📌 What is Carbon Trading?
Carbon Trading (also called 🔹Emissions Trading) is a market-based mechanism to reduce global greenhouse gas (GHG) emissions by putting a price on carbon.
It allows companies or countries that emit less than their emission quota to sell the surplus (carbon credits) to those exceeding the limit.
✳️Concept derived from the "cap-and-trade" principle.


⚙️ How It Works
☑️Cap: Government sets a cap on total GHG emissions (national or sectoral).
☑️Allowances: Firms get a fixed number of emission allowances (e.g., 1 credit = 1 tonne CO₂).
☑️Trade: Firms with surplus allowances can sell to others who exceed their caps.
☑️Incentive: Encourages companies to reduce emissions and invest in green tech.

What the Court Said:

1. Limits of IEEPA:
• The court ruled that IEEPA does not give unbounded power to the President to impose tariffs “in the form of a national emergency.”
• The President cannot apply blanket tariffs on goods from nearly every country using emergency powers.
2. Violation of Separation of Powers:
• The judges emphasized that it is not for unelected judges to set trade policy, but neither can the executive bypass legal checks in the name of emergency.
