Defendants Apply to Lift Restrictions on Reporting Court Proceedings

Towards the end of the court hearing for the #47Democrats on Nov 29, one defending lawyer attempted to seek clarification from Magistrate #LawTakChunPeter over three legal stand points, including asking the court to lift the reporting restrictions set out in the Magistrates Ordinance.

Section 87A of the Magistrates Ordinance prohibits reporting the majority of details of committal proceedings, but defendants have the right to request that the restrictions be removed. Accordingly, several defendants' lawyers asked the court to remove the limitations.

Magistrate Law, in fact, sought assistance from one of the defending lawyers to coordinate the matter. The courtroom broke into laughter as the judge struggled with the overwhelming workload of a case with 47 defendants.

The magistrate decided to adjourn hearing the substantive arguments on the application to January 17, 2022 at 9:30am.

He ordered some defendants to return to the court on February 8, while another court appearance is scheduled for March 4.

Defendants and Supporters Catch a Moment to Cheer On Each Other

Most of the defendants of the #47Democrats case have been remanded for over 8 months. Court hearings have become the only occasion where they can see their families and friends.

When the four-hour-long hearing ended on Nov 29, defendants in the dock stood on the benches and moved close to the glass panels to bid farewell to the court attendees.

Former district councilor Sam Cheung shouted, "the toilet in room 1 has been fixed!" Owen Chow shouted back, "Work out more, Sam Cheung!"

Cheung grinned as he replied jokingly, "Prison life is hard, I got no time for work out!"

Former district councilor Tiffany Yuen told fellow defendant Owen Chow – who is on bail – to write letters back to her. Chow acknowledged her, shouting back “Bye bye Tiffany!”

Greta Thunberg Has a Message for Jailed Hong Kong Activist Joshua Wong

The Swedish climate campaigner #GretaThunberg has written imprisoned Hong Kong activist #JoshuaWong a letter, in an effort to draw attention to the detention of the protest leader in Hong Kong.

"You are a big hero, we are with you always,” Thunberg's letter reads. “Stay strong and never give up. You are never alone. I really hope that we will be able to meet one day.”

Hong Kong Pro-democracy Activist #RayChan Gets Married in Face of #PoliticalProsecution

Activist and former legislator Ray CHAN Chi-chuen is one of the 47 pro-democracy figures who were charged over national security violations for participating in the Primary Election of the pro-democracy camp in July 2020.

In face of political prosection, Chan, while on bail, decided to get married. Chan thanked his partner for supporting him during his arrests, trials, and detention.

The ceremony took place in Hong Kong on December 15, 2021. Since Hong Kong's law does not recognise same sex marriage and Chan's passport has been confiscated by the authorities, Chan and his partner registered their marriage virtually in Utah of the United States.

Chan is the first #LGBTQ legislator in Hong Kong. He has been detained for half a year before his bail was granted in September 2021.

Hong Kong Court Asks Man to Change Mask With Suspected Protest Iconography


#CarolNg, former chairperson of Hong Kong Confederation of Trade Unions (#HKCTU) and one of the “#NSL47”, has been remained under custody. She has requested bail on #Dec20, 2021 to the High Court, and the application was processed by Esther Toh Lye Ping, one of the designated judges for any #NationalSecurityLaw-related cases.

A court observer have worn a yellow and black mask with the #Bible verse (Amos 5:24), “But let justice roll down like waters, and righteousness like an ever-flowing stream,” embroidered on it.

He was denied entry by security and court personnel under orders of the judge, and demanded that he change his mask before he would be allowed entry. They have not explained their reasons behind this act.

The observer was disgruntled by the request, and questioned, “If my clothes were not allowed in court, do I have to take them off them too?”

A similar incident also happened on #Dec17, 2021, when former head of the English edition of Apple Daily #LoFung (Fung Wai-kwong) requested bail.

Before the hearing began, Toh, through her secretary and Bailiffs, required observers wearing yellow masks or wearing hoodies with yellow umbrella insignias to change into “more appropriate” clothing, or be led away from the courtroom.

Some observers have questioned the requirement, questioning that those were “unsuitable” clothing, to which the Chief Bailiff stated, “it is inappropriate,” without further explaination.

Hong Kong court adjourns democrats’ subversion case again

//Acting Chief Magistrate Peter Law was scheduled to handle procedures relating to nine defendants in the West Kowloon Magistrates’ Courts on Monday [February 28], exactly one year since the pro-democracy figures were officially charged with conspiracy to commit subversion under the national security law.

Fourteen are currently on bail pending trial, while the rest remain in custody.

The nine included former law professor Benny Tai, former lawmakers Jeremy Tam, Wu Chi-wai, Andrew Wan, Kwok Ka-ki, Alvin Yeung and Au Nok-hin and ex-district councillors Andrew Wan and Ben Chung.//

Pro-democracy activist arrested for violating bail conditions

On March 7, the Hong Kong police National Security Unit arrested Winnie Yu Wai-ming on suspicion of violating bail conditions, when she made comments online.

Yu, a nurse, is the founder and former chairwoman of the Hospital Authority Employees Alliance — a union for healthcare workers known for its pro-democracy stance.

She is one of the 47 activists charged with conspiracy to subvert state power for partaking a primary legislative council election in 2020.

Yu was among the few who secured bail in July 2021 on stringent conditions that she refrains from all acts and speeches that could endanger national security, as well as from contacting foreign government officials and legislators.

//Hong Kong pro-democracy activist “Fast Beat” Tam Tak-chi has been sentenced to 40 months in jail and given a HK$5,000 fine after being convicted of 11 charges, including seven counts under the colonial-era sedition law.

The DJ and former vice-chair of People Power has been held in custody since he was arrested in September 2020. He appeared in front of handpicked national security judge Stanley Chan at the District Court on Wednesday.

The 50-year-old activist faced 14 charges, including “uttering seditious words,” disorderly conduct in a public place, conspiracy to utter seditious words, holding or convening an unauthorised assembly, incitement to knowingly take part in an unauthorised assembly, and refusing to obey an order given by an authorised officer...

After the court session ended, Tam shouted: “Mum, take care of yourself, you will have to live longer to wait for me.”

Tam’s ex-DJ partner, former lawmaker Raymond Chan, was among those sitting in the public gallery. People stood up and waved at Tam as he stepped into the dock, and the activist waved back.

Tam is among the 47 pro-democracy figures awaiting trial under the #NationalSecurityLaw over their roles in a primary election for the 2020 Legislative Council election, which was later postponed.//

47 democrats’ subversion case adjourned to June 2022

//Hong Kong’s high-profile subversion case involving 47 leading democrats has been adjourned to June 2022, days after a court judgement revealed at least 11 of them would plead guilty to the offence under the Beijing-imposed #NationalSecurityLaw.

Most of the group have been held in custody since their arrest in February last year and their cases have been repeatedly adjourned. Only 13 of them have been granted bail.

The democrats, accused of conspiracy to commit subversion, appeared before Principal Magistrate Peter Law on Thursday. The court is handling proceedings to commit them to the High Court, where the maximum penalty is life in prison.

Unlike previous hearings, the courtroom was relatively quiet when the democrats were escorted to the dock by corrections officers. Their family and friends, who took up most seats in the public gallery, only waved at the group and made hand gestures.

Court attendees have been less vocal since six people were arrested earlier this month under the colonial-era sedition law for allegedly causing nuisance during a hearing. One of the arrestees, citizen journalist Siew Yun-long – better known as Siu Wan – also attended Thursday’s hearing.//
