Emergency Regulations Ordinance is Martial Law in Disguise, Eroding Completely the Freedom and Rights Promised to the Population


Although the government claimed to be willing to 'withdraw' the extradition law amendments in early September when the territory-wide protest entered the fourth month, in less than a month the government bypassed the Legislative Council and forcefully implement the Anti-Mask Law. (See the summary of the law: https://t.me/guardiansofhongkong/7643)

The government's press conference on October 4 announced the immediate enforcement of the controversial mask ban in less than 12 hours, despite the criticism sparked off concerning infringement of personal privacy, rights and freedom promised in the Basic Law.

Share market analyst David Webb explained clearly the need for Hong Kong protesters to wear masks, so as to avoid political prosecution and retaliation (Read more: https://t.me/guardiansofhongkong/7691). Webb also feared that the government would re-apply the Emergency Regulations Ordinance to enact other draconian laws and measures such as the restricted use of the Internet and the ban on publication and other communication means (read more: https://t.me/guardiansofhongkong/7670).

In view of the ongoing withdrawal of capital from Hong Kong, Webb believed that the government's move had faltered Hong Kong's status as a stable financial hub, although the government officials denied such claims in the press conference.

On that account, there are reasons to believe not only that the Emergency Regulations Ordinance is a martial law in disguise, but also that the government's invocation of this law on October 4, as Webb suggested, probably opens up a precedent case for more unjust and unjustified policies to be implemented, hence completely eroding the freedom and rights entitled to Hong Kong people in the 1984 Sino-British Joint Declaration and the city's own constitution Basic Law.

Shops Closed, Major Transport Suspended: The Authorities are Just Not Using the Word 'Curfew'


After the government's announcement of the Anti-Mask Law on October 4, classes in many secondary schools and universities were cancelled, while companies also dismissed their employees early and shops were closed early (https://t.me/guardiansofhongkong/7617). Some citizens rushed to supermarkets for grocery as if the city would turn into an emergency state in no time; while others occupied streets to protest before the Anti-Mask would become effective after midnight

On October 4, police ordered bus companies to stop their services (https://t.me/guardiansofhongkong/7684) while the MTR also completely stopped running at 22:35. The suspension of major public transports had made it difficult, if not impossible, for citizens to seek for medical help. Fortunately, two parents who are in need of bringing their child to a doctor were assisted by protesters to get to the hospital (https://t.me/guardiansofhongkong/7687).

One day after the government had invoked the Emergency Regulations Ordinance, on October 5 over 22 large shopping malls are to be completely closed while the MTR has announced the suspension of service in all lines (including the airport express, the light rail and MTR shuttle buses) in the morning, at least.

In the last evening before masks would since then be banned in the city, Hong Kong police was filmed telling the passers-by that those wearing a mask “will die” as the law would be in effect (Source: Stand News). Incidents suggest that it is also likely for the police to abuse power under the Anti-Mask Law (https://t.me/guardiansofhongkong/7707).

Meanwhile, the police continued to mistreat members of the press (https://t.me/guardiansofhongkong/7714) after being known to have wounded an Indonesian journalist by causing permanent blindness on Sept 29.

In addition to shooting the 18-year-old schoolboy in the chest with a live round on Oct 1, the police wounded a 14-year-old boy with also a live round in his thigh. When the boy in critical condition was being operated, the riot police showed up and conduct searches in the hospital (https://t.me/guardiansofhongkong/7712).

It is also noteworthy that the police force had relaxed the use of firearm in their internal guideline on Sept 30, which is allegedly a retrospective modification after the said Indonesian reporter was shot on Sept 29.

Protest Goes on Against the Anti-mask Law

Citizens initiated a protest against the Anti-mask Law on Hong Kong Island. The crowd began to gather at around 2pm outside the SOGO department store. People then marched on Hennessy Road towards Wan Chai.

Many people wore masks or used a cloth to cover their faces. Someone held a large banner that reads “Glory to Hong Kong”. No police were seen.

School Principals Criticize the Abrupt Implementation of Anti-mask Law

The HKSAR government forecefully implemented the Prohibition on Face Covering Regulation by invoking the Emergency Regulations Ordinance, turning it effective on 5 October.

The Chairman of The Hong Kong Association of the Heads of Secondary Schools Teddy Tang Chun-keung criticizes on a radio programme that the government has implemented the law too hastily [without seeking approval from the law-making body].

He also criticized the letter template provided by the Education Bureau, saying that it failed to explain the law clearly to parents and does not state how students can avoid breaking the law.

Despite the suspension of services of all major MTR lines, hundreds of people walked from Causeway to the cross-harbour ferry pier in Central. Citizens in masks standing up against the Anti-Mask Law


Large crowds of people marched to Central, protesting against the Anti-Mask law, with a majority of participants wearing caps and masks. They left peacefully after arriving at Chater Garden.

A retired lady expressed that she was not scared of being arrested because of the Anti-mask law, and she would continue to wear masks to protest. She criticized that the government enforced the law "for no reasons". She did not suggest, but was not against protester's acts of vandalising the shops, saying that "protesters revolt with stronger force when facing stronger oppression from government".

Mr Tam, another participant, believed that the legislation was too abrupt. The government should not stop people from questioning, but to answer to the demands of citizens instead. He criticized the Anti-mask law as "useless", as it would not help solve social problems. Instead, it stirs up anger. The government should have announced the curfew directly. He did not consider the act of protesters last night as "going too far", and their vandalism towards China-based company would be able to get attention.

After invoking the Emergency Regulations Ordinance
[Anti-mask law] Citizens are queueing to get cash. HKMA: over 10% of ATM machines are damaged, not operating.

Bank of China HK (2388) temporarily stopped many ATM services last night (4th). Many branches were damaged. All other branches are closed today apart from the Bank of China Building. Most branches of other Chinese capital banks, HSBC, Hangseng Bank, and Standard Chartered are closed today. As it is a 3 days long weekend, some citizens are afraid that they will not have enough cash and rushing to ATM machines which are still operating to withdraw cash.

There are photos on Internet showing the long queue outside the main branch of HangSeng Bank, and a long queue for the HSBC ATM machines in Sheung Shui. Residents in Sheung Shui said that only one of the four HSBC ATM machines in Sheung Shui Centre are still with cash, reminding others to take cash.

Our reporters observed the banks in Hoi Yuen Road in Kowloon, there were more people today queued up than usual, but the situation is peaceful. The window of Bank of China Hoi Yuen Road branch was damaged, the police surrounded that with plastic tape, and all of the ATM machines inside were not operating.

The spokesperson of Hong Kong Monetary Authority preliminarily estimated that over 330/3300 (10%) of affect ATM were not operating due to damage. Because MTR stations and some shopping malls are closed, ATM in those areas are not in use today. Among those machines that are operating normally, there are only about 5% of them, being not able to offer cash due to various reasons. The banks are now closely communicating with cash delivery service to top up cash as soon as possible to ensure the normal operations of ATM. The banking industry hopes to resume service for the affected ATM machines in order to reduce the impact to citizens.

Police Warned a Family Of Three with a Three-Year-Old Kid of Unlawful Assembly

In Taipo, the police yelled at a family where two parents were out with their three-year-old child riding a tricycle.

Unbelievable as it sounds, the police warned of arresting the family for unlawful assembly.

As the couple voiced their disagreement with the police, the police shone flashlight at the eyes of the woman directly.

Apparently, hanging out with your family at night could be considered violating the law after the emergency powers of the government were invoked and the Anti-Mask Law is enforced.
