This June 27, 2002 memorandum from John C Yoo, Deputy Assistant Attorney General to Daniel Bryant, AGA of the Office of Legislative Affairs was asking a very pertinent question:
Does 18 USC 4001(a) prevents the Military Detention of United States Citizens?
The conclusion, based on SCOTUS precedent and the President's Article II Powers, was clear:
"There was no agreement in Congress that the law would reach enemy combatants or that section 4001(a) could regulate the President's authority as Commander in Chief to detain such individuals. The legislative history of section 4001(a), therefore, cannot be read to undermine our conclusion and the apparent conclusion of subsequent sessions of Congress, that subsection (a) does not apply to the detention of US Citizens held as enemy combatants by the US Armed Forces under the direction of the President in the exercise of his Constitutional authority as Commander in Chief."
