Long before cannabis was legalised in Germany and discussions were underway about the planned reform, one question stood out louder than others: what will happen to those who get behind the wheel of a car under the influence of marijuana? Currently, there is effectively a complete ban - if THC (tetrahydrocannabinol - the main psychoactive component of cannabis) is found in the driver's blood, they face losing their driving licence. Partial legalisation came into effect on 1st April. Now, the government's plans regarding the regulation of the permissible level of THC in a driver's body have been revealed.
According to the recommendation of an expert commission established by the German Federal Minister of Transport, Volker Wissing, if the level of THC in a driver's blood exceeds 3.5 nanograms per millilitre (which is roughly equivalent to 0.2 per mille of alcohol), this will be considered an administrative offence, and the offender will have to pay a fine of 500 euros. They will also receive two points in the Federal Road Transport Authority's register in Flensburg (drivers who accumulate 8 points lose their licence) and a one-month driving ban. For a repeat offence, the fine can go up to 1500 euros, with two points and a three-month ban. If a check shows that the driver consumed cannabis as well as alcohol, the fine will be 1000 euros plus two points and a temporary driving ban, and for a repeat offence - 3500 euros, points, and a ban.
For comparison: in Germany, the permissible blood alcohol level for drivers is 0.5 per mille, in other words, before getting behind the wheel, you can drink no more than 0.5 litres of beer or one glass of wine.
