China lost patience over Hong Kong

The central government is exploiting the right of Hong Kongers at an alarming rate, interferencing local legislation and “the high degree of autonomy”. Chinese officials have announced plans to impose controversial laws in Hong Kong, the implications of which activists say could be "deadly dangerous" and a "knockout blow" for Hong Kong's one country, two systems deal with China.

Hong Kong’s autonomy was guaranteed under the “one country, two systems” principle enshrined in the 1984 Sino-British joint declaration. Yet, 186 law and policy leaders from UK said the proposed laws are a “comprehensive assault on the city’s autonomy, rule of law and fundamental freedoms” and “flagrant breach” of the Sino-British Joint Declaration. Despite being blamed for the pandemic, China is using the coronavirus crisis as a distraction to push through its geopolitical aims. The international community should not trust Beijing to keep its word when it comes to Hong Kong, people will be reluctant to take its word on other matters. The only hope of Hong Kongers might be from international helps, especially, Britain's.
Chris Patten, the last governor of the former British colony, mentioned China has betrayed the people of Hong Kong, and the UK has a moral, economic and legal duty to stand up for them. He also suggested Hong Kong residents with British national (overseas) passports (BNO) should be allowed to settle in the UK. The number of applications of #BNO has increased sharply since 2019. Hong Kongers have no faith in the #tyranny government.

Boris Johnson’s spokesman said on Friday that the prime minister and his government were monitoring the situation, and that as a party to the joint declaration the #UK was committed to the upholding Hong Kong’s #autonomy and respecting the one country, two systems model. And that could be the only hope for Hong Kongers to shirk the authoritarianism. Yet, even #immigration can help some of the Hong Kongers, the root cause has not been solved. As a Hong Konger, I wish that Britain could take a part in our situation as what Chris Patten mentioned and willing to give a hand to us.

Battle against tyranny: High Court judge Patrick Li barred from Anti-ELAB related hearings after signing Anti-Extradition petition

(28 May) On the eve of the 9 June demonstrations last year, High Court judge Patrick Li, who presides over the Court of First Instance, signed a joint press statement alongside more than three thousand alumni from the University of Hong Kong entitled, "We oppose deceitful policies, withdraw the Extradition Bill." The Judiciary later acknowledged that a judge was involved in the petition. Chief Justice Geoffrey Ma discussed the matter with the said judge, reminding him to refrain from letting similar issues to occur in the future. Today [28 May], Sing Tao Daily quoted the Judiciary that based on the Guide to Judicial Conduct, Li was to avoid handling cases that related to the petition's subject matter to prevent "apparent bias" from arising. This means he is barred from handling cases on Anti-ELAB [Anti-Extradition Law Amendment Bill].

According to the report, the Judiciary responded by quoting paragraphs 46 and 47 of the Guide to Judicial Conduct: "In practice, questions of disqualification are most likely to arise in relation to suggestions of the apparent bias", and "The apparent bias test may be stated as follows: A particular judge is disqualified from sitting if the circumstances are such as would lead a reasonable, fair-minded and well-informed observer to conclude that there is a real possibility that the judge would be biased." The above principles apply to scheduling cases at all levels of court. The Judiciary decided that when assigning cases for the Court of First Instance judge Patrick Li, he would not sit in cases related to the joint statement to avoid apparent bias.

On 1 Oct last year, Li handled the case of local actor Gregory Wong concerning the 1 July Legislative Council incident. Wong was detained by the police for approximately 36 hours. Li granted a writ of habeas corpus after trial and Wong was released at 7:50 pm on the same day.

Last month, District Judge Kwok Wai-kin's handling of the Lennon Wall attack case in Tseung Kwan O provoked controversy over his verdict where he praised the defendant's "noble virtue". Chief Justice Geoffrey Ma subsequently issued a statement that inappropriate or unnecessary expressions of political opinions by judges and judicial officers could harm their impartiality and credibility. He determined that Kwok should not sit in any cases surrounding such political issues for the time being. Currently, two judges in charge of criminal cases - Patrick Li and Kwok Wai-kin - are barred from hearings that involve Anti-ELAB due to personal conduct or remarks made in trial.

