HK Police Arrest Two More Pro-democracy Lawmakers

Police have arrested pro-democracy lawmakers Lam Cheuk-ting and Ted Hui, of Democratic Party, at their respective homes on the morning of August 26, 2020.

Both Lam and Hui are accused of conspiracy to damage property outside of the Tuen Mun Police Station on July 6, 2019. In addition, Lam is accused of "rioting" on July 21, 2019.

[Editor's note:
Ted Hui has recently filed two private prosecution cases against a driver who rammed into a crowd participating in a pro-democracy protest and a traffic policeman who shot an unarmed youngster with a live round.

Lam Cheuk-ting has been looking into the white-clad gangsters who assaulted train passengers and civilians during the Yuen Long 7.21 Attack.]

Pro-dem Lawmaker Lam Cheuk-ting arrested for "Rioting" in 721 Yuen Long. Author of "Yuen Long Darkest Night" raises doubt and concern

// Regarding Lam Cheuk Ting, my investigation in "Yuen Long Darkest Night" is as such:

At about 19:00 in July 21 2019, an eyewitness saw Lam Cheuk Ting and his colleagues, Chong Wing Fai and Kelvin Sin Cheuk-nam, cleaning up the street booth near Hennessy Road petrol station in Wan Chai, and told people to go home early to rest.

After 20:00, Lam and his assistants had dinner in a tea restaurant in Wan Chai, paying attention to the gathering of white-clothed people in Yuen Long's "Kai Tei" (Area around Kuk Ting Street), with more than five hundred triad members assembled. Lam Cheuk Ting, who grew up inFung Kat Heung, Yuen Long, was very concerned about the incident. After dinner, he decided to go to the middle point of Yuen Long and Sheung Wan- Mei Foo Station to be on guard.

The three of them watched the situation in Yuen Long through their mobile phones on the platform until the photo of Mr. So being beaten came out. At 22:22, Lam Cheuk-ting called Sergeant Tang of Yuen Long Police Public Relations Branch, requesting the police to arrive at the scene as soon as possible to enforce the law, and stated that he would immediately head to Yuen Long Station for incidence observation.

It takes 16 minutes to arrive Yuen Long Station from Mei Foo via West Rail Line. At 22:44, Lam Cheuk Ting and his two colleagues arrived. At the scene, a woman was battered after beaten at her head by a white mob. A scene from livestream video showed that a woman picked up a broken stick, apparantly used for beating civilians. Lam asked the civilians not to touch any evidence at the scene, and said that he had called the police and would wait for the police to come and search for evidence. At the same time, he stated that there were triad members gathering outside, urging the citizens not to go out of the gate. Meanwhile, there was a train arriving at the station. At that time, there were over a hundred men, women and children who were at a loss.

While everyone was discussing what to do next, the white-clothed people outside the toll gate gathered again and attacked the citizens inside the station. At that time, inside the station were civilians returning home from various districts. Between the confrontation of the two sides, Lam stood in the front row, and loudly declared to the white-clothed man that he had called the police: "The police will be here at any minute! Stay right here if you have the balls to!"

Until 23:02, the white-clothed men rushed into the gate again. Lam and the civilians were chased into train carriages and beaten violently. After several rounds of attacks, a large number of civilians were injured. The train drove to Siu Hong Station and Lam was sent to Tuen Mun hospital.

I have four questions:

1. Of course, the riot charges can generally refer to participation in an illegal assembly that "undermines social order." As a member of the Legislative Council, Lam, who was present to perform his supervisory duties, "destroyed social order"?

2. If Lam intended to "destroy social order", why did he take the initiative to call the police before and after his presence?

3. If Lam is accused of participating in the riot, does it mean that all the civilians present participated in the riot, but not the white-clads who launched the terrorist attack?

4. Is the arrest really based on sufficient evidence, or is it a political operation to arouse the public opinion that supports the police force? //

Police Arrest Pro-democracy Activists and Former Lawmakers Ray Chan, Chu Hoi-dick and Ted Hui

According to the Facebook pages of #RayChan, #ChuHoiDick and #TedHui, the three pro-democracy activists were arrested by the police at their homes on the morning of November 18, 2020.

The case was reportedly connected to the legislative council (#LegCo) meeting on June 4, 2020, where the three then-lawmakers protested against the third reading of the National Anthem Bill.

The police accused Hui of breaching the Legislative Council (Powers and Privileges) Ordinance Cap.382 with the charge of comtempt, as he spilled smelly liquid on the floor of the chamber and "caused the LegCo chair to feel disturbed and mentally distressed".

Chan and Chu resigned from the LegCo in Oct, as they refused to let the term be extended by the CCP without an election; Hui joined the recent mass resignation.

Hong Kong Police Arrest Two More Directly Elected District Councillors

On the morning of November 22, 2020, police arrested two directly elected district coucillors who belong to the pro-democracy camp. They are Henry Wong Pak-yu of Yuen Long and Lee Hin-long of Kowloon City.

Police suspected them of conspiring to defraud. Senior inspector Kwok Lai-yee of the Police's Commercial Crime Bureau said the concerned election campaign expenses of HKD 4.89m did not exceed the amount of HKD7.3m, which requires to be reported to the government; however, the police claimed that they would still be investigating as they received a complaint. According to the police, the case involves two people who were running for the functional constituency of the Legislative Election.

When the police were asked how they would prove their suspicion of fraud, the police insisted that they would look into it and stated that more arrests might be made.

In addition to the two district councillors, a former board member of the company "U Made This" was also arrested. The police claimed that they found some gun models in one of the arrestees' home. According to the assistant of Lee Hin-long, the police raided the councillor's district office in To Kwan Wan and took pictures of some pro-democracy greetings printed for
the Lunar New Year.

The two district councillors turned on live broadcast to record the police raid on social media platform, but were stopped by the police.

Former legislative councillor Lam Cheuk-ting pointed out this type of complaint should be handled by the ICAC, instead of the police. Moreover, pro-Beijing candidate Fong Kwok-san had reportedly spent over HKD2.6m during two days of her campaign. Lam commented that if that is the concern of the authorities, the two cases shall be treated equally.

#Taiwan President #TsaiIngWen: Staying true to my insistence on the value of democracy and freedom, I want to openly voice my support for Mr. Jimmy Lai

In a social media post on December 16, 2020, Taiwan's President Tsai Ing-wen talked about a recent photo of Jimmy Lai, the founder of Next Digital, who was charged with a suspected violation of the Hong Kong National Security Law.

In the photo, Lai was being handcuffed and entangled in a metal chain around his waist on his way to court. Tsai said that the photo was "infuriating".

Tsai said, "the Human Rights Day has just passed, but Hong Kong's human rights are still in its butter winter. Staying true to my insistence on the value of democracy and freedom, I want to openly voice my support for Mr. Jimmy Lai. I want to let him know that the whole of Taiwan, and the whole world are watching this scene. It is not Mr. Lai who was humiliated, but Hong Kong's freedom and the rule of law."
