Explanation
This piece intends to explore the law regarding the territorial jurisdiction of a High Court to issue writ under Article 226 of the Constitution.

226. (1) Notwithstanding anything in article 32, every High Court shall have power, throughout the territories in relation to which it exercises jurisdiction to issue to any person or authority, including in appropriate cases any Government, within those territories directions, orders or writs, including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, or any of them, for the enforcement of any of the rights conferred by part III and for any other purpose.

(2) The power conferred on a High Court by Clause (1) shall not be in derogation of the power conferred on the Supreme Court by Clause (2) of Article 32.

Operation Greens

Operation Greens is a project approved by the Ministry of Food Processing Industries with the target to stabilise the supply of tomato, onion and potato crops (TOP crops) in India, as well as to ensure their availability around the country, year-round without price volatility. The Government of India has decided to ease its ban on the export of hydroxychloroquine, a drug that has garnered global interest in the treatment and prevention of COVID-19.Hydroxychloroquine is an antimalarial drug option, considered less toxic than chloroquine, and prescribed in certain cases. Doctors also prescribe hydroxychloroquine for patients of rheumatoid arthritis and lupus.However, several countries source the drug from India. By March 21, Trump had begun to call the drug a “game changer”, and has since been pushing it.At the end of last month, the Indian Council of Medical Research (ICMR) issued an advisory recommending the use of hydroxychloroquine in asymptomatic healthcare workers treating COVID-19 patients.India decided to ban exports of the drug on April 4. Subsequently, US President Donald Trump tweeted about “retaliation” if India did not heed his request for the drug.But now, government decided to ease the ban. India said it would supply to countries that needed it the most, and to neighbours who were “dependent on India’s capabilities”.

Personal Liberty: Procedure Established by Law:

• The petitioner, detained under the Preventive Detention
Act challenged the legality of detention under Art. 32 of
the Constitution on the ground that the said Act
contravened Arts. 13, 19, 21 and 22 of the Constitution
and was, therefore, ultra vires.

• The S.C. held- that Article 22 was a self-contained Code
and if personal liberty is taken away by the State in
accordance with the procedure established by law i.e. if
the detention was as per the procedure established by
law, then it cannot be said that the law was violative of
provisions contained in Articles 14 ,19 and 21 of the
Constitution.
Indrajit Gupta Commitee

Indrajit Gupta was the chairman of the parliamentary committee on state funding of elections set up in 1998.

Following are the recommendations of Indrajit Gupta Committee:

State funding should be in kind i.e. no financial support is to be given to parties.

Part of financial burden of the parties is to be initially borne by the states.

Only the recognized political parties should be given state support.

Political Parties should compulsory submit their annual accounts to the income tax department.

Complete account of the election expenditure should be filed by the parties to EC

The Committee noted that at the time of the report the economic situation of the country only suited partial and not full state funding of elections.
Helicopter Money

Amid rising concerns over economic crisis that has been triggered by the COVID-19 lockdown; Helicopter Money is one concept that is being considered by authorities’ world over.In fact, Telangana Chief Minister K. Chandrashekar Rao has suggested RBI to adopt the concept of Helicopter Money to help state governments tide over the current crisis and kickstart economic activity in India.

What is helicopter money?

This is an unconventional monetary policy tool aimed at bringing a flagging economy back on track. It involves printing large sums of money and distributing it to the public. American
economist Milton
Friedman coined this term.
It basically denotes a helicopter dropping money from the sky. Friedman used the term to signify “unexpectedly dumping money onto a struggling economy with the intention to shock it out of a deep slump.” Under such a policy, a central bank “directly increase the money supply and, via the government, distribute the new cash to the population with the aim
of boosting demand and inflation.”

With the coronavirus-hit economy falling deeper and deeper into a chasm with each passing day, Telangana chief minister KC Rao has said helicopter money can help states comes out of this morass. He asked for the release of 5% funds from GDP by way of quantitative easing (QE).

Is helicopter money the same as quantitative easing?

Quantitative easing also involves the use of printed money by central banks to buy government bonds. But not everyone views the money used in QE as helicopter money. It sure means printing money to monetise government deficits, but the govt has to pay back for the assets that the central bank buys. It’s not the same as bond-buying by central banks “in which bank-owned assets are swapped for new central bank reserves.”

How will Helicopter Money help Indian Economy?

Simply put, Helicopter Money means extension of non-repayable money transfer from the central bank to the state and central governments, to infuse liquidity in the system.

The policy aims at putting more money into the pockets of people to nudge them to spend more money and in turn pick-up economic activity in the country.

The direct impact of Helicopter Money is rise in disposable incomes of the people, increase in money supply with an intention to boost demand and inflation in the economy.

The report of the Fifteenth Finance Commission, along with an Action Taken Report, was recentl tabled in Parliament. FC has considered the 2011 population along with forest cover, tax effort, area of the state, and “demographic performance” to arrive at the states’ share in the divisible pool of taxes. In order to reward population control efforts by states, the Commission developed a criterion for demographic effort — which is essentially the ratio of the state’s population in 1971 to its fertility rate in 2011 — with a weight of 12.5%.. The total area of states, area under forest cover, and “income distance” were also used by the FC to arrive at the tax-sharing formula.The Commission has reduced the vertical devolution — the share of tax revenues that the Centre shares with the states — from 42% to 41%.. The Commission has said that it intends to set up an expert group to initiate a non-lapsable fund for defence expenditure. Shares of the southern states, except Tamil Nadu, have fallen — with Karnataka losing the most. Shares of states like Maharashtra, Himachal Pradesh and Punjab, along with Tamil Nadu, all of which have fertility rates below the replacement level, have increased slightly.On the other hand, Andhra Pradesh, Kerala, Karnataka, and West Bengal’s shares have fallen, even though their fertility rates are also low. Incidentally, Karnataka, the biggest loser in this exercise, also had the highest tax-GSDP ratio in 2017-18, as per an RBI report on state finance.

HLAG on Elephant Bonds

A High-Level Advisory Group (HLAG) headed by Surjit S Bhalla recently issued a suggestion to the Government of India to issue “Elephant Bonds” to help India recover up to $500 billion of black money stashed overseas.

What is Elephant Bond?

The elephant Bond is a proposed debt instrument that:

- Is a 25-year sovereign bond in which people declaring undisclosed income will be bound to invest 50 percent of that income in these bonds.

is like an Amnesty scheme to help State treasury raise tax revenues, adding beneficiaries in tax base who have not declared their assets previously.

Key Recommendations of the Committee

- The funds raised through these bonds will solely be utilized for boosting economic growth by utilizing the collected money to fund infrastructure projects in the country.

lowering the effective corporate tax rate and bringing down the cost of capital and simplifying regulatory

State governments need to be closely involved in improving the competitiveness of exports.
Personal Liberty: Procedure Established by Law:

Maneka Gandhi v. Union of India (1978).

• The view expressed in A. K. Gopalan’s case was revisited in this case after about 28 years.

• The main issues were whether the right to go abroad is a part of the right to personal liberty under Article 21 and whether the Passport Act prescribes a ‘procedure’ as required by Article 21 of the Constitution.

• The SC held that the right to go abroad is a part of the right to personal liberty under Article 21.

• The SC also ruled that the mere existence of an enabling
law was not enough to restrain personal liberty. “The procedure prescribed by law has to be fair, just and
reasonable, not fanciful, oppressive or arbitrary. ”