Feeling Inspired on the night of 4 June, 2020 in Hong Kong

Image:

(4 Jun) Today, Fellow saw a bunch of posts condemning the hypocrisy of Hong Kong celebrities by showing their old photos, especially those in The Concert for Democracy in China, as well as when people like Leung Chun-ying (Third Chief Executive of Hong Kong) and Priscilla Leung Mei-fun (Hong Kong barrister and legislative conciliator) supported the Tiananmen Square protests in 4 June 1989 and condemning Chinese Communist Party.

Maybe we’ll consider them disgraceful and laughable, but when we think about it, on the path of a revolution, both you and me are bound to be tempted by the enemy at all times.

Recently, Fellow rewatched the Sci-fi movie, The Matrix, which was a favourite during my school days. The most classic scene in the movie is one where the protagonist Neo (Keanu Reeves) had to choose between the “Red Pill” or “Blue Pill”, aka “to awake” or “to indulge”.

1. Choosing the “Blue Pill”—to be comfortable with the status quo
Stay in the past, where truth and justice are not the purposes of life; As long as life is good and stable, everything else can be ignored, and it does not matter even if life is virtual.

2. Choosing the “Red Pill”—to pursue the truth

Leave the comfort zone to face the unacceptable truth, and live a life that others may not understand, and even have his own safety threatened.

In the movie, Neo chose the Red Pill. He woke up to see himself (and all of mankind) always being the slaves to the Matrix, where the past was just a virtual dream created to cultivate humanity as a source of energy. Afterwards, Neo embarked on a harrowing adventure to defy the Matrix while being hunted. Indeed, one year ago, many Hongkongers chose the Red Pill to protest, few million people once took to the street against the demonic Extradition Bill. But we can reverse our original choice at any time.

In the movie, there’s an antagonist called Cypher, who had the Red Pill before Neo and joined the Anti-Matrix revolutionary army. But as time went on, Cypher started to get tired of being in the real world, even more so of having to eat monotonous food that tasted bad every day. Thus, seduced by the Matrix, he decided to betray his comrades in arms and told Agent Smith (the lobbyist the Matrix sent to seduce him), “You know, I know this steak doesn't exist. I know that when I put it in my mouth, it's the Matrix telling my brain that it is juicy and delicious. After nine years, you know what I realize? Ignorance is bliss. I don't want to remember nothing. NOTHING! You understand? (Give me the Blue Pill again) And I wanna be rich. You know, someone important, like an actor.” The Matrix answered his demands on the condition that he kills the other anti-Matrix revolutionaries.

Of course, in the end, Cypher's devious plan failed and he became one of the most hated characters in the movie.
In reality, 31 years ago there were 1.5 million Hongkongers who took to the street for democracy; But today, how many of them have become useless elderly and blue ribbon (pro-government people)? From going against the CCP to flattering it? Every one of them has taken the Blue Pill like Cypher.

After one year of protest, have you become numb and jaded (about the sadness and unfairness in our daily life)? Will you choose to go back to the false life and continue with the status quo? I hope today's portrait of the hypocrites will serve as a reminder for us in the future.

I also declares once again that as long as tyranny is not extinguished, we will continue to fight even if it is our last breath.

Never jaded, never forget.

Concerns over the broad coverage of the National Security Law,
Hong Kong Law Professor: The idea that "national security should overrules everything" will only result in
tyranny

A three-day meeting was held by the Standing Committee of the National People's Congress in Beijing last week, with details of the National Security Law draft being discussed during the meeting.

According to China state media Xinhua News Agency, the definition and the criminal responsibility of secession, subversion of state power, terrorist activities, collusion with foreign or abroad forces to endanger national security were discussed. Moreover, the wordings in one of the four criminal offences described by the Xinhua Agency has been changed from "foreign or abroad forces to intervene in affairs in HKSAR" to "collusion with foreign or abroad forces to endanger national security"; which some interpreted the amendment as a target to local individuals and organisations.

