were accused of receiving donations from Huawei for research, and some even participated in a research commissioned by Alibaba on crowd surveillance.
