THE BLANK PAGES IN INDIA’S ONLINE LEARNING EXPERIENCE{1/2}
✔️Context
◆India is one among the several countries that are grappling with the adverse impact of the COVID-19 pandemic in the social, economic and political spheres.
◆COVID-19 has affected all sectors. However, India must be worried most about the education sector, especially the education of the girl child.
◆In India, around 300 million children across all age groups are reported to be out of school during the period when all schools were closed and when schools finally reopen in the country, the number of children returning to class has to be closely scrutinised.
◆The Indian education sector faces the challenges of delivery of pedagogical processes, classroom assessment frameworks, students’ support and teacher-student engagement.
✔️Realistic assessment is key
●When the schools reopen, the authorities will have to realistically assess the level of understanding of students who have returned to schools after ‘digital learning’ at home.
●The realistic assessment was conducted in many government-run schools in various States which result in poor performance of the majority of children especially the girl child.
●The poor performance was due to poor access to digital data, the children were burdened with household/farm work; girl students were given away in marriage.
●Further, the students, parents and teachers were unprepared for the pedagogic shift.
✔️A challenge and the response
◆Closures of school impacted students and their families severely especially the vulnerable and underprivileged sections.
◆Enforcement of lockdown during the last quarter of the academic year led to the postponement of examinations and the curtailment of the prescribed syllabi.
◆Government to address the situation gave a push to the digital distance learning method, where text/video/audio content was sent through SMS, WhatsApp, radio and TV programmes to reach out to students and engage them.
◆The Union Ministry of Human Resource Development provided free e-learning platforms. Example: Diksha portal which had e-learning content aligned to the curriculum, and e-Pathshala, an app by the National Council of Educational Research and Training for Classes 1 to 12 in multiple languages.
◆SWAYAM portal provides 1,900 complete courses including teaching videos, computer weekly assignments, examinations and credit transfers, for both at school (Classes 1 to 12) and higher education.
◆SWAYAM Prabha provides a group of 32 direct to home channels devoted to the telecasting of educational programmes.
◆Though all these initiatives look impressive there are many pitfalls,
◆First, the rapid transition to digital learning initiative failed to consider the existing divides — spatial, digital, gender and class.
◆As per the UNICEF report, massive school closures exposed the uneven distribution of technology leading to which the dream of remote learning appears to be grim in the country.
✔️The impact is multi-fold
◆During the lockdown, boys became inattentive to studies while girls were more involved in household chores.
◆As their educational routine was disrupted, many children forgot even what they learnt earlier.
◆Further, the decision to postpone the board examinations and automatic promotion to the higher classes affected the quality.
◆According to the survey promoted by the Centre for Budget and Policy Studies, 3,176 households of Assam, Bihar, Uttar Pradesh, Telangana and Delhi, faced cash and food shortages, only 50% of the boys and girls were confident of returning to school thus affecting their educational journey.
◆Attending schools was not about learning alone, The long closure of schools led to the disruption of the mid-day meal scheme, the school health programme and pre-metric scholarships to girl children which earlier helped for enrolment and regular attendance.
◆Digital learning was initiated in a haphazard manner where many States lacked adequate digital infrastructure and even teachers were poorly equipped to teach.

◆The biggest complaint of the authorities now is teachers have been drawing their salaries doing precious little.
✔️The case of Rajasthan
◆Rajasthan ranking the second last in overall literacy rates in India and the lowest literacy rate among the females (NSS,2017-18); 20% of girls in the age group 15-16 were out of school against the national average of 13.5 (Annual Status of Education Report 2018).
◆Despite various education initiatives like Lok Jumbish and Shiksha Karmi projects, Rajasthan continues to flounder in systemic issues of quality, equity and gender in education.
◆According to a study by the Institute of Development Studies and Jaipur and Development Solutions, most girls in Rajasthan between 13-16 years were keen to return to school and around 97% of them in the districts Tonk, Dausa, Karauli and Udaipur, enrolled children in schools before the COVID-19 lockdown itself was a positive finding.
◆However, In Rajasthan, the access of girls to education during the COVID-19 period was limited to 11%. Online access was majorly through WhatsApp (92%) and YouTube (12%).
◆The inability of students to access online education was mostly due to lack of devices, poor or no Internet connectivity, and also girls’ preoccupation with household activity.
✔️NGO activities as a contrast
●Schools run by the non-governmental organisation sector performed well during the interregnum by teaching individual students at home or children in small groups instead of online teaching.
●Online classes are not comparable to actual classroom education and this was further exposed through the digital divide between the rich and the poor and the urban and rural areas.
✔️Way forward
◆Education planning has to be context-specific, gender-responsive and inclusive.
◆Increased access to the internet for online education, removal of barriers in pre-matric scholarships and ensuring the provision of mid-day meals, iron and folic acid tablets and provision of personal hygiene products to girl students even when schools are closed would help the students to continue in school.
◆Once schools reopen, the authorities should establish the re-enrolment of children as mandated by the National Education Policy 2020.
◆Mass outreach programmes within civil society to encourage re-enrollment, Remedial tuitions and counselling along with scholarships, targeted cash transfers would enable to retain the poorest at school.
◆Making secondary education for girls free is also advisable.
◆Given the seriousness of the situation, the government should keep the budgetary share of education to 6% of GDP, as emphasised by the President of India.

