Student Organisations Targeted, At Least 3 Former Members Arrested in Raids

The police have coordinated arrests in Yuen Long, Tai Wai, and Sha Tin this Wednesday night, arresting at least three former members of the now disbanded pro-Independence student organisation Studentlocalism, including former convenor Tony Chung Hon-lam, his significant other, and as well as former spokesperson Ho Nok-hang.

According to sources on-site, the police claimed that the arrested are suspected to have incited succession, in violation of Article 21 of the National Security Law and would be taken to Ma On Shan Police Station, which houses the police's Department for Safeguarding National Security. More may be arrested tonight.

Studentlocalism is a pro-Independence organisation found by students founded in 2016. Although having disbanded its local operations on 30 June before the National Security Law was implemented, its overseas divisions is currently still under operations, with its Facebook page continuing to post content related to the movement.

Other student organisations have also been targeted. The email address of a localist students group Ideologist and its spokepersons were logged in by unknown people via various phones (including, but not limited to Huawei, Xiaomi, and Samsung phones) in under an hour. The unknown personnel attempted to extract information from the account and even attempted to gain control over Ideologist's social media accounts. No members of this organisation have been arrested as of yet.

Judge Calls Out Prosecutor's Usage Of Half-truths As Evidence

A 24-year-old man was charged with wounding a police officer with intent at Causeway Bay (CWB) on July 1.

On the very same night, the police received an anonyomous call, tipping them off regarding the whereabouts of the accused.

He was intending leaving Hong Kong to London that very night. In the end, he was arrested on the plane. The prosecutor asserted that he attempted to abscond, and that he had bought a one-way ticket. The defendant's lawyer objected against the accusation, as the prosecutor already knew that accused had an electronic return ticket sent to his email, which was purchased by his girlfriend. The judge stated that the prosecutor was not telling the full truth based on the evidences gathered, and questioned the fairness and impartiality which was supposed to be upheld in the court.

Japanese Lawmakers Across Parties Motion to Freeze Assets and Bar Entries of Human Rights Offenders, Nathan Law Calls on Japanese Corp to Stop Aiding Hong Kong Police Crack into Phones

The implementation of the national security law in Hong Kong has prompted widespread response in the international community.

On July 29, Japanese politicians announced the founding of the "Japan Parliamentary Alliance on China" (JPAC) and released a human rights act draft bill to be introduced to the National Diet. The bill details the conditions and procedures targeted at human rights offenders worldwide, including the freezing of assets, barring of entry, and deportation.

At the founding meeting of JPAC, a clip by Nathan Law Kwun-chung, former Demosisto Standing Committee member in exile in the UK, was played. Law expressed that the support of Japanese politicians and society was very important for the Hong Kong resistance. He especially mentioned the global petition he initiated previously, which demanded that Israeli company Cellebrite stop providing service for Hong Kong police to crack into phones. As Cellebrite is owned by Japanese company Sun Corporation, Law hoped that Sun would cease offering phone hacking services to Hong Kong police as well. He also reiterated his plea to the Japanese government to not invite Chinese President Xi Jinping to visit Japan.

The members supporting Japan’s bill with regards to “specific human rights abuse” include Gen Nakatani, Akihisa Nagashima, Haruko Arimura, Kenzo Fujisue and Hiroshi Yamada of the governing Liberal Democratic Party, Shu Sakurai of the Opposition Constitutional Democratic Party of Japan, Shiori Yamao of the Democratic Party for the People, Seiichi Kushida of the Japan Innovation Party and Kazunori Inoue of Kibō no Tō.

Japan’s Liberal Democratic Party Urges Government to Impose Restrictions on TikTok and Other Chinese Apps

Nikkei Asian Review reported that Japan's ruling party, the Liberal Democratic Party (LDP), will urge the government to impose restrictions on apps developed in China, such as TikTok (Douyin’s international version), to maintain close cooperation with the US on security affairs.

According to the report, LDP members discussed with experts on the matter on 28 July and their proposal could be ready next month. Ex-cabinet member Akira Amari, who was in the discussion, said that if the government and corporations did not have a clear policy on security issues pertaining to sensitive information, they might be excluded from research, talent exchange programs and other schemes in the US and Europe."

TikTok currently has more than 10 million users in Japan, most of which are youngsters. The LDP planned to call on the government to impose restrictions on apps developed in China, design security review standards to safeguard technical and information security, and refrain from publicising the patent applications of military technologies. Under current practice, the Japanese government publishes the information of a patent application approximately a year and a half after receiving the application, and the information can be viewed by people outside of Japan.

According to the report, the LDP worried that while US-China relations continued to deteriorate, if Japan did not have a clear policy on technical, information and intelligence security, it might lag behind its western partners. The LDP also hoped to enhance cooperation between Japan and the international intelligence alliance the Five Eyes (The Five Eyes comprises of the US, the UK, Australia, New Zealand and Canada).

