Expert Question How Widespread Corruption is in Hong Kong Police Force

On April 30, Apple Daily released an exclusive investigative story and outed Assistant police commissioner Rupert Dover for allegedly breaching the property rule. Dover and his wife were reportedly residing in houses barred by government regulation from allowing anyone but immediate family to live in.

On the next day, the paper further revealed that the couple had rented out one of the houses as a guesthouse without a licence.

As the story unfolded, Dover’s wife, Cheung Ngai-si, also a police officer, was suspected of replacing her profile picture with a photo of the Apple Daily reporter involved in the investigative media report on her Facebook page. The incident could amount a threat to the reporter and a significant blow to press freedom.

The member who withdrew from the International Expert Committee of IPCC, Clifford Stott, a Keele University Professor of Social Psychology specialized in Police Powers, shared Dover’s news on his Twitter on May 2.

In his comment, he described Dover as “one of the Police Commanders who handles protests in Hong Kong with radical and violent means”. Stott said Dover was currently involved in an accusation of corruption. He then openly asked, “How widespread is this in the Hong Kong Police Force?”

War against violence: Hong Kong Police received $2.5 billion overtime allowance last year, police officers account for 90% of suspected corruption cases concerning civil servants relating to "anti-extradition" protests

Average monthly overtime allowance of $16,000 per person

The police's overtime allowance (OTA) continues to arouse public concern. Many Legislative Council members continued to follow up with supplementary questions on the latest figures during Finance Committee meetings. In response, the police indicated that the total expenditure on OTA for the whole of 2019-20 was approximately $2.52 billion, which was a $460 million increase from last month alone. On average, the year saw 13,000 recipients per month and a further increase of 1,000 "beneficiaries". Each recipient got an average of $16,000 per month.
 
This considerable remuneration failed to attract the public to join the Hong Kong Police Force (HKPF). The number of applicants dropped sharply. In reply to a Finance Committee supplementary question by legislator Eddie Chu Hoi-dick, the police stated that the number of applicants for Inspector of Police (IP) was only 5,223 during the 2019-20 recruitment. Compared to 7,350 last year, it decreased by more than 2,000 or nearly 30%. In the same year, only 6,751 applied to be a Police Constable (PC), a decrease of 3,827 or 36% from the previous year.

Third controversy amongst the top brasses of the Police Force, involving Commissioner PK Tang

The Boland Court high-rise duplex unit in Kowloon Tong once rented by Chris Tang Ping-keung, the head of the police force, was found to be illegally modified by reporters of Apple Daily.

The police issued a press release at 3 a.m. on May 4, two hours after the report was published, alleging that the news report was inconsistent with the facts. Tang admitted that as early as 2017, he knew that the Housing Department had issued an statutory removal order, which he then "immediately notified the owner of the removal order and asked him to remove the structure", moving out of the building in June 2019 after the owner refused to comply with the order.

The press release claimed that Apple Daily's report on the matter was untrue and expressed displeasure on it.

This newspaper first enquired with the police at about 3 pm, last Friday (#May1). At 9 pm, the police replied that Tang had rented the unit, "but moved out of the site last year." At about 1 am the next day, the police added a reply, saying that if the newspaper had relevant information or evidence on the matter, "please inquire or file a complaint to the relevant department, and the relevant personnel will cooperate with the investigation held by that department."

At 5:30 p.m. on the same day, the reporter asked the police again of the time when Tang moved out last year. He also mentioned that the unit was issued a statuary removal order by the Housing Department and asked whether Tang was informed. However, the police's final reply was a repeated one, that the reporter should submit the evidence to the relevant departments.

The police responded to the incident by drop-feeding information.

There are still many doubts that have not been explained to the public regarding on whether Tang leased unauthorized units. This also includes questions of whether the tenant was informed of the illegal modifications when they signed the lease and if they were aware of the existence of the unit before receiving a notification from the Buildings Department, whether the unauthorized unit been used during the entire rental period, and whether in 2017, after learning from the Buildings Department that he had to deal with the problem of unauthorized construction, did he actively assist the Department in contacting the owners and request that it be dealt with as soon as possible, along with other questions regarding the unauthorized building. All of them remained unanswered.

Tanya Chan, the convener of the Democracy Camp Caucus and a member of the Civic Party, criticized Tang for his lack of political sensitivity. She stated that Tang as a senior official, should be more prudent in dealing with the unauthorized building issue, seeing that it is a recurring political scandal, and that "after notifying the owner, he should've tried other methods."

“If he knew that it wasn't legal and that there is a safety issue with the construction, he shouldn't have used it at all."

Chan thinks that Tang cannot be excused just because he is not the owner, or simply because the illegal structures were not built by him.

Council Members now questioning this series of scandals

The Democratic Legislative Council member Lam Cheuk Ting bluntly stated that the police's "clarification" is in fact an attempt to "warp reality".

"Him moving out because of the illegal construction is not a fact."

He believes that if Tang knew of the illegal construction before renting, strictly speaking, he should not have rented it at all. The Security Committee of the Legislative Council will hold a meeting this afternoon, with Tang attending the briefing "Hong Kong Public Security in 2019" and answer questions from the legislators.

It is expected that he will respond to the recent series of scandals of the "one department, three controversies" of the police force. It is difficult to guarantee whether or not he will be questioned. Lam made it clear that he will ask Tang to explain the serious corruption of the police under his management.

