Hong Kong Education Bureau oversteps its authority to settle scores, at least 10 teachers accused of professional misconduct without justification - Part 1 of 2

[Abstract] The Education Bureau previously stated that investigation into 60 complaints of teachers’ professional conduct relating to recent social affairs had been completed, of which about 30 were preliminarily confirmed cases of misconduct and would likely lead to revocation of the involved teachers’ registered designation. Apple Daily was informed that the Education Bureau accused at least 10 teachers of misconduct but did not contact those directly implicated in the investigation. Instead, they only adjudicated based on the schools’ own findings. The Education Bureau sent letters informing these teachers that they were presumed guilty of alleged misconduct. They had to respond in writing and were given no opportunity for a scheduled hearing. Some lawyers have criticized the Education Bureau’s move as “outrageous”, that it was unjust and should be appealed.

Apple Daily was informed of at least 10 similar complaint cases against teachers that the Education Bureau delegated to the schools involved to make initial investigations. Education Bureau has yet to contact these teachers directly. It has only issued letters based on preliminary findings from schools that the teachers expressed biased opinions and incited hatred. It stressed that these actions had a negative impact on the professional image of education and alleged that they were a form of misconduct. The letter specified that the teachers were not required to meet with officials and only needed to respond in writing. It also stated that the Bureau would consider disciplinary action according to the Education Ordinance. It was reported that the identities of complainants were never disclosed to the teachers involved, which dismayed some schools that were hoping to conclude the investigation quickly and minimize the disruption to normal school operations.

According to Apple Daily, the Education Bureau has not been consistent in its response to teacher complaints relating to the Anti-ELAB movement. Apple Daily also contacted a teacher against whom a complaint was lodged for online posts earlier in the movement. He revealed that the Education Bureau had invited him for a meeting and was denied when he requested a union representative or lawyer to accompany him. It relegated to asking him for a written response instead. The Bureau did not respond in turn, rather choosing to notify the teacher directly that he was indeed charged with misconduct with no explanation as to why his written defense was not accepted. The teacher denounced the Education Bureau for lack of transparency and due process in its ruling.

Chong Yiu-Kwong, a lawyer and the vice-president of the Hong Kong Professional Teachers’ Union, pointed out that teacher registration is issued by the Education Bureau to teachers on an individual basis. Should a problem arise, the Bureau should deal with the teacher in question directly. He found it inappropriate and unfair that schools had to carry out investigations and described the Education Bureau’s handling of complaints as “outrageous”. He indicated that cancelling a teacher’s registration was “a big deal” for teachers and that issues pertaining to it deserved a proper hearing, not just in writing. He continued to say that the teachers implicated had the right to know the complainant’s identity. Withholding it violated the principles of natural justice and kept the teachers from knowing if the relevant incriminating data was obtained through illegal means like hacking.

Chong explained that if a teacher’s registration is cancelled, the aforementioned injustices could be grounds for challenging Education Bureau’s future decisions; under the Education Ordinance, teachers could appeal to the Chief Executive and Executive Council and any further disagreements could undergo judicial review.

In a newspaper article, Winnie Yu - an honorary professional consultant of the Department of Educational Administration and Policy from the Chinese University of Hong Kong - warned that Education Bureau had been investigating complaints of teachers criticising the police online since June. In some cases, the offending information was never divulged to the teachers, leaving them no opportunity to defend themselves. Yu also pointed out that most of the proof came from screenshots of teachers’ personal social media accounts, which was a violation of privacy. This meant that Education Bureau was an “accomplice” in using illegally obtained evidence to accuse teachers of professional misconduct.

Yu stated that the Education Ordinance did not authorize Education Bureau to use verbal warnings, condemnations or punishments against teachers accused of misconduct. Minor cases that do not warrant the cancellation of registration should be terminated. To do otherwise would “overstep its authority”.

