🇵🇸 Self-defence in Israel and Palestine: Unsuspending Disbelief Research Society of International Law

In this short post, we focus on a distinct but interrelated question, namely whether Israel’s use of force against Gaza could be described as self-defence at all. Our answer is in the negative.

One preliminary comment is necessary: recently Marko Milanovic raised the question whether the prohibition of the use of force is applicable at all in the relationship between Gaza and Israel.

The question refers to the view that if Palestine is not a state with Gaza as part of its territory, the prohibition of the use of force would not apply to Gaza. We come to this question as critical legal scholars who do not wish to romanticise the concept of statehood in international law.

🇵🇸 Influential Israeli national security leader makes the case for genocide in Gaza – Mondoweiss –

In an Op-Ed titled "Let’s Not be Intimidated by the World," Israeli ret. Major General Giora Eiland argues that all Palestinians in Gaza are legitimate targets and that even a “severe epidemic" in Gaza will "bring victory closer.”

Eiland has a long history of being surprisingly forthright about his view on the state of the Gaza Strip. In 2004, then as head of the National Security Council, he regarded the Gaza Strip as “a huge concentration camp” as he advocated for the U.S. to force Palestinians into the Sinai desert as part of a “two-state solution.”

🇵🇸 UN experts call for full and independent investigations into all crimes committed in Israel and the Occupied Palestinian Territory | OHCHR –

GENEVA (27 November 2023) – UN experts* today called for prompt, transparent and independent investigations into allegations of war crimes and crimes against humanity, perpetrated in Israel and in the Occupied Palestinian Territory on 7 October 2023 and thereafter. They urged all parties to the ongoing armed conflict to protect civilians and comply with their obligations under international law.

“Independent investigators must be given the necessary resources, support and access required to conduct prompt, thorough and impartial investigations into crimes allegedly committed by all parties to the conflict,” the experts said, calling on Israel, the Palestinian Authority and the de facto authorities in #Gaza to cooperate fully with investigations.

Errors like these are harmful, when language is distorted or weaponised to harm marginalised and vulnerable people.”

Arabic team lead for Respond Crisis Translation, Ayah Najadat, talked to Middle East Eye about how she and her team help with emergency translations in Gaza and other crisis areas and correct harmful mistranslations in media reports.

One such example was when Najadat’s team corrected a video report published by the BBC about a released Palestinian prisoner which featured incorrect subtitles, distorting what she was saying. The #BBC took down the video and corrected the error following the correction by Najadat’s team.
