Biden, Von der Leyen, announce agreement ‘in principle’ on transatlantic data flows

US President Joe Biden and European Commission President Ursula von der Leyen declared on Friday (25 March) the two sides had reached a political agreement on international data transfers, a move cautiously welcomed by industry and analysts.

The agreement at the political level, announced at a joint press conference in Brussels, paves the way for a successor to the Privacy Shield deal, which provided the legal framework for transferring personal data to both sides of the Atlantic until it was invalidated by the Court of Justice of the European Union (CJEU) in July 2020.

Since then, EU officials and members of the US administration have been scrambling to find a legal basis for a new agreement. The core issue is the US surveillance laws, which allow intelligence services to access personal data with little scrutiny and no possibility to readdress.

India Orders VPN Companies to Collect and Hand Over User Data

A new government order will force virtual private networks to store user data for five years or longer.

In India, virtual private network companies will be required to collect extensive customer data -- and maintain it for five years or more -- under a new national directive from the country's Computer Emergency Response Team, known as CERT-in. It's a policy that will likely make life more difficult for both VPN companies and VPN users there.

The body, under the country's Ministry of Electronics and IT, announced Thursday that VPNs in the country will have to keep customer names, validated physical and IP addresses, usage patterns and other forms of personally identifiable information. As first reported by Entracker, those who don't comply could potentially face up to a year in prison under the governing law cited in the new directive.

The directive isn't limited to VPN providers. Data centers and cloud service providers are both listed under the same provision. The companies will have to keep customer information even after the customer has canceled their subscription or account. And, in all case, CERT-in will require the companies to report on their users' "unauthorized access to social media accounts."

#EU Commission is expected to publish the draft law on "chat control" tomorrow. Lawmakers seek AI-based checks of all message content & images directly on users' devices in order to bypass encryption protocols.

Critics say this is an attack on the digital privacy of correspondence and leads to mass surveillance.

German Chaos Computer Club protests against the planned "chat control" law in an open letter. Says it is a "fundamentally misguided technology" and an "unprecedented surveillance tool".

Users in Texas, Illinois can no longer use certain filters on Instagram and Facebook

Fun social media filters are now banned in Texas and Illinois. Meta turned off AR #filters in the two states after they accused the company of misusing #facial #recognition technology.

Some filters are still available on apps like #Facebook and #Instagram, but the filters that use facial recognition are now gone, thanks to new state laws.

#Texas accused #Meta of violating #privacy rights through its technology.

In #Illinois, a class-action #lawsuit that restricted the use of #biometric data was settled.

Texas has a similar case pending.

However, Meta doesn’t believe that its technology violates facial recognition laws in Illinois and Texas.

Meta said it plans to roll out an opt-in system that would explain how its technology works and continue offering filters that map out users’ faces.

#Signal would 'walk' from UK if Online Safety Bill undermined encryption - BBC News
https://web.archive.org/web/20230224103103/https://www.bbc.com/news/technology-64584001

The encrypted-messaging app Signal has said it would stop providing services in the UK if a new law undermined encryption.
If forced to weaken the privacy of its messaging system under the Online Safety Bill, the organisation "would absolutely, 100% walk" Signal president Meredith Whittaker told the BBC.

The Online Safety Bill (UK) will bring in client-side scanning, a tech for moderating content on encrypted services. Apps will have to compromise encryption to scan your message, putting a spy in your pocket.
