Battle against tyranny: High Court judge Patrick Li barred from Anti-ELAB related hearings after signing Anti-Extradition petition

(28 May) On the eve of the 9 June demonstrations last year, High Court judge Patrick Li, who presides over the Court of First Instance, signed a joint press statement alongside more than three thousand alumni from the University of Hong Kong entitled, "We oppose deceitful policies, withdraw the Extradition Bill." The Judiciary later acknowledged that a judge was involved in the petition. Chief Justice Geoffrey Ma discussed the matter with the said judge, reminding him to refrain from letting similar issues to occur in the future. Today [28 May], Sing Tao Daily quoted the Judiciary that based on the Guide to Judicial Conduct, Li was to avoid handling cases that related to the petition's subject matter to prevent "apparent bias" from arising. This means he is barred from handling cases on Anti-ELAB [Anti-Extradition Law Amendment Bill].
 
According to the report, the Judiciary responded by quoting paragraphs 46 and 47 of the Guide to Judicial Conduct: "In practice, questions of disqualification are most likely to arise in relation to suggestions of the apparent bias", and "The apparent bias test may be stated as follows: A particular judge is disqualified from sitting if the circumstances are such as would lead a reasonable, fair-minded and well-informed observer to conclude that there is a real possibility that the judge would be biased." The above principles apply to scheduling cases at all levels of court. The Judiciary decided that when assigning cases for the Court of First Instance judge Patrick Li, he would not sit in cases related to the joint statement to avoid apparent bias.
 
On 1 Oct last year, Li handled the case of local actor Gregory Wong concerning the 1 July Legislative Council incident. Wong was detained by the police for approximately 36 hours. Li granted a writ of habeas corpus after trial and Wong was released at 7:50 pm on the same day.
 
Last month, District Judge Kwok Wai-kin's handling of the Lennon Wall attack case in Tseung Kwan O provoked controversy over his verdict where he praised the defendant's "noble virtue". Chief Justice Geoffrey Ma subsequently issued a statement that inappropriate or unnecessary expressions of political opinions by judges and judicial officers could harm their impartiality and credibility. He determined that Kwok should not sit in any cases surrounding such political issues for the time being. Currently, two judges in charge of criminal cases - Patrick Li and Kwok Wai-kin - are barred from hearings that involve Anti-ELAB due to personal conduct or remarks made in trial.

Patrick Li Criticises LMFā€™s Cursing Songs as ā€œIndecentā€ and Unsuitable as the Interviewee. All Programs in RTHK Need His Approval Before Airing

Deputy Secretary for Home Affairs Patrick Li, who had no media experience, was brought as an outside manager and became the Director of Broadcasting. Li Biased against Public Affairs Department and Asked, ā€Why arenā€™t we interviewing Raymond Choā€

Insiders from RTHK revealing Li repeatedly stressed that he was the Chief Editor of the channel who had the responsibility to ensure the fairness and the impartiality of their programs. He stated that ā€œif you canā€™t pass my impartiality test, your programme canā€™t go on airā€. Knowing LMF being interviewed at Hong Kong Stories, Li said that LMF was not a decent guest for a public broadcasting organisation like RTHK because they often cursed in their songs. He even played one of their songs, asking the meeting attendees to count the swear words in the song and questioning why another kind of voice was not sourced. Li described LMF as showing extreme political stance and saying their song as ā€œGil of organsā€.


The insider added that Li was quite demanding even though RTHK should produce a broad spectrum of programs. ā€œIt is like all or nothing (and it makes you) feel like he doesnā€™t mind to withdraw a program and replace it with another.ā€ Rumour was it that Li was obviously targeting the Public Affairs Department and the editorial freedom came from the bottom level. There has never been a Director of Broadcasting who demanded to approve of the programs before airing, arousing suspicion of political censorship.

Board Of Advisors Issued Statement Criticizing Director Of Broadcasting's Attempt To Turn #RTHK Into Government Propaganda Machine

Patrick Li, former Deputy Secretary for Home Affairs and current Director of Broadcasting, has been seen constantly interfering with the public broadcaster RTHKā€™s programs since he took office in early March 2021.

In a statement issued on March 27, 2021, 19 members of the RTHK Board of Advisors criticized Li's intention to turn RTHK into a government propaganda machine.

The statement mentioned that Li has misinterpreted editorial independence as ā€œeditorial independence of RTHKā€ and stressed that it should not be defined by a small group of management on their personal stance and political mission.

The statement demanded Patrick Li to immediately explain the reasons and criteria for canceling or changing programs, and abolish the mechanism of sending program proposals to the Editorial Board for pre-screening.

The petition included signatures including Barrister Randy Shek, Mr. Francis Fong, Honorary President of The Hong Kong Information Technology Federation, Ms. Phyllis Cheung, Executive Director of Hong Kong Unison, Professor Lisa Leung, Associate Professor of Department of Cultural Studies at Lingnan University, Ms. Leticia Wong, District Council member , Mr. Warren Tam Ka-chun and Mr. Sin Chung-kai.

This petition listed a series of incidents related to Li, including the request for previewing programs such as ā€œHong Kong Connectionā€ć€Šé—é˜é›†ć€‹ , ā€œViewpoint 31ā€ 怊視點31怋; removing parts of the interview within programs of ā€œHong Kong Stories: The Pandemic Walkerā€ 怊香ęøÆꕅäŗ‹ļ¼šē–«č”Œč€…怋, ā€œLegCo Reviewā€ 怊議äŗ‹č«–äŗ‹ć€‹and ā€œThe Pulseā€ 怊脈ꐏ怋; and requesting staff to submit program proposals to an editorial committee composed of the Director and directorate staff for approval in early stages of program production.

#RTHK bans Journalists from receiving Human Rights Press Awards

Multiple news documentaries produced by the public broadcaster RTHK in Hong Kong have won the Human Rights Press Awards.

The winning titles include the episodes entitled ā€œWaking up in the spread of the pandemicā€ and ā€œIn the name of justiceā€ of the programme ā€œThis Weekā€.

According to Stand News, the news documentary program "#HongKongConnection" also receives accolade. In particular, the episode ā€œ7.21: Who owns the truth?ā€, produced by local journalist #BaoChoy Yuk-ling, won the grand prize in the Chinese Documentary Video category.

Despite the international accolades received by many journalists of the station, #PatrickLi Pak-chuen, the newly appointed Director of Broadcasting to RTHK, disallowed the staff from submitting their works to local and international competitions. Li even contacted the Human Rights Press Awards in person to demand RTHKā€™s withdrawal from the competition, but it was refused by the organizer.

The award-winning program "#ThisWeek" includes the particiation of former RTHK journalist #NabelaQoser, who is known for her critical stance and professionalism.

Another awardee Bao Choy is currently facing charges made by the Hong Kong authorities, accusing her of "falsifying statement". The authorities' action against Choy has been decried by many journalists and the local population as an act of political suppression.

The RTHK spokesperson claims that the station will not receive the Awards, and insisted that it will withdraw from the competition.
