Government has filed this motion to dismiss with exhibits. The entire filing is 216 pages. There are cables included here that have never been made public, including the Nov. 16, 2021 cable. (and others)

All the redactions are by the government except page 159 where we redacted plaintiffs' names.

We have filed our opposition to the government’s motion to dismiss. Here's a copy with all exhibits, but I redacted names for plaintiffs' privacy.

What is next? The government has until June 3 to file a reply to this memorandum, and then the court can issue an order on the government's motion to dismiss, either with or without a hearing.

¨As of May 31, 2022, KCC had scheduled interviews for more than 20,400 of the processed DV22 cases, associated with 42,500 prospective applicants.¨

#TesfayevBlinken Update: in this group case filed in February where we represent 12 #DV2022 Sudanese and Ethiopian families who challenge Secretary of State Blinken's withholding visas by preventing them from reassigning their interview locations, we have just filed this motion for leave to file a sur-reply to motion to dismiss briefing.

Next in this case, US District Court Judge Colleen Kollar-Kotelly must issue an order on the government´s motion to dismiss. She can do this with or without a hearing, and we do not yet know if she wants to hold a hearing on this motion. Also, there is no deadline for when she must issue this order, but we hope she will recognize the urgency related to the September 30th deadline.

#DV2022 #TesfayevBlinken update: The government has filed a notice of errata with the court attempting to update their exhibit showing the queues for plaintiffs at Addis Ababa and Khartoum. However, the new filing raises more questions than anything. Some plaintiffs advanced in the queue and some went backwards. We do not know what this means really.

Update in #TesfayevBlinken #DV2022. Judge KOLLAR-KOTELLY has issued order that Plaintiffs file a brief by September 6 explaining why court has jurisdiction over plaintiffs' claims who have already had interview, but are now in post-interview AP.
