Barrister’s powerful speech at Filton Trial reminds jury of its right to defy judge

"Mr Menon is the barrister representing Charlotte Head, who, like four of the others, is charged with three offences: aggravated burglary, criminal damage and violent disorder.

In his speech, he carefully unravels the prosecution’s – and, of course, the government’s – charge that the break-in was aggravated burglary. As Menon points out, for that to be true, Head and the others would have had to have harboured an intention to use the sledgehammers to hurt the guards when they broke into the factory. There is precisely no evidence that that was the case.

He also dismisses the claim of violent disorder against Head. For that to be true, she would have needed to have actively colluded with the others in using or threatening violence – violence that was not in self-defence or to defend someone else. This charge usually applies in circumstances such as pub brawls or football match fights. The test is whether a hypothetical “bystander of reasonable firmness” – someone uninvolved – would feel their safety was in danger from the fracas.

Again, Menon makes a compelling case that at no point was this true of Head, and suggests that the reason the video footage of the confrontation between the activists and the security guards looks so threatening is largely because one of the guards menaced the women, and twice assaulted an unarmed male activist, Jordan Devlin, with a sledgehammer.

But the most astonishing part of his speech relates to the third charge: criminal damage. The defendants have only one available defence against this. In legal parlance, it is called “lawful excuse”. It means that any criminal damage they caused can be viewed as lawful because it was designed to prevent the commission of a far graver crime – in this case genocide.

At one point in the trial a jury member sent a note to the judge, Mr Justice Johnson, asking this very question: “If we decide that they [the defendants] genuinely believe that they were performing life-saving action and were morally compelled to destroy weapons they believed were going to be used to kill civilians in what they believe to be an illegal genocide, would that amount to a lawful excuse?”

The judge, who repeatedly stifled efforts by the defence to air evidence of Elbit System’s involvement in the genocide, answered that the jury must not take into account such “lawful excuse”. In his words: “There is no evidence in this case of anything that is capable in law of amounting to a lawful excuse, so that is not something that you need to consider.”

He gave Peter Mandelson one of the most cherished jobs the British state can offer: ambassador to the United States. Now Mandelson is embroiled in the gravest political scandal in more than a century.
We now know that Mandelson was leaking sensitive inside information about British government decisions to his financier friend Jeffrey Epstein, one of the most repulsive criminals of the 21st century - a criminal, moreover, who had recently been convicted in a Florida court for procuring a child for prostitution.

At the time, Mandelson was business secretary (and effective deputy prime minister) in the Gordon Brown government as it weighed up how to confront a financial crisis. On the evidence of the Epstein emails, Mandelson may well be guilty of misconduct in public office - an offence that carries a maximum penalty of life imprisonment.

To make matters worse for Starmer, Mandelson has been celebrated - one might almost say loved - by the political and media classes for nearly half a century.

During this period, more than any other politician, he has shaped the modern Labour Party, exercising hypnotic influence over four leaders: Neil Kinnock, Blair, Brown and Starmer.

The scale of the latest political scandal cannot be understood outside of this background.his decision to despatch Mandelson to Washington breached historic foreign office conventions.
In the US, ambassadors are often political appointments. This is not the case in Britain. Karen Pierce, a career diplomat, preceded Mandelson in Washington, and after Mandelson was sacked, another British diplomat, Christian Turner, succeeded him.
Bear in mind therefore that Starmer was making a personal intervention when he sent Mandelson to the White House. This makes the prime minister directly responsible for the most reprehensible and disastrous appointment in the postwar history of the British diplomatic service - an appointment that blew up in his face, humiliating Britain in the process.

Mandelson has been celebrated - one might almost say loved - by the political and media classes for nearly half a century.

Reportedly, 74.79% of the Bitcoin core development and code was committed after Jeffrey Epstein took over the de facto senior management role as benefactor.

Later that year, he donated to MIT staff who knew it was dirty money. They hid his name from logs and internally referred to him as “Voldemort.”

With Larry Summers: Epstein discussed Bitcoin’s future inside his Manhattan mansion.

With Brock Pierce: Hosted the Tether co-founder for private strategy sessions.

Records show Epstein seeded Blockstream with roughly $500,000 in 2014 via MIT Media Lab director Joi Ito, and later financed Bitcoin Core development during a funding crisis that same year, including support for Gavin Andresen.

But he is also responsible for supporting Coinbase in its early days.

Emails show Epstein invested $3 Mn into Coinbase’s Series C in December 2014 at a $400 Mn valuation, via IGO Company LLC. The same documents indicate Fred Ehrsam was aware the investment was being made on Epstein’s behalf."
