Hong Kong Today in History: Do you know what had happened in Hong Kong on the 27th in the past 9 months?

27 June, 2019:
Protesters encircled Justice Place calling for withdrawal of the Extradition Bill.

27 July, 2019:
Citizens initiated a march in Yuen Long in protest of the suspected Police-Triad collusion in the 7.21 Attack.

During the march, police fired numerous tear gas canisters, fuming elderly home and residences in the district.

Contrary to the police inaction toward the 7.21 triad attack, the police rounded up and attacked civilians at Yuen Long West Rail station after the march on 27 July. The police behavior reminds many of the brutal scenes on 21 July.

September 27, 2019:
Arrestees who were physically and sexually violated by the police at San Uk Ling Holding Centre gave their testimony in public. Citizens filled Edinburgh Place to root for the victims and protest against police brutality.

27 October, 2019:
A rally took place in Tsim Sha Tsui, with an aim to show solidarity with journalists and demand probing police brutality
Investigate Police Brutality.

27 November, 2019:
Police sieged and attacked the Hong Kong Polytechnic University (#PolyU) for consecutive days. Police called all civilians trapped inside the campus, including students, teaching staff and others, "rioters".

Police officer contracted Coronavirus refuses to wear mask, putting safety of medical staff at risk

Ho Yuen-ha, Chief Administration Manager of Hospital Authority pointed out that when the female police officer came to seek medical assistance, two phlebotomists with surgical masks and gloves, found that she was coughing and not putting on a mask. They advised her to wear mask and left. However, she was still found not wearing a mask after a while. Ho call for all patients to follow the instructions of medical staff and wear masks when seeking medical treatment.

Since it takes more than 15 minutes to collect blood samples and conduct electrocardiogram examination, two phlebotomists were deemed close contacts of the female police office, a carrier of coronavirus. They will undergo a quarantine of 14 days.

The Police expressed deep regret for the female officer who contracted Coronavirus, and refused to put on mask when receiving medical examination in Caritas Hospital.

The female police officer was not wearing filter mask when phlebotomists collected her blood sample, so they were deemed close contacts of the officer and required to undergo a quarantine for 14-days. One of the phlebotomists was not well and sought medical assistance in Accident & Emergency unit of the hospital.

The police stated on its social media platform today (March 27) that the Force is deeply concerned, expressing that the officer had insufficient awareness of epidemic prevention. They have immediately approached her to understand the incident and asked her to follow instructions of medical staff to protect others from being infected.

In order to prevent similar incidents, the police remind all its officers to support medical staff's epidemic prevention work and to maintain personal hygiene at all times to reduce the risk in virus transmission.

Editor Note: The police has been wearing masks in previous monthes, before the outbreak, to hide their identities. However, in the past few weeks, quite a number of police officers could be seen without masks when conducting their operation.

Prince Edward and Lai Chi Kok MTR Station CCTV Footage Delivered to Student’s legal representative, Video length exceeds 90 hours

Kex Leung Yiu-ting, president of Education University Student Union who has accused police officers of assault and unlawful arrest, was granted access by the High Court to request video footage from two MTR stations for the incident on Aug 31, 2019, despite objections from the Cooperation.

On Mar18, High Court ordered the MTR Corporation to hand over CCTV footages from Prince Edward and Li Chi Kok Station within 7 working days. Mar 27, being the last day before the deadline, MTR Cooperation delivered relevant footages to Leung’s lawyer. The total length of the clips exceeds 90 hours.

Leung has promised the court that the footages would only be used for legal actions and would not be released without the court’s permission. He stated that the clips would be examined by a team of lawyers for further legal actions.

HK Police denies medical assistance of an elderly in custody

A 80-year-old man with chronic diseases including high blood pressur was charged with threat of destroying other people's property. On March 22, the man argued with his neighbour over noise issues and threatened to kill

During the court hearing on March 25, the defense complained about maltreatment: during the detention in police station, he severed diarrhea, but "no police office was willing to send him to hospital".

Until the lawyer and his family learnt about it and made specific request, the old man was then sent to hospital for medical treatment.

However, the police officer did not carry the elderly's ID card to the hospital, which hindered doctors from looking into his medical records. Even worse, police officers kept urging the doctors to discharge the old man so that they can continue their investigation.