✔️Context
◆An Indian Law is shaped on basis of experiential tussle instead of mathematical exactitudes thus resulting in bargaining of Fundamental Right in return for some negotiation, sometimes with the desire of the coloniser and at others with the dominant ideology at the Centre.
◆There are ambiguities:
•The new Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, introduced by the Government threaten to deprive social media platforms of their safe harbour immunity in the event of non-compliance with the said rules.
•Though there are certainly positive aspects about the said rules, there are ambiguities and susceptibilities.
▪️The new media rules are a tightening noose:
●The Rules have a positive aspect such that it provides for the removal of non-consensual intimate pictures within 24 hours, publication of compliance reports to increase transparency, setting up of a dispute resolution mechanism for content removal and adding a label to information for users to know whether the content is advertised, owned, sponsored or exclusively controlled.
✔️Gagging a right
●The Supreme Court, in its judgement in the case of Life Insurance Corpn. Of India vs Prof. Manubhai D. Shah (1992) said that ‘the freedom to circulate one’s views was the lifeline of any democratic institution and any attempt to stifle, suffocate or gag this right would sound a death knell to democracy and result in autocracy or dictatorship’.
●Hence, to safeguard democracy there is a need to critically scrutinise the recent barriers imposed via these Rules against our right to free speech and expression.
●The rules were framed by the Ministry of Electronics and Information Technology (MeiTY), However, the Second Schedule of the Business Rules, 1961 does not empower MeiTY to frame regulations for digital media instead it's the responsibility of the Ministry of Information and Broadcasting.
●MeiTY said that these new rules shall be administered by the Ministry of Information and Broadcasting.
●However, this action violates the legal principle of ‘colourable legislation’ where the legislature is not allowed to do something indirectly if it is not possible to do so directly.
●The already existing Information Technology Act, 2000, does not regulate digital media, Therefore, the new IT Rules which claim to be a piece of subordinate legislation of the IT Act are beyond the rule-making power conferred upon them by the IT Act.
●Thus, the recent new rules framed ultra vires to the Act.
▪️Fair recourse, privacy issues
◆According to new rules, the intermediary is now supposed to take down content within 36 hours upon receiving orders from the Government.
◆This deprives the intermediary of fair recourse as sometimes intermediary may disagree with the Government’s order due to a strict timeline. Also, It hinders free speech by fixing the Government as the ultimate adjudicator of objectionable speech online.
◆In addition to the right to free speech, the new rules also undermine the right to privacy by imposing a traceability requirement.
◆Initially, there was end-to-end encryption due to which the intermediaries did not have access to the contents of their messages, but Imposing the mandatory requirement of traceability it would weaken the security of the private conversations of the users.
◆Further, the data from these conversations shall be vulnerable to attack from ill-intentioned third parties.
◆Along with the threat to the right to privacy, there is a threat of invasion and deprivation from a safe space.

▪️Fair recourse, privacy issues
◆According to new rules, the intermediary is now supposed to take down content within 36 hours upon receiving orders from the Government.
◆This deprives the intermediary of fair recourse as sometimes intermediary may disagree with the Government’s order due to a strict timeline. Also, It hinders free speech by fixing the Government as the ultimate adjudicator of objectionable speech online.
◆In addition to the right to free speech, the new rules also undermine the right to privacy by imposing a traceability requirement.
◆Initially, there was end-to-end encryption due to which the intermediaries did not have access to the contents of their messages, but Imposing the mandatory requirement of traceability it would weaken the security of the private conversations of the users.
◆Further, the data from these conversations shall be vulnerable to attack from ill-intentioned third parties.
◆Along with the threat to the right to privacy, there is a threat of invasion and deprivation from a safe space.