US Senator Jim DeMint: I’ve changed my mind about China, America should too

“I’ve changed my mind about China,” said former US senator Jim DeMint, “America should too.” Having belief in free enterprise, markets and trades, DeMint supported George Bush’s agenda of letting China into #WTO, which according to him, was a hard but right vote as he had believed. However, never would he realize was that the dictators of China were so capable of corrupting the world into their benefit. Instead of playing under the rule they prey on America, and the rest of the world alike. Human right in China remains a disaster, but international organizations and #US congress are too intertwined with it to make any move. And eventually, it leads to the loss of American sovereignty and interest. America cannot be truly free nor safe if it continues to depend its necessities on a hostile adversary.

this pandemic has given its warning. The question is, how far can #America get away with blaming them, be it #China or international bureaucrats, who have no reason to serve America’s interest by definition? Letting these people get away with their shady business is an indisputable failure of the government that Americans need to wake up into and call a change on.

Victims of Police Brutality Films Video to Attest to Police Sexual Violence

Police violence has been ongoing since the beginning of the Hong Kong Protests. Victims of police sexual violence have recently produced a video asking for international aid. The five victims include CUHK student Sonia Ng, 17-year-old K, a man in his twenties going by the pseudonym C, Chloe, who was bared by a policeman in August last year, and Miss Lui.

They alleged that the police had conducted strip searches for no reason, harassed them sexually, and forced them to defecate or urinate while being spectated by others. The male victim had to also endure getting hit on his buttocks and at his genitals by a policewoman.

They also alleged that Miss X, whose case involved having been gang-raped inside Tsuen Wan Police Station, had made them untrusting of the Complaints Against Police Office to take their case seriously. They also feared police retribution for filing a complaint against the police, as they viewed the Independent Police Complaints Council as a black box organization.

They called for the US to speak on behalf of the victims of police sexual violence in Hong Kong, and to put sanctions on the perpetrators and the CCP, "Hongkongers are now standing on the frontlines against the fight against the CCP. We have done everything we could, and we now ask for your help."

Faced with days of accusations regarding sexual violence committed by their very own officers, the Hong Kong Police Force had only stated that all complaints are directed to the Complaints Against Police Office, when asked whether or not they would conduct investigations willingly.

Suspected for Receiving $3M from CCP, University of Pennsylvania Failed to Explain the Donor's background

The University of Pennsylvania, a member of the Ivy League, was accused that a donation from an unknown party of US$3M, may include the Chinese Communist Government. Washington Free Beacon, a political news website by the conservatives, reported on 3rd August "The amount of donation was from a mysterious shell corporation in Hong Kong which its boss was involved in a government official corruption case in Shanghai, resulting in resignation. Besides, he has a close relationship with the Chinese Communist Party. The donation implies that China is paying an effort in interfering with the Academies in the US."

In the past few years, the University of Pennsylvania received a large number of foreign funds, which the majority was from China. From March 2017 to the end of last year (2019), the University received presents and contracts of US$61M involved. Among the large amount, cash donation owned a significant portion of US$19M.

#PandoraPapers Expose Undisclosed Assets of Former Hong Kong #ChiefExecutives

Hong Kong Stand News took part in the Pandora Papers investigations by the International Consortium of Investigative Journalists (#ICIJ), joining forces with over 600 journalists across 117 countries and territories in uncovering secret finances of the rich and powerful of the world.

The papers uncovered undisclosed assets held by two former chief executives of Hong Kong, #LeungChunYing and TungCheeWah, both of whom are now serving on the Chinese People's Political Consultative Conference (#CPPCC) as vice-chairmen.

(1) Leung Chun-ying's Undisclosed #UGL-Related Sales May Constitute Misconduct, Says Ex-ICAC Officer

Leung was found to have made undisclosed sales of shares worth HKD $2.3 million in EuroAsia Properties, a subsidiary of international property services firm DTZ, which he held through a convoluted string of ownership via two offshore companies.

Notably, the undisclosed sale occurred during an anti-corruption investigation on Leung in 2015, in which he was said to have received HKD $50 million as part of an agreement with Australian firm UGL when it acquired DTZ Holdings. The details of the newly found sales agree with those of the UGL agreement, which was disclosed by Sydney Morning Herald.

The ICIJ and Stand News had inquired Leung regarding the new findings, without receiving a reply.

Since the Pandora Papers were published, however, Leung published a statement on the same day, claiming that the government's reporting rules did not require declaring changes in subsidiary companies. He also said that he had initiated procedures for resigning from his director's position at EuroAsia before becoming chief executive, and that it may not be immediately effective due to the differing legal processes in different countries.

However, barrister and former ICAC Chief Investigation Officer Stephen Char said that this shows that loopholes exist in the government's procedures of declaring assets. If there is sufficient evidence that the omission is deliberate, Char added, it may constitute an offence of Misconduct in public office.

(2) Tung Chee-Wah and Family Involved in Over 72 Offshore Companies

The Pandora Papers also show former chief executive Tung Chee-wah and his family to be involved in at least 72 offshore companies, of which 7 are owned by Tung.

One company's HSBC bank account was found to have current assets worth an estimated USD $1 million.

Tung's youngest son also has a Bank of China account via another offshore company. Tung's brother Chee-chen allegedly also has bank accounts through 4 offshore companies, and owns mansions in opulent neighborhoods via yet another two offshore companies.

Of the 7 companies owned by Tung, the papers show that he has either full or partial ownership in his name or in a company name. These 7 are all established in March 2005, after Tung's resignation from his chief executive position.

Now 84 years of age, Tung was conspicuously absent at the flag-raising ceremony on China's national day last Friday, Oct 1. His spokesperson said that Tung was not feeling well that day, and was resting at home.