Charge of Seditious Intention Has political meaning;
Law Professor: Might trigger a time bomb for the government

Member of Democratic Party and Chairwoman of Central and Western District Council Cheng Lai-king was arrested on Mar 26 by the police under the charge of “Seditious Intention”.

In an interview with Hong Kong's Commercial Radio on March 27, Johannes Man-mun Chan, Chair Professor of Law at the University of Hong Kong, saix that the charge of "sedentious act" is a political persecution, as the interpretation of the ordinance is vague to such an extent that citizens are actually prone to offend the ordinance, whenever they criticize a social issue. If the ordinance is brought to court, it is likely to be adjudicated as a breach of human rights, and would stir up more unrest.

Charging Civilians for 'Seditious Intention' Carries Political Meaning;
Law Professor: A violation against human right

Member of Democratic Party and Chairwoman of Central and Western District Council Cheng Lai-king was arrested on Mar 26 by the police under the charge of “Seditious Intention”.

Johannes Man-mun Chan Chair Professor of Law at the University of Hong Kong, pointed out that the "Seditious Intention” mentioned in the 9th and 10th Sections of the “Crimes Ordinance” is controversial, as it is deemed a political persecution.

Chan believes that many clauses in the ordinance such as “to raise discontent or disaffection amongst Her Majesty’s ["the PRC government’s” since the handover] subjects or inhabitants of Hong Kong” and “to promote feelings of ill-will and enmity between different classes of the population of Hong Kong” are open for interpretation. Literally, they do not point to violent behavior or inciting violence. “What does the word 'discontent' mean anyway? Are we offending the ordinance whenever we feel discontent in our everyday life?”

Chan also pointed out the difference between “Sedition Intention” offence and other crimes, as the former is based on "objective intent". While subjective intent refers to the actual state of a person's mind, objective intent argues for a person's intentions regardless of what the person thinks. Therefore, the charge of seditious intent carries a strong political meaning.

Chan further explained that even an emotive speech in a rally could be charged for "seditious intent" when the person has not taken any action. This is a violation of the freedoms granted in Hong Kong's Basic Law.

Normally, a government would avoid making charges based on such a controversial ordinance, but "our government often makes unexpected moves,” said Chan. In the past the legal sector had criticized the Sedition act heavily. Chan believed that the ordinance involved human rights issue and the government should not bring the ordinance into the court to trigger a time bomb.

“The court would probably rule that the charge is a violation of human right, and the prosecution would definitely reach the Court of Final Appeal. No matter how it was handled, it would stir up political disturbances.”

Hong Kong Authorities’ Arrest of Pro-Democracy Politician for “seditious intent” Heightens Concerns of a Renewed Crackdown

Statement from Human Rights Watch (HRW):

//“Arresting a pro-democracy politician for seeking police accountability is political persecution, not legitimate policing,” said Sophie Richardson, HRW's China director. “Hong Kong authorities should immediately drop the case against councilor Cheng Lai-king.”

Following Cheng’s arrest, a Hong Kong police spokesperson said that Cheng had “illegally shared personal information”...The spokesperson said that she may also have violated an October court injunction banning “doxing” of police officers – the disclosure of personal data on the internet – and the Privacy Ordinance.

“Seditious intent” is a crime that has not been invoked since 1952, when the British colonial government used it against the pro-Beijing newspaper Ta Kung Pao.//

Support for Hong Kong protesters' demands rises even as coronavirus halts rallies

"Support for the demands of pro-democracy protesters in Hong Kong has grown even as rallies have paused due to the coronavirus outbreak, according to a survey conducted for Reuters that also showed a widespread lack of confidence in the government’s ability to manage the COVID-19 crisis.

Demands for the resignation of Hong Kong’s leader, Carrie Lam, were supported by 63% of respondents in the poll, conducted by the Hong Kong Public Opinion Research Institute between March 17-20, versus 57% in a poll it conducted in December.

Supporters of the protests outnumbered opponents by a ratio of roughly two to one, with 28% against them compared with 30% in a poll in December, and 58% supporting them, versus 59% previously.

The poll showed a significant increase in the levels of support for key demands of the often-violent demonstrations which rattled the city..."

