The Combatting Antisemitism, Hate and Extremism Bill 2026 has been published and it is worse than you think.
It criminalises speech that merely causes fear even if no harm occurs, 5 years imprisonment.
It defines public place so broadly that it includes the internet, meaning posts, videos, tweets, memes and blogs all fall within scope.
The law states it is irrelevant whether hatred actually occurs or whether anyone truly felt fear.
You are guilty of displaying a prohibited symbol unless you can prove a religious, academic or journalistic exemption.
The AFP Minister can declare prohibited groups without procedural fairness, including relying on retroactive conduct.
That power can extend to actions that occurred outside Australia.
Penalties include up to 7 years in prison if you have membership in a prohibited group.
Sentences to as much as 15 years for supporting, training, recruiting or funding a banned group.

The Government is legislate the creation of a hate group list determined by the Minister.
It will be a criminal offence to be a member, to recruit or donate to a listed group.
Labor will now list any organisation which is against multiculturalism as a hate group.
