Further Erosion of Rights: Hong Kong Police Obtain Power of Search of Mobile Phones without Warrant

On April 2, 2020, the Hong Kong's Court of Appeal reverts the ruling of the High Court and grants the Hong Kong police power to access the digital content of mobile phones, without the need to obtain a warrant.

The appeal was submitted by the police commissioner in opposition to the High Court's ruling made in 2014. During the annual July 1 protest in 2014, the phones of five pro-democracy activists were confiscated by the police. The group filed a judicial review and the court ruled that it is unconstitutional for the police to have such power.

Regarding the new ruling in 2020, concerns are raised over the infringement of personal privacy and the further erosion of rights. The judgement stated that refusal to give password to the police would not constitute an offence of obstruction.

HK Journalist #BaoChoy to #Appeal: "I will regret for a lifetime if I give up pursuing justice"

On May 5, 2021, former #RTHK producer and award-winning journalist Bao Choy announced that she would appeal against her conviction. The Hong Kong court has previously ruled her guilty of giving "false declarations" in connection with a car plate license search she made for a news documentary on the 2019 Yuen Long gang attack.

"I will regret for a lifetime if I give up pursuing justice. I won't be able to sleep at night," Choy wrote. "As a media worker, reporting facts and speaking the truth have always been my mission. As my city is falling apart, I expect myself to live in reality, with sincerity, honesty and integrity."

Huawei appeals Sweden's ban on company for selling 5G gear

On 3 Sep, Huawei said it had filed an appeal against a ruling by a Swedish court in June that upheld a ban on the Chinese company for selling 5G equipment in the country. Also, they had requested a hearing.

The Court of Appeal could decide if such a hearing should be held or a preliminary ruling from the European Court of Justice should be requested.

Former Reporter Charged with Rioting in Hong Kong: Losing the 612 Fund is Like Losing a Backing

Since 2019, the 612 Humanitarian Relief Fund have been providing financial support to the pro-democracry protesters arrested in the #AntiELAB movement in Hong Kong. On August 18, 2021, the Fund annouced that they would suspend their operation. Their record shows that there are still 1,274 ongoing cases as of May 2021.

Ari (a pseudonym), who was previously a #AppleDaily reporter and currently unemployed, was charged with rioting during the AntiELAB movement in 2019. She is one of the arrested persons receiving support from the 612 Fund.

She described the 612 Fund as a firm backing the arrested people who were unsure about their future and struggle to live normally. The Fund relieved part of their financial burden; however, after the suspension of the Fund, Ari would hesitate before filing a legal review, if she would be convicted.
