Saifan and the Weaponization of Trade Secrets - Verfassungsblog – June 2023

In this post, we offer an overview of current Knesset discussions; the contested legal grounds on which the Israeli police and Ministry of Justice rely for spyware authorization; and an analysis of governmental procurement of surveillance technology, with particular emphasis on the weaponization of trade secrets to strategically conceal governmental operations.

Current public engagement has chiefly focused on the uncertain legal basis for the police’s enhanced surveillance capacities as a result of using spyware. However, this is not the only concern with the use of technologies as advanced and powerful as Saifan by public bodies. In particular, we argue that the current combination of outdated laws with nontransparent operations makes public accountability and oversight with regards to how such technology is used intensely and unduly difficult.

🇵🇸 The 'second Nakba' government seizes its moment | +972mag

In early December 2022, shortly before Israel’s far-right government was sworn in and long before the events of October 7 and Israel’s ongoing brutal assault on the Gaza Strip, Ameer Fakhoury and I published an article on these pages entitled, “Why the ‘second Nakba’ government wants to remake the Israeli state.”

One year on, our worst fears have come to fruition: 1.9 million of the Gaza Strip’s 2.2 million Palestinian residents are currently displaced from their homes — which in many cases have been totally destroyed — and senior Israeli government figures are openly touting, and actively working toward, mass expulsion from the besieged enclave.

🇵🇸 Israeli Knesset’s decision to deny Gaza detainees legal representation provides legal cover for crime of enforced disappearance

The Israeli #Knesset’s General Assembly approved regulations that prevent Gazan detainees from meeting with their lawyers for an additional four months, thereby creating a legal cover for the crime of enforced #disappearance committed against thousands of #detainees.

According to the statement, the detainees’ prolonged forced disappearance may be a sign of the degree of #torture and violence they have endured during their arrest, interrogation, and #detention. EMHR emphasised that offering legal cover to conceal detainees indicates the involvement of multiple Israeli authorities in human rights violations. This cover is worthless, however, given that enforced disappearance is considered a crime against humanity by the #RomeStatute of the International Criminal Court.
