Sept 21, 2020 marks 14 months after the triad attack of civilians and pro-democracy protesters on July 21, 2019.

Tens of riot police entered and conducted stop and search in the shopping mall.

1918
Riot police intercepted civilians and reporters.

1922
Police cited the gathering ban to fine on-duty reporters.

1928
Police were still searching two young reporters inside the cordon.

1943
Reporters were ticketed for violating anti-pandemic measures, although the ordinance exempts people who are carrying out the duty of their profession.

#Censorship: Hong Kong Authorities Accuse Protest Documentaries of "Constituting Criminal Offences"

The Hong Kong government's Office for Film, Newspaper and Article Administration (#OFNAA), which is responsible for approving films and printed matters for public distribution, accused two local documentaries of "constituting criminal offences" for showing footages of the 2019 Anti-ELAB movement.

The two documentaries “Taking back the Legislature" and "Inside the Red Brick Wall" were produced by Ying E Chi, a veteran non-profit independent film organization in Hong Kong.

The documentaries captured the pro-democracy protesters' siege of the legislative council on July 1, 2019 and the siege of the Hong Kong Polytechnic University in November 2019, respectively.

Ying E Chi released a statement on Sept 21, 2020 and revealed how the OFNAA has made different attempts to bar the films from being shown in cinema. These included the request to re-edit; overturning past approved screening certificates; and classifying "Inside the Red Brick Wall" into a Category III film only 2 hours before its release.*

*In Hong Kong, Category III films are restricted to an audience above 18 years of age. In the case of "Inside the Red Brick Wall", Ying E Chi has to make refund to all underaged spectators.

Ying E Chi said the authorities has tried to "coerce the directors into making statements against their wills" and threatened to bar the films from screening.

Ying E Chi also expressed that "the opinion expressed in the statement issued by The Office for Film, Newspaper and Article Administration (OFNAA) does not reflect the views of the director and the production team".

According to Ying E Chi director Vincent Chui, four staff of the OFNAA were present to monitor the public screening on Sept 21, 2020.

Ying E Chi expresses strong disagreement as the OFNAA:

1. Force the films to be edited under the pretext of protecting everyone, but in fact, only to protect their own interest

2. Request an announcement to be made at the beginning of the film, yet refused to be declared as the one who demanded the announcement

The comments made by the OFNAA on the two documentaries are as follows:

“Taking back the Legislature”:
“This film records the serious incident of the storming of the Legislative Council Complex on 1 July 2019. Some of those depictions or acts may constitute criminal offences under prevailing laws.”

“Inside the Red Brick Wall:
“This film records the serious incidents at The Hong Kong Polytechnic University and nearby areas in November 2019. Some of those depictions or acts may constitute criminal offences under prevailing laws. Some of the contents of or commentaries in the film may be unverified or misleading.”

HK Government Skips Tendering and Awards Bank of China as Sole Partner to Payout $10,000 cash Allowance to Low-income New Immigrants

The Community Care Fund (#CCF) announced on September 21, 2020 the launch of the One-off Allowance for New Immigrants from Low-income Families Programme, with an aim to help them "adapt to community and to help ease the load of the immediate financial pressure".

Announcing the details at a media briefing, the Chairperson of the CCF Task Force, Dr Law Chi-kwong, said that the CCF has set aside around HK$2,131.04 million to kickstart the programme, and an estimation of 203,000 new immigrants will benefit from it.

Separately, Law stated that Bank of China Hong Kong (#BOCHK) was appointed as the sole agent bank of the project to disburse cash allowance within 8 weeks. He claimed that skipping the formal tendering process was to "shorten the processing time".

Overseas Hongkongers Organize Protest Art Exhibition Calling For International Attention on Worsening Situation in Hong Kong

A New York-based Hongkongers' group "NYC Sing With You" organized a 10-day exhibition titled "We Are All Heung Gong Yan [Hongkongers]". The exhibition is hosted by 393 NYC Studio from September 18, 2020 onwards. Works by over 20 artists and photographers from Hong Kong, New York, Paris and Australia are displayed.

Australian-Chinese artist Badiucao, known for his political cartoons, will show his documentary "China's Artful Dissident" on September 25 and 26.

#Whistleblower of MTR construction scandal, “HK has become a lawless city”

Jason Poon Chuk-hung, Managing Director of China Technology Corporation Ltd (#CTC), is also known as the whistle-blower who exposed rebar-cutting and shoddy construction works connected to Sha Tin-Central link MTR project. On September 21, the High Court handed down a bankruptcy order to CTC.

Poon explained that CTC has been facing oppressions from multiple fronts after he blew the whistle putting the company in grave business and financial pressure: over 300 lawsuits were filed against CTC within a year, more than HK$12 million fee in relations to government projects were overdue, while police refused to investigate the report of over HK$20 million construction materials being stolen in Hung Hom Station construction site.

Poon sighed that “Hong Kong has become a lawless city”.

Citing Section 81D of the Criminal Procedure Ordinance, the Hong Kong's Department of Justice (DOJ) sought clarification from the Court of Appeal on the principles of joint enterprise stemming from Elaine To and Henry Tong’s case, where the couple was acquitted of riotting, as the Judge said there was “no direct evidence against the defendants, although they were arrested near the site of clashes between protesters and the police”.