A spokesperson for the Education Bureau responded that the implicated teachers had ample opportunity to explain themselves to their schools. They also stated that schools were responsible for reporting to Education Bureau, which would then review and determine the validity of a case. If a case was proved to be convincing, the Bureau would inform the teacher involved and invite them to write a statement. The option of requesting a meeting would be open as necessary. The spokesperson claimed that the Bureau has never ruled out the possibility of speaking directly with the teachers involved.

The spokesperson also denied that coercing, warning and condemning teachers should be misconstrued as “overstepping authority”. Rather, such actions were the hallmarks of responsibility for all teachers, schools, students and the entire education system.

Secretary for #Education Claimed Right to Dismiss Principals for Supporting Teachers' Behaviour; Legislator Criticized as "White Terror"

In an interview with China’s “Shanghai Observer”, Kevin Yeung Yun-hung, Secretary for Education, was asked what possible actions would the Bureau take if a school principal is reluctant to investigate into the conduct of a school teacher, or the principal is in fact supportive of the teachers' behaviour. Yeung responded that should the principal is not up to the requirement of the position, therefore the Bureau has the right to dismiss the principal in this regard.

Vice President of the Hong Kong Professional Teachers’s Association, Legislator Ip Kin-yuen rebuked that Yeung had put unnecessary pressure on school, forcing school principals to execute political tasks and follow the government’s political stance. Yeung’s comment would incite white terror and could lead to incrimination of teacher by their behavior.

White Terror Looms in Hong Kong as Schools Ask to Ditch Debate Topics on Anti-extradition Bill

White terror continues to loom among schools in Hong Kong. One of the debate topics selected by Hong Kong Schools Debate Federation this year was associated with Anti-Extradition Bill, and was then criticized by pro-Beijing newspaper and Hong Kong Federation of Education Workers, also a pro-Beijing organisation. Sources of Apple Daily revealed that Education Bureau has been calling down the list of participating schools, exerting pressure on them to withdraw, saying “its is not advisable to discuss sensitive issues amid a sensitive time”. It was also said that schools were asked to provide names of those students refused to quit.

Besides, major sponsoring bodies of schools, including Tung Wah Group of Hospitals, Roman Catholic Diocese of Hong Kong and Shun Tak Fraternal Association also made contact with and advised their respective subsidizing schools to withdraw from the contest.

The Federation confirmed that 17 schools has withdrawn from this year’s debate contest so far, among which 5 were Government Schools. The Education Bureau had not responded to whether they had been pressurizing participating schools to drop out. However, the Bureau did stress that students should not participate in any contest that is politically coloured, fearing that it may affect their wellbeing.

Recruitment of former disciplined servicemen draws white terror suspicion. EDB: groundless accusations – just to investigate unregistered schools.

(17 Jan) The Education Bureau (EDB) posted a recruitment advertisement for an “Assistant Operation Officer (Central Compliance),” looking for applicants with ‘at least 5 years of work experience in law enforcement departments, such as the Hong Kong Police Force, Independent Commission Against Corruption, Customs and Excise Department and Immigration Department, and be at the rank of Police Sergeant or above, or equivalent.’ Democratic Party legislator Hui Chi-fung questions that, by bringing retired police officers into the education sector, the EDB is spreading white terror. The EDB’s reply to the Stand News’ inquiry states that the position is not a new one, and the main job is to tackle unregistered schools, so they will not inspect any registered secondary schools, primary schools or kindergartens that comply with the legal requirements, nor will they monitor teaching materials at schools. The reply further comments that these are groundless accusations, and the act of spreading false information about the recruitment and the position stems from “ulterior motives” and the “aim to besmirch the EDB’s professional work and specific occupations.”

The EDB also responds that they have established the Central Compliance Section since May 2000, which specializes in dealing with complaints, inspection and prosecution regarding unregistered schools, in the effort to combat such malpractice. To act in concert with law enforcement, the EDB publicly recruits an Assistant Operation Officer to inspect suspected unregistered schools, write up investigation reports, collect evidence (including taking the statements of the people involved), as well as testifying at the court as part of the prosecution procedure. As such, the position requires the applicant to have worked in the disciplined services and have experience in law enforcement.

