Aim:::::::::::::::
The key aim behind the move is to rebuild the education system of the country, which is at present broken, as per the Union HRD Minister.
The Minister said many students have moved from private schools to govt schools in some states, such as Sikkim, Kerala and Telangana.
He added that teacher training, quality and accountability are most important & while stating that there is no shortage of teachers, he said that their deployment is not right.
Significance:::::::
The legislation is significant as it brings accountability in the elementary education system.
The proposal received the support of a majority of state governments.
RTE amendment Bill : Key Provisions ::

• The Bill seeks to amend the Right to Education (RTE) Act to abolish the “no-detention” policy in schools. Under the current provisions of the Act, no student can be detained up to class VIII.
• As per the amendment, it would be left to the states to decide whether to continue the no-detention policy.
This Bill has been analysed by a Parliamentary standing committee, which also recommended bringing back the concept of detention in schools.
• The policy has been brought back as it was felt that compelling children to repeat a class was demotivating, often forcing them to abandon school.
• The bill provides for regular examination in classes V and VIII, and if a child fails, the amendment bill grants a provision to give her or him additional opportunity to take a re-examination within two months.
• Such children will be provided with two-month remedial teaching to perform better in the re-examinations.
• If the students still do not pass the exam, the state government may decide to detain them.

The Right of Children to Free and Compulsory Education Act, 2009 (the Act) provides for free and compulsory education to all children of the age of six to fourteen years.
The Section 16 of the Act provides that no child admitted in a school shall be held back in any class or expelled from school till the completion of elementary education.
This provision was made in the said Act because examinations are often used for eliminating children who obtain poor marks, which compels children either to repeat the same grade or leave the school altogether.
It was felt that compelling a child to repeat a class is both de-motivating and discouraging.
Why the need for the amendment.?

In recent years, States and Union territories have been raising the issue of adverse effect on the learning levels of children as section 16 does not allow holding back of children in any class till the completion of elementary education.
Therefore, the amendment to the section was proposed in order to improve the learning outcomes in the elementary classes and to empower the appropriate Government to take a decision as to whether to hold back a child in the fifth class or in the eighth class or in both classes, or not to hold back a child in any class, till the completion of elementary education.
According to the Union HRD Minister, over 25 states favour abolishing the no-detention policy.

भारत में उच्च शिक्षा का इतिहास
भारत में उच्च शिक्षा का इतिहास काफी पुराना है। इसके मूल में १९वीं शताब्दी है, जब वाइसरॉय लॉर्ड मैकाले ने अपनी सिफारिशें रखी थीं। उसके बाद बीसवीं शताब्दी में सन् १९२५ में इंटर यूनिवर्सिटी बोर्ड की स्थापना की गई थी जिसका बाद में नाम भारतीय विश्वविद्यालय संघ (एसोसिएशन ऑफ इंडियन यूनिवर्सिटीज) पड़ा। इस संस्था के अंतर्गत सभी विश्वविद्यालयों के बीच शैक्षिक, सांस्कृतिक और संबंधित क्षेत्रों के बारे में सूचना का आदान-प्रदान किया जाने लगा था। भारतीय स्वतंत्रता उपरांत १९४८ में डॉ॰ सर्वपल्ली राधाकृष्णन की अध्यक्षता में यूनिवर्सिटी एजुकेशन कमीशन की नींव रखी गई।[3] इसके अंतर्गत देश में शिक्षा की आवश्यकताओं और उनमें सुधार पर काम किए जाने पर विचार किया जाता था। इस आयोग ने सलाह दी कि आजादी पूर्व के यूनिवर्सिटी ग्रांट्स कमिटी को फिर से गठित किया जाए। उसका एक अध्यक्ष हो और उसके साथ ही देश के बड़े शिक्षाविदों को भी इस समिति के साथ जोड़ा जाए।

➨58th Amendment to the Constitution of India provided for an authoritative text of the Constitution in Hindi language. It gave the same legal sanctity to the Hindi version of the Constitution.
➨According to the 91st Amendment Act of 2003 the provision of the 10th Schedule (anti-defection law) pertaining to exemption from disqualification in case of split by one-third members of legislature party has been deleted. Accordingly the defectors have no more protection on grounds of splits.
➨96th Amendment Act of 2011 substituted “Odia” for “Oriya”. As a result of that, the “Oriya” language in the Eighth Schedule shall be pronounced as “Odia”
➨Parliamentary Forum on Millennium Development Goals was created in year 2013. At present, there are eight Parliamentary forums such as Parliamentary Forum on Water Conservation and Management (2005), Parliamentary Forum on Youth (2006), Parliamentary Forum on Children (2006) etc.
➨According to the Article 124(7) of the Constitution of India, no person who has held office as a judge of the Supreme Court of India shall plead or act in any court or before any authority within the territory of India.
➨Judicial review has been declared by the Supreme Court as one of the elements of the basic structure of the Constitution, therefore, it cannot be curtailed even through a constitutional amendment. Both Supreme Court and High Court have the power of judicial review. And using judicial review, legislative enactments and executive orders of both the Central and State governments can be examined.
➨Article 312 of the Constitution authorises the Parliament to create new All-India Services on the basis of a Rajya Sabha resolution to that effect. The Centre and the states jointly control these services. However the ultimate control lies with the Central government but the immediate control vests with the state governments.
➨According to the Constitution of India a proclamation declaring financial emergency in India must be approved by both the Houses of Parliament within two months from the date of its issue.
➨‘Judicial dynamism’ refers to judicial activism which is the opposite of ‘judicial restraint’. Judicial restraint means the self-control to be exercised by the judiciary. Judicial activism, on the other hand, means the proactive role played by the judiciary to protect the rights of the citizens.
➨Judicial restraint means that the judges should play a limited role of saying what the law is, leaving the job of lawmaking for legislators and the executives. Moreover, judges must not allow their personal political values to influence their judicial opinions.
