#JacobvBiden Update: Gov has filed it's supplemental briefing plus exhibits, which appeared to be borrowed from their filing in the Gjoci lawsuit.

Update in #RaivBiden: Pursuant to court's instructions, we just joined the government in filing this joint status report, with exhibits.

I am in touch with a photojournalist contractor for Al Jazeera who is looking to videotape an airport reunion with a family formerly subject to PP 9645 (Muslim Ban). This is an important story because it will allow her to tell the real story- that most visa applicants previously refused PP 9645 still do not have visas. Update in #RaivBiden: Status conference set for Wednesday has been rescheduled for Thursday.

“The new lawsuit filed on Monday argues that the US should be prioritising diversity visa winners as much as any other visa applicant.

"Congress found that the broader mix of nationalities that comes to define America, the better America becomes equipped to understand and relate to the diversity of the world abroad," it states.”

(2) Also in #RaivBiden, Gov has filed very embarrassing motion to dismiss. They argue "consularnonreviewability... precludes review of the Secretary’s decision to suspend visa processing..." They've lost that argument maybe 50-75 times in last 2 years. 🤣

#GoodluckvBiden Update: We are still waiting for judge assignment and summons to be issued. We were hoping that would come today, but it's already 3 pm in DC, so maybe tomorrow.

We've heard overwhelming appreciation of CAND court for livestreaming audio for past #JacobvBiden hearings, so I asked AUSA Valerie Smith, representing President Biden, if it's ok to livestream Friday conference also. The fate of 1,582 immigrant applicants at issue, this was her response.

I can report that #GoodluckvBiden has been assigned to U.S. District Court Judge Amit. P. Mehta. #DV2021

#JacobvBiden Update: Judge Chen has issued an order on the government's motion to dismiss. Two main takeways:

(1) The Court grants the Government’s Motion to Dismiss this case as moot as it pertains to the family preference (F1, F2A, F2B, F3, F4), and IR-5 Plaintiffs.

(2) The court acknowledges that DV-2021 are situated differently, and also, that "the Court has jurisdiction to adjudicate the Motion for Class Certification for DV-2021 selectees in the instant case."

"The Court directs DV-2021 Plaintiffs to file a Second Amended Complaint which properly alleges a class action and directs DV-2021 Plaintiffs to file renewed Motions for Class Certification and Preliminary Injunctive Relief. DV-2021 Plaintiffs shall file the SAC and these motions by June 22, 2021."

We will be reviewing the order and options for the remainder of the week. We plan to schedule a Zoom for Monday to talk with Jacob family preference (F1, F2A, F2B, F3, F4), and IR-5 plaintiffs about our options moving forward.