The EDB discloses that the department publicly recruits related positions occasionally. The last recruitment of the similar kind was in September 2018, and the current recruitment is for filling a vacancy. According to online information, the EDB posted a similar recruitment in 2016.

The EDB clarifies that the Assistant Operation Officer (Central Compliance) is only in charge of work relevant to tackling unregistered schools, and will not inspect any registered secondary schools, primary schools or kindergartens that comply with the legal requirements, nor will they monitor teaching materials at schools. They also rebuke people for making groundless accusations online and spreading false information about the recruitment and the position, and expressed their deep regrets against the “ulterior motives” and the “aim to besmirch the EDB’s professional work and specific occupations” behind these actions.

A screenshot of the job advertisement has been being circulated online, along with comments that the job is no different than a special agent or an “Embroidered Uniform Guard” stationing at school, accusing the EDB for spreading white terror. Democratic Party legislator Hui Chi-Fung questions why law enforcement personnel are needed to monitor and deal with education work. “The EDB is being the Central Government’s attack dog, invading schools with “Red Force” (Chinese power). And now they’re trying to introduce retired police officers into the education sector? This is so absurd that it is unacceptable,” he says, demanding the EDB to explain immediately and stop any attempts of punishment.

Stained and Very Thin Masks Provided by Education Bureau to Hong Kong Students,
Logistics Department Confirms Origin from China and Russia


The Education Bureau in Hong Kong previously announced, that they would provide masks and let school distribute them to students sitting for this year’s DSE Examinations, a public exam crucial to university admission in Hong Kong.

Stand News received 2 complaints from students, who found the masks too thin and stained with yellow marks. In response to the inquiries made by Stand News, the Education Bureau said that the 500,000 masks for local students were supplied by the Government Logistics Department. No complaints had been received from the schools.

The Logistic Department confirmed that the masks were not expired and they came from China and Russia.

Poll Shows 94% of Students Worry About the Spread Coronavirus in Public Exam in Hong Kong

Secondary Student Strike Preparation Platform conducted an online poll in early April, and interviewed 15,000 secondary students, among which 70% are standing in the DSE examination, a public exam for university admission in Hong Kong.

Findings of the online poll show that
• 90% of the respondents opposed of having the examination next Friday as scheduled, among them 94% were concerned about the spread of the Coronavirus.

• Over 60% of the respondents stressed that they would be confident to take examination when no new confirmed cases are found in two weeks’ time.

• 70% of the respondents supported the postponememt of the examination.

Education Bureau informs all schools including kindergartens and special education schools of mandatory National Security Law education

(04 Jul)The Hong Kong National Security Law took effect on 30 June. Last night (3 July), the Education Bureau issued a circular to "inform" all schools including primary, secondary, kindergarten and special education schools to "timely enable [sic]" the school staff and students to "acquire an understanding" and "remind" them to abide by the National Security Law. The notice stated that the schools' "primary responsibilities" were in helping students gain a "correct" understanding of their country and the relationship between their country and Hong Kong, as well as strengthening their sense of national identity. Through "school visits" and "teacher learning circles", the Education Bureau would provide the schools with support and advice for the undertaking. It would also offer more detailed guidelines on promoting national security and law-abiding awareness in students via school management and learning activities as soon as possible.

The Education Bureau's circular insisted that all levels of school personnel including management and all teaching and non-teaching staff "should" consult the provisions within the National Security Law and its relevant information from the government to "correctly" grasp the "key messages" and its scope of application. Schools "are required" to explain the significance of national security as well as the law's meaning and background based on the cognitive development and abilities of their students. This would provide them with the "correct information". They are also responsible for reminding students to abide by the National Security Law as with other "Laws in Hong Kong... and nurture them to become good law-abiding nationals and citizens."

