China's Court Approves the 'Arrests' of Pro-democracy Hongkongers Already Detained in China and Might Sentence At Least Two People to Up to 7 years' Imprisonment

1. On September 30, 2020 in Shenzhen, the Yantian District People's Procuratorate approved the 'arresst' of the 12 pro-democracy Hong Kong civilians who have been captured on a speedboat and detained in China for over a month since August 23, 2020.

Among them, Quinn Moon and Tang Kai-yin, were charged on suspicion of organising others to cross the border illegally, while the other 10 were charged for illegal crossing of the border.

2. The bail request of 5 detainees were rejected. According to PRC criminal law, illegal crossing of border will be sentenced to a maximum of 1 year's imprisonment, while those who are convicted of organising others to cross the border illegally can be jailed for 2 to 7 years.

Pro-democracy activist Owen Chow pointed out that China tried to justify the detention of the 12 Hongkongers before the PRC's national day on October 1.

Editor's note: The conviction rate of China's courts is 99.9% in 2019, according to the figures cited by New York Times.