Chinese celebs, netizens slam 'two-faced' Hugo Boss over Xinjiang

Hugo Boss had a post on its Weibo account on Mar25 that it would continue to purchase and support Xinjiang cotton. However, the post was deleted on Friday. A new official statement in its Weibo account was issued to say that it cherished all longstanding relationships with partners in China.

Chinese netizens have accused Hugo Boss for backtracking on its position, saying the brand was being “two faced”, with some vowing to boycott the brand for good. “A two-faced person is the most disgusting. I’ll boycott you forever,” said a Weibo user.

Missing Hong Kong Pro-democracy Activist Reportedly Detained in HK Psychiatric Centre

Pro-democracy activist Andy Li, whose whereabouts was not confirmed by the Hong Kong authorities, was reportedly detained in Siu Lam Psychiatric Centre. According to Apple Daily, Li was guarded under high security by a special unit in the Department of Correctional Service, and is currently detained in isolation.

Li was one of the 12 pro-democracy Hongkongers who were arrested and jailed in China after attempting to flee the city in August last year.

On March 22, 2021, Li and 8 others who had completed their jail sentence in China were sent back to the Hong Kong into police custody for further interrogation and detention.

However, Li was the only one who insofar has no contact with his family and lawyer ever since his assumed arrival in Hong Kong. His family has made inquiries to the Hong Kong Police Force and the Department of Correctional Service earlier; but no government department had information on his whereabouts.

As the #XinjiangCotton controversy intensifies, many artists unilaterally terminated their collaboration with a number of brands. Chinese netizens are now targeting at professional soccer teams, demanding them to change their sponsors.

Shanghai Shenhua F.C., one of the teams in the Chinese Super League, was found to have photoshopped away the Nike logo on their practice jersey on their photos posted on the Chinese social media platform #Weibo.

China, With $400 Billion Iran Deal, Could Deepen Influence in Mideast

China and Iran signed 25 years investment agreement on Mar 27. Iran did not make the details of the agreement public before the signing, nor did the Chinese government give specifics. But experts said it believed that China agreed to invest $400 billion in Iran over 25 years in exchange for a steady supply of oil to fuel its growing economy.

The deal could deepen China’s influence in the Middle East and undercut American efforts to keep Iran isolated. But it was not immediately clear how much of the agreement can be implemented while the U.S. dispute with Iran over its nuclear program remains unresolved.

The draft also called for deepening military cooperation, including joint training and exercises, joint research and weapons development and intelligence-sharing.

Xinjiang cotton is some of the best fabric in the world. It's also, human rights campaigners say, produced by forced labour.

Please bear in mind that Xinjiang cotton accounts for 85% of Chinese production and 20% of world supply.

Some Western brands have removed it from their supply chains, leading to a backlash from Chinese celebrities and netizens. Welcome to the row over cotton from the Xinjiang region of China.

Certification schemes for cotton mills, such as Yarn Ethically & Sustainably Sourced (Yess), work to eliminate forced labour from the supply chain.  But that's of limited help to you as a consumer if you're just ordering a pair of jeans off a retailer's website. 

"If you really want to be confident of the traceability of the cotton in your jeans, you have to look for Soil Association organic cotton or Fairtrade," advises Clare Lissaman from Common Objective (CO), a sustainable fashion sourcing platform.

US fears China is flirting with seizing control of Taiwan

The US is concerned that China is flirting with the idea of seizing control of Taiwan as President Xi Jinping becomes more willing to take risks to boost his legacy.

“China appears to be moving from a period of being content with the status quo over Taiwan to a period in which they are more impatient and more prepared to test the limits and flirt with the idea of unification,” a senior US official told the Financial Times.

The simulation occurred as Chinese warplanes spent two days flying in and out of Taiwan’s air defence zone just days after Biden was sworn in, in what was the largest Chinese exercise in the area until the intrusion on Mar 26. One US defence official said the incident was not the first time China had simulated attacks on US ships.

China: Companies should resist boycott threats

Human Rights Watch said that companies threatened with Chinese government-promoted boycotts should stand firm in their opposition to forced labor.

Chinese authorities have recently encouraged consumers across China to boycott companies that have publicly expressed concerns about forced labor and other human rights violations against Uyghurs in Xinjiang.

“The Chinese government’s actions, effectively punishing the companies trying to uphold those standards, are a brazen attempt to weaken an emerging global norm,” Human Rights Watch said.