The Bureau also mentioned that, with "ongoing work" occurring in schools, it has been promoting education in the Constitution of China and the Basic Law Education. "To render full support for" the implementation of the National Security Law, it would continue supporting schools with curriculum renewal and the development of learning and teaching examples and resources to reinforce learning elements of national security education. Professional development programmes for principals and teachers would also be organised. The Education Bureau would also offer professional support and advice through "school visits" and teacher learning circles. The circular also stated that school should maintain close communication with parents to help students understand the National Security Law with a "rational and positive" approach "so that students will conscientiously observe the National Security Law and other existing laws of Hong Kong." Schools must also adapt to the students' behavioural and emotional needs when co-operating with parents to "enhance care and guidance" to provide them with "guidance and support".

HK Governmentd Makes #LiberalStudies a Scapegoat for Social Discontent

Hong Kong's Education Bureau (#HKEB) announced on Nov 26, 2020 their plans to reform Liberal Studies, including changing the grading to a pass/fail system, and requiring student to join a study tour to China.

Former lawmaker of the education sector Ip Kin-yuen criticized the proposed curriculum reform for covering up government failures in handling the social discontent about the extradition bill and shifting blame onto Liberal Studies for making students "radical".

He added that the proposed change is apparently putting political consideration above educational professionalism, with a goal to weaken students' critical thinking by inserting politically correct elements.

Ip pointed out that the government also ignores the review report published by the Task Force on Review of School Curriculum in September 2020.

The Secretary for Education Kevin Yeung Yun-hung said that the unit "Hong Kong Today" in Liberal Studies is not for news discussion; whereas Ip stressed that Liberal Studies teaches news-relevant topics including personal development, society and globalization.

"There is no reason to ban the discussions of current affairs," Ip said. He described the government's plan as an act of setting up new limitations for education, and slammed the exclusion of news discussions.

More senior officials of HK Examinations and Assessment Authority resigned reportedly due to extreme political pressure

In May 2020, the history exam paper question from the Hong Kong Diploma of Secondary Education Examination (#HKDSE) was harshly criticized by pro-Beijing figures. The question asked students to discuss whether Japan did more good than harm to China during the war years.

Soon after the PRC's Foreign Ministry condemned the question, calling it biased and off-limits, Hong Kong government's #EducationBureau pressured the Hong Kong Examinations and Assessment Authority (#HKEAA), an independent organization, to strike out the question because it “seriously hurt feelings and dignity of the Chinese people who suffered great pain during the Japanese invasion of China”.

This incident was said to lead to resignation of Yeung Wing-yu, Manager of the Evaluation and Development Department of HKEAA and Secretary of the Committee on Subjects of the History Section in August 2020.

Before leaving the Authority, Yeung revealed to his colleagues that his resignation was due to extreme political pressure. He suspected that the series of seemingly coincidences were in fact vigilantly planned.

Yeung pointed out that the DSE question was leaked way before the examination day in May while the question’s marking scheme was leaked two months later in July. During this time, his social media account was being repeated hacked for at least twice.

After HKEAA’s decision to invalidate the question on Sino-Japanese relationship on 22 May, he personally covered up students’ answers to the question. Yeung considered the incident the biggest humiliation in his tenure in HKEAA.

Liberal studies is another subject furiously pounced by the SAR government. Lo Ka-yiu, Senior Manager of HKEAA responsible for Liberal Study was fluttered by pro-Beijing mouthpiece in Hong Kong for his pro-democracy opinion calling for the city’s Chief Executive to step down.

In May 2020, Lo and Leung Tsz-yin, a manager reported to him, both resigned. In September, two Liberal Studies teachers, Fan Si-kei and Lam Yi-mei, were appointed to replace Lo and Leung.

However, it was reported on December 5 that Lam Yi-mei resigned despite an extremely short tenure of less than three months.

Since May 2020, a number of senior officials of HKEAA has either resigned or their contracts not being renewed, including the Authority’s Secretary General, principal officer of Assessment Development, as well as Senior Manager and Manager responsible for Liberal Studies.

Most recently, HKEAA announced appointment of their new Secretary General Ngai Heung-tung, Professor of Economics of Lingnan University who again has profound Chinese background.
