In Indian law, when you deposit money in a bank, legally you are NOT keeping your money in safe custody.
You are actually giving a loan to the bank.
So the relationship becomes:
Customer = Creditor
Bank = Debtor
The bank becomes owner of the money and can use it for lending and business.
You only get a right to demand an equivalent amount back, not the same notes.
Indian courts (like in Canara Bank v. Canara Sales Corporation, Supreme Court) have clarified that a bank is not a trustee or bailee of deposited money. The obligation of the bank arises only when the customer makes a demand (withdrawal/cheque).
Because of this:
• Bank can adjust your balance against loan (right of set-off)
• Court can attach your account through garnishee order
• Limitation period starts only when you demand payment
• In bank insolvency you become an unsecured creditor
In simple words: a bank account is legally a repayable debt owed by the bank to you, payable on demand.
Case Laws:
1. Union Bank of India v. K.V. Venugopalan (SC)
The Supreme Court held that bank deposits create a debtor–creditor relationship and not fiduciary ownership.
2. Canara Bank v. Canara Sales Corporation (1987) SC
The Court observed:
- Customer has only a right to demand repayment
- Bank is not a trustee of deposited funds
- Payment obligation arises only when customer demands
So under Indian law, your bank balance = legally recoverable debt.
