Forwarded from CA Final DT - Prof. Aagam Dalal (CA Final May 26 / Sept 26 / Jan 27 / May 27 / Sept 27 / Jan 28 / May 28 / Sep 2028)
Certain imp points for May 26/Sept26/Jan 27
1)
Clarity on rebate u/s 87A(though already discussed in lectures)
In 115BAC, while calculating rebate we need to see total Income(Including special rate Income) and if it is upto 12 lakhs then only rebate applies..however no rebate against any special rate Income..
(INCOMETAX UTILITY VIEW IS DIFFERENT FROM ICAI..pls follow ICAI view only in exam)
2)
Second clarification for grossing up:
If dividend is from single company and word is "received" apply grossing up and assume tds deducted.
However if dividend is from various companies and word is "received" then we cannot assume TDS deducted by all companies and hence no grossing up..ignore tds implication.
3)
TDS U/s 194
Threshold of 10,000 only applicable when shareholder is Individual..in other cases no threshold will apply..in 194K threshold of 10000 is for all unitholders.

Prof.Aagam S. Dalal
