When Pro-Democracy Lawmakers Are Ousted: The Spectre of Beijing Looming Before Hongkongers' Last Line of Defence

It was the second time in just over a week that Beijing had called for pro-democracy legislator and barrister Dennis Kwok to be prosecuted.

On April 21, the PRC State Council's Hong Kong and Macau Affairs Office (HKMAO) issued a fresh statement accusing Kwok of breaching his oath of office and warning that nobody would "expect Beijing to sit idly by". Many including Kwok himself believed that Beijing will try to get him ousted from the legislature, despite that this is a breach of the One Country Two Systems policy.

Kwok conceded that "the writing is on the wall" for him as a lawmaker, and urged the people of Hong Kong never to give up their fight for democracy and freedom being as they are "the last line of defence".

"The Central People's Government are now exercising their so-called 'comprehensive jurisdiction' over every aspect of Hong Kong domestic affairs," Kwok said.

He added that Hong Kong is now seeing the "complete demolition" of One Country, Two Systems, and he expects to be disqualified as a lawmaker as part of this process.

"As for myself, their intention of disqualifying me as a Legislative Council member is very clear. The writing is on the wall. Being able to have the opportunity to defend and fight for democracy, rule of law, and freedom for and on behalf of the Hong Kong people, this is the glory for me," he said.

"I will continue to do what God has called upon me to do to the very last minute, until I can no longer do it anymore... But my brothers and sisters who are here, they will not give up. And the Hong Kong people, I hope, will never give up. Because you are the only and last line of defence. If you give up, then we lose."

Ousted pro-democracy lawmaker wins legal challenge, Pro-Beijing lawmakers may appeal

Ousted pro-democracy lawmaker Lau Siu-lai won her legal challenge over the disqualification of her candidiacy in the 2018 LegCo West Kowloon By-election.

Lau was removed from her office after Beijing interpreted the Hong Kong Basic Law and the court in Hong Kong retroactively ruled her seat invalid for not having taken her oath of office "solemnly". Lau tried to enter the by-election to take back her seat, but was barred by the Election Affairs Committee.

With the current ruling, pro-Beijing Yan Chan, who took over Lau's seat, is now ousted. However, Chan can still apply for an appeal before June 10.

Authorities Demand Ousted Pro-Demmocracy Lawmaker to Return Pay during Office

The Legislative Council Commission filed to the High Court a bankruptcy petition against Baggio Leung, a pro-democracy lawmaker who was ousted during the oath of office saga in 2016.

The Legislative Council Commission filed the petition as the creditor, requesting that a bankruptcy order be made against Leung. The application is scheduled to be heard on 2 December, 2020.

Leung had been removed from the Legislative Council after Beijing interpreted Hong Kong Basic Law. The Legislative Council Commission had then chased after his HKD930,000 salary for his brief tenure as a legislator. The Commission had won the case.

Legislative Council president Andrew Leung had stated last month that Baggio Leung had not been returning the debt punctually. The Commission then decided to apply a bankruptcy order for Baggio Leung.

230 Directly Elected #DistrictCouncillors to be Disqualified by HK Gov't

According to Cable News and Now News in Hong Kong on July 7, 2021, about 230 directly elected district councillors would face "#disqualification" by authorities, for not having taken an oath of #allegiance to uphold the #BasicLaw.

The government will reportedly demand the district councillors to return their entire salary received during the term they have served. The estimated amount per person is HKD1million.

Since one day ago, a resignation wave took place across different districts. These include Chan Shu-ying (Tuen Mun), Cheung Kwan-kiu (Kwai Ching), Lee Wing-shing (Shatin), Lo Chun-yu (Tuen Mun), Lee Chun-hei (Shum Shui Po), Yau Man-chun (Shatin) and Chan Siu-yeung (Shatin).

Paul Zimmerman: I will not immigrate and will keep trying

Since news has been spreading in Hong Kong that the government would disqualify the directly elected district councilors who did not take the oath of allegiance for the Basic Law and would demand them to return their entire salary.

A resignation wave has since taken place. As of July 12, 2021, at least 204 district councilors had left.

In the Southern District Council, there are only four members remaining. The vice chairperson #PaulZimmerman sighed, "Suddenly it's all gone, it's sad."

Zimmerman said he will not immigrate nor leave:

"I want to get good things done, that's the only reason I am here, changing the harbour, changing heritage, changing street market."
