Boundary between #China and Hong Kong Continues to be Eroded

It is not the first time for the Chinese and the Hong Kong Governments to deliberately blur the boundary between the territory of China and that of Hong Kong.

According to a pro-Beijing press Sing Tao Daily, the Shenzhen authorities would re-build the Lo Wu Port, a checkpoint at Hong Kong-China border, and extend the East Rail Link terminal running across Hong Kong to Shenzhen.

In addition, the Chinese authorities would want to impose a co-location plan in China's territory at the Lo Wu Port, such that Hong Kong immigration officers would go to Shenzhen in China to handle “departure” procedures while “arrival” formalities would be handled by the Chinese authorities.

The news has raised worries over the possible "direct #extradition to China" by entering China's juridiction area at the shrinking border between Hong Kong and China.

Bank of China client information "extradited to China", data on the opening of accounts and loans sent to Guangxi subsidiary for processing approved by Hong Kong Monetary Authority

Stand News has learned that the Bank of China (Hong Kong) [BOCHK] intends to allocate a portion of its data processing and auditing work to its wholly-owned subsidiary in Nanning, Guangxi. This has been approved by the Hong Kong Monetary Authority [HKMA]. However, whether its clients are aware that documents containing their personal information, including assets and loans, are to be "extradited to China" remains questionable. The BOCHK responded that they strictly adhered to the relevant laws and regulations in Hong Kong to ensure the proper handling of client information. The Office of the Privacy Commissioner for Personal Data [PCPD] stated that organisations that transfer information should inform their clients.

Finland Annuls Extradition Treaty with Hong Kong after China Enforces National Security Law in Hong Kong
 
After the National Security Law was put into effective in Hong Kong on 30 June 2020, Australia and Canada had both announced suspension of their extradition treaties with Hong Kong.  

On 13 July, Finland’s Foreign Minister Pekka Haavisto had also announced that under the Hong Kong National Security Law, the extradition treaty between Hong Kong and Finland would no longer be applicable. 
 
As stated in a Reuters report, Haavisto told a press conference that the current situation has changed from the time when Finland first signed the treaty, thus the extradition agreement with Hong Kong “should not be applied”.

#Germany to Suspend Extradition Agreement with Hong Kong; #WhiteHouse Condemns Disqualifications and Election Delay

Germany Foreign Minister Heiko Maas said after Carrie Lam postponed a Sept. 6 election to the Chinese-ruled city’s legislature by a year:

“The Hong Kong government’s decision to disqualify a dozen opposition candidates for the election and postpone the elections to the legislature is another infringement on the rights of the citizens of Hong Kong.

We have repeatedly made our expectation clear that China lives up to its legal responsibilities under international law”.

White House spokeswoman Kayleigh McEnany condemns Hong Kong's decision to delay election:

"This action undermines the democratic processes and freedoms that have underpinned Hong Kong’s prosperity.

This is only the most recent in a growing list of broken promises by Beijing, which promised autonomy and freedoms to the Hong Kong people until 2047 in the Sino-British joint declaration.”

The President of Poland signed the “Taiwan-Poland Criminal Justice Cooperation Agreement”, becoming the first European country to cooperate on legal matter including extradition and prisoner transfer

Ministry of Foreign Affairs of Taiwan announced that Poland President Andrzej Duda has signed the “Taiwan-Poland Criminal Justice Cooperation Agreement” on 28th February and became the first European country to sign such agreement with Taiwan, which covers mutual assistance with criminals, extradition, and transfer of criminals. The agreement was approved unanimously by the Polish Sejm (lower house) and the Senate (upper house) and will take effect after the President signs the agreement.

“Taiwan-Poland Criminal Justice Cooperation Agreement” was co-signed by the representatives of two countries in the Ministry of Foreign Affairs of Taiwan in June 2019. After the coordination between the two governments, the Taiwan Legislative Council completed the third reading of the agreement in December 2019 and notified the Poland side. Poland went through the legal process, including unanimous approval by the Polish Sejm and the Senate, official sign-off by the president Andrzej Duda on 28th January 2021, and finally its announcement. The agreement will take effect as soon as Taiwan receives formal notification from Poland.

//The UK government is alerting people in Britain who were named in a Hong Kong national security case to avoid travelling to countries that have extradition treaties with the Chinese territory...

The warnings underscore concern among US allies that China might reach beyond its borders to prosecute people for crimes under a Beijing-drafted national security law imposed on Hong Kong last year.

The sweeping legislation asserts global jurisdiction for cases involving terrorism, secession, subversion and collusion with foreign powers, which carry sentences as long as life in prison

Nine countries, including Germany, the UK and the US, suspended their extradition treaties with Hong Kong following the imposition of the sweeping legislation in June 2020.

Still, China has almost doubled its extradition treaties to more than 50 since 2012, as the country pursued fugitives overseas as part of a years-long graft crackdown under President #XiJinping.

Beijing ratified an extradition pact with #Cyprus last year, and approved a similar one with Belgium earlier this year.//