The Xinhua Agency also indicated that drafting the law itself is an important process that affirms the Committee's hope and need to pass the Law.

In an interview, Johannes Chan, Chair Professor of Law at the University of Hong Kong, said in the details of the draft announced, "collusion with foreign or abroad forces to endanger national security" includes inciting, conspiring, convincing, or even unilaterally planning of criminal activities. With the Chinese government vesting the power of interpretation, Chan worried that the definition of criminal offences can become arbitrary, and might vary from time to time. He also expressed concern that the promise of "one country two systems" and Hongkongers' protection under the Basic Law are no longer valid since the new Law overrides the Basic Law, and charged Hongkongers can be sent to the mainland for trials.

Chan also emphasized that protecting national security does not justify random accusations and sentencing or even executing without going through trials. The idea that "national security should overrules everything" is an misleading concept, and will only result in tyranny.

Pro-Beijing Politician: Waving national flags of other countries is illegal under the National Security Law

The PRC's Standing Committee of the National People's Congress will meet for three consecutive days starting Sunday on June 28. According to pro-Beijing politians, it is expected that the National Security Law will be tabled and endorsed in the meetings.

Beijing loyalist and Hong Kong representative attending the meeting Yip Kwok-him said that the finalised draft remained unknown at the moment. According to existing draft, waving national flags of the United Kingdom, the United States of America or Hong Kong would be deemed illegal under the National Security Law.

Yip stressed that if the Law cannot deal with these circumstances, there is no practical effect, citing the controversial Article 23 as only a "toothless tiger". Yip pointed out that once when the National Security Law is in force, it would be an obvious breach for anyone lobby for foreign country to impose sanctions on Hong Kong.

Virologist fled Hong Kong: I know how they treat whistleblowers

Dr. Li-meng Yan, a virologist in the University of Hong Kong, realized COVID-19 is transmittable between humans as early as Dec 2019. She believes that the Chinese government withheld that vital information at that time, costing millions of lives worldwide. Her supervisors from HKU, despite also being consultants in the W.H.O., did not do anything to stop this massive crisis.

Dr. Li fled to the US to reveal the truth. Right after she left Hong Kong, her family in mainland China was 'visited'; her work accounts and emails became unaccessible.

Anyone can be Dr. Li. Will you speak out when politics override conscience? Show your obedience to #tyranny or #strive for a democratic government, it is your choice now.

China’s “recolonization” of Hong Kong could soon be complete

The Chinese Communist party (CCP) has made clear it has no intention of honouring the international treaty its signed with the UK in 1984, which promised a high degree of autonomy to Hong Kong for at least 50 years. The most important aspect of this affront to the former colonists is what it tells us about the kind of power a rising CCP intends to be in the world.

The sweeping changes in the territory indicate that President Xi Jinping really does believe China is engaged in a bitter ideological struggle with the “extremely malicious”, “western” ideas of liberalism and democracy.

Blinken: "Tiananmen" is a Synonym of China's brutal actions, the protest at the time echoes Hongkongers' struggle today

On the 32nd Anniversary of the June 4th Massacre, the US Secretary of State Blinken issues a statement saying that Tiananmen had already been a synonym of brutal actions by the Government of the People’s Republic of China (PRC) in 1989. He also describes the Tiananmen demonstrations in 1989 echoing the struggles for democracy and freedom in Hong Kong.

The statement said that the people at the Tiananmen Square by then had a noble and simple request: Recognize and respect the human rights. Blinken criticises the PRC authorities for failing to meet the people's request and responded it with violence. He said that the courage of the protesters on the June 4th incident reminds him never stop seeking transparency on the events of that day, including a full accounting of all those killed, detained, or missing. He also pointed out that the Tiananmen demonstrations echoes the struggles for democracy and freedom in Hong Kong, where a planned vigil to commemorate the event was banned by local authorities.

He emphasises that the US will continue to stand with the people of China as they demand their government to respect universal human rights.
