HK Court Rejects Challenges on National Security Law, Civilian Detained Since July 1

HK High Court rejected a legal challenge against the constitutionality of the National Security Law that was forcefully enacted by Beijing. The courst also refused the writ of habeas corpus of defendent Tong Ying-kit, who has been detained since 1 July 2020.

Tong is the first man in Hong Kong charged under the law after he was accused of driving with a flag reading "Liberate Hong Kong, Revolution of Our Times".

Justices Anderson Chow and Alex Lee dismissed arguments that bail conditions imposed under the law violates the presumption of innocence vua arbitrary detention.

They also rejected claims by defence lawyers that the law restricts the independence of the judiciary; and that judges cannot be free from government influence just because those responsible for adjudicating national security cases are all appointed by the Chief Executive.

HK Police Clamping Down 7.21 Remembrance in Yuen Long with National Security Violation Warning

August 21, 2020 marked 13 months since the 7.21 Yuen Long Attack, where white-clad assaulted civilians and police allegedly turned a blind eye to these brutal attackd.

At 8pm today in Yuen Long's Yoho Mall, some civilians shout slogans. Riot police arrived less than 10 minutes later and hoisted a Purple Flag. Police warned people around might be in violation of the Hong Kong National Security Law.

Police moved forward quickly and suddenly and intercepted lots of civilians. More police then arrived on the spot to support, and police continued to extend cordoned line until the whole shopping mall was completely blocked. Police yelled at the civilians to leave the mall at once, or otherwise they would violate the group gathering ban.

HK Police Suppress Commemoration: 13 Months into Yuen Long 7.21 Attack

On Aug 21, 2020, the police gathered at Yuen Long's Yoho Mall to prevent citizens from gathering.

On July 21, 2019, white-clad gangsters had assaulted many civilians returning from protest, passersby, train passengers and journalists in Yuen Long. Citizens had tried to seek help from the police, but one can hardly reach the emergency hotline and the nearby police station happened to have closed early that day. Since then, the police were accused of colluding with the Triad, as they 'arrived' late and arrested no one that evening. Among many videos capturing violent attacks in trains and on the streets, one that went viral included Beijing Loyalist Junius Ho shaking hands with a white-clad gangster.

Hongkongers have been gathering on the 21th day every month to seek justice; however, the national security law has made it quite impossible to protest.

Sources: 3 Heads of Engineering Team at Cable News Fired by News Director

According to sources cited by Apple Daily, three engineering team heads got a termination letter from their news director on August 21, 2020 effective immediately.

They have worked at Cable News for around 20 years. They were the first batch of employees when Cable News was just established. They were responsible for maintaining network connections, live broadcast signals, assisting news interviewing, editorials and other back-end works. They have a good relationship with journalists. It's reported that some journalists couldn’t stop crying when they knew the company let go of them.

Cable News had underwent a major staffing change during early August, with Anderson Chan Hing-cheong and Oscar Lee taking the position of news director.

Public opinion: a large majority of 76% Hong Kong citizens reject “Health Code”

Hong Kong Public Opinion Research Institute (#HKPORI) conducted an online poll “We Hongkonger Survey” from August 17 to 20, collecting citizens’ view on the government’s proposal to introduce “Health Code” in Hong Kong as a screening mechanism for only the “healthy one” to enter eateries, shopping malls and other public places.

Among 23,000 respondents, a large majority of 76% rejected the proposal while only 15% showed support and 8% claimed neutrL.

Analyzing based on respondents claimed political orientation, 96% of pro-democracy respondents (sample size: 21,345) rejected the proposal, 1% supported while 3% were neutral. Among the remaining sample of 1,700 non-democracy supporters (including pro-establishments, the moderates, and those without political orientation, apolitical and not belong to any political camp), over half of them (55%) rejected the proposal while 29% supported and 13% claimed neutral.

Dismissing Privacy Concern, HK Gov't Insists in Carrying Out Universal Test and Health Code

The Chief Executive Carrie Lam on August 21 urged Hongkongers to take part in the COVID19 test run by the Chinese companies appointed by the HK government from September 1 onwards. Secretary for the Civil Service Patrick Nip reassured that information will "not be sent outside of Hong Kong".

Despite public concern over data collection and privacy, Lam said that the government will implement a health code plan to exempt qualified Hong Kong-China travellers from quarantine restrictions, similar to what China had already installed in Macau and Guangdong.

Secretary for Innovation and Technology Alfred Sit dismissed privacy concern. He stated that the health code users will have to acknowledge that they 'agree' to have their data sent to their destination, i.e. the Chinese authorities, if travelling to China.

Meanwhile, microbiologist Ho Pak-leung, head of the University of Hong Kong's Centre for Infection, has doubt in universal COVID-19 testing. He called it "a waste of bullets" if people with higher risk of infection are not tested.

Ho suggested to test all patients in public hospitals, and carry out repeated tests for elderly home workers and frontline medical staff, instead.

Should Incumbent Lawmakers Serve in Extended Term Under Beijing's LegCo Arrangement?

HK Public Opinion Research Institute (#HKPORI) released two sets of survey results from online discussion groups and phone interviews, randomly sampled.

Q: The Standing Committee of the National People's Congress has extended the current LegCo term for no less than 1 year. Do you agree or disagree for incumbent lawmakers to serve in the extended term?

Survey results:
• Online opinion groups: Agree 35%;Disagree 47% Sampling threshold +/- 1%
• Random phone interview: Agree 37%;Disagree 41% Sampling threshold +/- 3%

A few reflections are offered by CUHK lecturer and research Dr. Leung Kai-chi:

1. Methodology

Two sets of survey results were devised from different methodologies,
Since netizens and political figures were involved in mobilizing citizens to register and take part in this survey, this set of survey result can be used as a reference to those being politically influenced.

Interviews via phone calls (including landline and mobile) were randomly sampled, not being directly influenced by political opinion leaders. These set of survey result can be regarded as an overall reflection of the mass population in Hong Kong.


2. Beyond Methodology

Leading researcher of the survey, Dr Leung Kai-chi explained, “methodology cannot be a solution to all the problems as some are matters of value judgement.” For instance, should a lawmaker make a deciaion in accordance to HK people’s opinion or his potential supporters? In the same light, should legislators of Functional Constituencies only look into opinions of his/her constituency, disregarding the rest? Should there also be a middle-ground / alternative solution, or should lawmakers only follow a dominant opinion with an absolute majority support?

Dr Leung admitted that many disagreements may arise. He said “I do not have an answer to them. Hopefully, we can face these questions unruffled and in unity.”

Australia inplements new visa arrangements for Hong Kong students, temporary graduates and skilled workers that comes into effect on 21 August 2020.

Around 10,000 Hong Kong passport holders currently residing in Australia will be able to extend their stay for five years and apply for permanent citizenship afterwards.

Australia's Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge said "Australia and Hong Kong have always shared a close relationship".

“Australia has a long history of attracting Hong Kong's best and brightest who have contributed significantly to our economic growth and job creation, and we are committed to ensuring this is further strengthened," Mr Tudge said.

“We know that recent events in Hong Kong mean that many highly talented individuals will want to remain in or relocate to a free, democratic country like Australia, and these new arrangements will ensure we're attracting those who create jobs and opportunities for Australians."
