Hospital Authotity: Staff took part in strike will face possible legal consequence

Many medical staff took part in the strike in February 2020 in a bid to pressure the government to lockdown the city’s boarders and to curb the rapid spreading of the coronavirus and safeguad public health.

Not only thst the Hospital Authority (#HA) challenged cause of the strike, Chairman of HA, Henry Fan Hung-ling also intimidated medical staff who partook in the strike with possible legal consequence in early June.

On September 24, Fan claimed that the Authority has received detailed legal opinion from external lawyers. The Human Resource department will soon issue letters to those absent from work coinciding the period when the strike was staged. They will be asked to state reasons for their absence and based on the stated reason, follow-up actions will be carried out.

An estimation of several thousands of medical staff would be involved.

When being asked whether dismissal could be one of the possible consequences, Fan refused to reply. He also declined to address whether salary deduction is possible, saying, “I do not want to comment on any penalty measures today.”

Hospital Authority demands explanation from those went on strike; Union defends it a legitimate industrial action

The #HospitalAuthority issued an email on October 9 to all employees who joined the strike this February, asking for explainations for their absence on each day during the #strike period by October 23.

The HA Employees Alliance, the initiator of the strike, advised its members not to rush to reply the email individually. #HAEA has been seeking legal advice for an aligned response. On October 10, the union further announced issue of a template its for members to reply.

Chairperson of HAEA, Winnie Yu Wai-ming, said that HAEA is a registered union and the strike motion has been supported by members’ votes, therefore the strike was a legal industrial action.

90% of pro-democracy respondents consider HA’s demand for staff’s explanation for absent of work during a strike is politically motivated

The #HospitalAuthority (HA) recently sent a letter to employees took part in the strike early this year and asked for their explanation for absent of work.

A survey conducted by the Hong Kong Public Opinion Research Institute (PORI) showed that 60% of the respondents believed HA’s demand was politically motivated, while around 30% considered otherwise. Among those claiming a pro-democracy stance, an overwhelming 90% believed that there is political agenda behind HA’s action.

Arrested District Councillor: It felt as though the motive was to confiscate my passport


On Jan 6, 2021, the Hong Kong authorities launched the largest crackdown on the pro-democracy camp since the implementation of the National Security Law in June 2020. The Hong Kong Police Force arrested 53 pro-democracy figures including former lawmakers, current district councillors, campaigners, lawyer and scholars, all in one day.

51 of them were detained overnight for over 40 hours before they were bailed on the evening of Jan 8, 2021

Democractic Party member Wan Siu-kin, formerly lawmaker and currently serving as a district councilor in Kwai Tsing, said the police had record his testimony on video for 3 times, with officers from the national security bureau handling the final recording.

During the process, the police showed him a newspaper cutting, which read "Ten Steps to 'Laam Chaau' [literally meaning, stir fry together]" and asked if Wan knew about it, and who said it.

Wan said the police also showed three short recordings about the legislative primaries that took place in July 2020. To his understanding, the officers from the national security bureau only handed the short recordings to other police officers on the same day and in a hurry.

Wan had the impression that everything was "done in a rush" and that it "felt as though the motive was to confiscate (his) passport".

Vocal journalist in HK faces dismissal by government-funded broadcaster before probe result


#NabelaQoser, a journalist of #RTHK, who confronted Chief Executive of Hong Kong, Carrie Lam over her handling of the 2019 protests for multiple times, is facing dismissal after the public broadcaster ended her three-year-odd probation for a civil service post and offered her a contract for just 120 days.

Qoser’s probation was extended by 120 days in late September 2020, shortly before she was due to complete the three-year probation under civil servant employment terms in October.

The broadcaster launched a probe into her work, citing complaints received against her since July 2020. The results of the probe, originally due in January 2021, would determine if Qoser was to gain a coveted contract as a permanent civil servant.

#RTHK Staff Union Rally to Support Journalist: We Are All #NabelaQoser

On January 28, 2021, more than 60 RTHK employees protested at the headquarters against the station's mistreatment of the journalist Nabela Qoser.

The video shows RTHK staff wearing a mask of Qoser's face and chanting slogans like, “Groundless charges”, and “Politics overriding professionalism”.

The management of the public broadcaster had previously launched a probe into complaints made against Qoser, after she enraged Beijing loyalists with her critical questions towards government officials and the Chief Executive Carrie Lam, during the Anti-ELAB movement in 2019.

Qoser was cleared of wrongdoing, but RTHK reopened its investigation in October 2020 and extend Qoser's probation period as a civil servant.

On January 22, 2021, Qoser's contract as a civil servant was terminated by RTHK, which reportedly cited the probe as a reason. Instead, Qoser was offered a new 120-day contract.

The RTHK Programme Staff Union decried the broadcaster’s move as something no difference than firing Qoser.