Chinese Hackers Infiltrate Vatican’s Computer System, Allegedly Stealing Information on September’s China-Vatican Negotiations and Gathering Intelligence on the Hong Kong Diocese and Pro-Democracy Movements

A cybersecurity company in the US discovered that Chinese hackers have been infiltrating the Vatican’s computer network in the past three months, allegedly stealing information related to the China-Vatican Negotiations in the coming September. Besides, the company said that hackers also infiltrated the computers of the Catholic diocese of Hong Kong, possibly stealing intelligence on its stance towards the Hong Kong pro-democracy movements and the relationship between the diocese and the Vatican.

Malware Found in Official Vatican Emails

Recorded Future, a private cybersecurity company based in Massachusetts, US, released a report on Wednesday (July 29), stating that Chinese hackers have been infiltrating the Vatican’s computer network, with intentions to steal relevant information ahead of China’s precarious negotiations with the Vatican. The Vatican and Beijing are expected to discuss the appointment of bishops, the status of the underground church, and other issues in September this year.

The report stated that the acts targeted at the Vatican were initiated by “RedDelta”, a hacker group supported by the Chinese government. This was believed to be the first instance where hackers working for China had been discovered, with their direct attack on the computer systems of the Vatican, the Catholic diocese of Hong Kong, and the Pontifical Institute for Foreign Missions coming to light.

Pleading for the First #NationalSecurityLaw Conviction -- Hongkonger Raises Sign in Silence: "If there is no jury, does #CommonLaw still exist?"

The first National Security Law case against 24-year-old Tong Ying-Kit resulted in a conviction on "inciting secession" and "terrorism".

On Jul 29, 2021 is the day for mitigation, and the sentencing is scheduled on Jul 30.

Michael, in his 70s this year, raised a sign he handwrote: "If there is no jury, does Common Law still exist?" at Taikoo Plaza and stood in silence.

In response to the conviction of Tong, he bluntly replied, "It's already expected" and criticized that "under Common Law, large cases that go to the High court must have juries present- why isn't there one all of a sudden?"

"The three judges collude with each other, and it is no different from Mainland China." He lamented, "Now there is no law. Rule of law is dead."

Michael predicted that Tong, "even without life imprisonment, will face more than 20 years [of jail]."

He also described that currently, "NSL rules us all," so action does not change much and he fears arrest. However, he still came out and expressed his sentiments. "I'm a hardliner- if you don't shout they'd think you're dead."

#NationalSecurityLaw Case in Hong Kong: Prosecution Cites Chinese Law Books to Assist Judge's Sentencing

The sentencing of Hong Kong's first National Security Law case is scheduled on July 30, 2021.

On July 29, the prosecution revealed that they had prepared Chinese law books for judges in Hong Kong court to review, believing that those sources were related to the case, and could provide strong support to the judges.

According to sources, the law books cited were written in simplified Chinese, named "Comprehension and Application of Criminal Law Provisions and Judicial Practice" (刑法条文理解适用与司法实务全书). However, the judges pointed out that those sources were for reference only. The interpretation of NSL would be based on Hong Kong's law principle. In regards to simulataenous sentencing, there is a large dispute among judges.

Tong Ying Kit pleads: I'm not a bad person, just did something very, very stupid

As "Inciting secession" and "Terrorism" are both serious crime, Tong, only 24 years old, is facing the highest sentence of life imprisonment.

On July 29, the Defence, in their plea, cited Tong's upbringing, the death of his parents, and his grandmother's cancer. If he faced a serious sentence, he would not see his grandmother for the last time.

The Defence expressed that Tong "is not a bad person, but did a very, very stupid thing and feels true remorse", and that "he knows he deserves punishment, but hopes the court can be light in sentencing."

The prosecution side, however, emphasized that according to the NSL, only when a suspect surrenders or exposes others can sentences be reduced.

Young men arrested for “sending angry emoji” targeting pro-China media outlet in Hong Kong

On July 29, Hong Kong police arrested two men over a suspected media boycott campaign. The 18-year-old and 26-year-old were allegedly connected to a Facebook group that contained intimidating messages against a media firm and the Police Force.

The two men were accused of inciting others to attack staff from the firm, police officers and their relatives, as well as on suspicion of conspiracy to commit criminal intimidation and inciting others to take part in unlawful assembly.

Reporters questioned whether “boycott” and “sending angry emoji” are criminal offences.

Superintendent Wilson Tam, from the force's Cyber Security and Technology Crime Bureau claimed officers had gone through all the posts, targeting over 100 entities. The particular Facebook group had pressurised them to withdraw advertisements on that media organization, which could cause financial losses to the media company, or damage its reputation.

The Facebook page, “Boycott TVB”, responded to the case in the afternoon, stating that they are not connected to the those being arrested. The page reiterated that they have always been advocating via “peaceful, rational and non-violent” means for advertises to stop partnering with controversial media and oppose any means to damage media organizations, advertisers' personal or property.

Cabinet split grows over China’s role in UK’s electric car industry

A growing cabinet split has developed over China’s role in the UK electric car supply chain as the government wrestles over how to handle economic ties to the superpower, The Independent can reveal.

Senior Conservatives fear the UK is “falling into a trap” by handing over sensitive aspects of its “green industrial revolution” to a regime that threatens British security.

MPs who have sought to raise these concerns have found they are increasingly isolated, with the prime minister suggesting such fears are overblown, according to those familiar with the discussions.