DOJ, however, took a different view. It reasoned that as illegal assembly and rioting activities are taking different forms nowadays, becoming increasingly fluid. Many “participants” of such illegal events do not have to show up physically at the scene, such as acting as sentry, drivers assisting protesters to escape, arms and equipment suppliers, members of material stations, or those responsible for brick-digging blocks away from a clash.

DOJ was reportedly attempting to stretch the interpretation of “joint enterprise” to cover all “indirect participants” of an illegal assembly or rioting, disregarding their presence at the scene.

Some members of legal profession explained, the essence of DOJ’s inquiry lies in alibi: even if a defendant is not present at the scene of an illegal assembly, he/she could still be charged over an illegal assembly or rioting offence, for example, by chanting slogans on the balcony of their home in support of an ongoing rally on the street.

Senior Counsel Hectar Pun confirmed that DOJ has applied to the Court of Appeal under section 81D of the Criminal Procedure Ordinance for the first time since 1997. Pun opined that it is a rare situation and outcome of which could have far-reaching implications for similar cases in the future.

Facing National Security Charges, Pro-democracy Youth Calls on Hongkongers to "Confront, Challenge and Defeat Fear" Together

In Hong Kong, the convenor of #StudentPoliticism #WongYatChin, together with two former members of the pro-democracy group, were arrested by the police on September 20, 2021. They were charged with breaching the #NationalSecurityLaw by "conspiring to subverting the state".

On the afternoon of September 21, 2021, Wong and former secretary #ChanChinSum were mentioned in court. Wong through his attorney wished Hongkongers a peaceful Mid-Autumn Festival and asked everyone to stay safe.

Wong said, "perhaps this is the test bestowed on me by the era. Hope that we can all live out our life bravely and courageously. May we confront, challenge and defeat fear together."

FAITH found on Mid-Autumn Festival

On the late evening of mid-Autumn festival on September 21, 2021, Mr Yin set off with his family to #FaiNgoShan (Kowloon Peak) to look at the full moon.

Approaching the "Suicide Wall", they saw a couple of citizens holding neon lights that read #Faith.

//RTHK has refused to comment on the whereabouts of its English-language radio presenter Hugh Chiverton after he disappeared from the airwaves without explanation over two weeks ago.

He last hosted the Backchat morning show on RTHK 3 on September 3. However, the episode remains missing from the online archive.

The topic of the programme was “#CivilSociety” and included former City University academic Joseph Cheng, Dr Lim Tai-wei of the National University of Singapore and Dr Eugene Chan – president of the Association of Hong Kong Professionals and a former RTHK board chairman.

According to a source familiar with the matter, Chiverton “was told he received an instruction that he could no longer host the programme anymore” following the civil society episode.

Chiverton’s disappearance from #Backchat is the latest controversy since a new Director of Broadcasting with no previous media experience took the helm in March. Since then, RTHK has also scrubbed its online archives, purged its Twitter account, launched a chat show hosted by Lam, and issued directives to staff to use Beijing-approved wording.

Lam has also announced a partnership between the broadcaster and Chinese state media CCTV to air more mainland-produced shows to instil a sense of patriotism among Hong Kong viewers...//

Hong Kong's #ChiefExecutive Carrie Lam met the media before attending the Executive Council meeting on the morning of September 21, 2021 and was asked about a Reuters report published the previous Friday, Septrmber 17, 2021, regarding Beijing’s pressure on Hong Kong property developers.

At first, she said that “I cannot confirm nor comment on this since they are all rumors.” She followed by saying that Beijing is very concerned about the livelihood of Hong Kong people. After they have “improved” the election system, they hope to enhance the effectiveness of the SAR’s governance. “After improving its effectiveness, of course they would want to help solve problems for the public.”

She added that the housing issue has been substantially adjusted by the current government, and now the remaining issue is the land issue.

“The current issue is a land problem. It is true that the developers have some privately own land, but when it is necessary, public powers can be exercised to recover some of these lands to develop public housing. Thus, solving a problem that has been bothering the city for a long time.”

[Editor's note: The National Communications Commision of #Taiwan has confirmed the same result of Chinese censorship in China-made mobile phones in the findings released on January 6, 2022. Taiwan conducted a similar investigation after Lithuania published their report on September 21, 2021 as below]

#Lithuania's #DefenseMinistry recommended that consumers avoid buying Chinese mobile phones and advised people to throw away the ones they have now after a government report found the devices had built-in censorship capabilities.

Flagship phones sold in Europe by China's smartphone giant Xiaomi Corp (1810.HK)have a built-in ability to detect and censor terms such as "Free Tibet", "Long live Taiwan independence" or "democracy movement", Lithuania's state-run cybersecurity body said on Tuesday.

The capability in Xiaomi's Mi 10T 5G phone software had been turned off for the "European Union region", but can be turned on remotely at any time, the Defence Ministry's National Cyber Security Centre said in the report.

"Our recommendation is to not buy new Chinese phones, and to get rid of those already purchased as fast as reasonably possible," Defence Deputy Minister Margiris Abukevicius told reporters in introducing the report.
