China Detains 12 Hongkongers for Nearly a Month; Families Demand HK Authorities to Prove that Chinese Coast Guard didn't Enter HK Waters to Make Arrest

The families of the 12 Hongkongers captured and detained in China filed a formal report to the Hong Kong Police at Wan Chai Police Headquarters on September 20, 2020. The detainees include Andy Li who is charged with national security violation and pro-democracy activists.

Accompanied by legislator Chu Hoi-dick and pro-democracy activist Owen Chow, the families demanded the police to disclose more information on the arrests, which include the time and location of the arrest and the radar records of the locations of the Hong Kong marine police at that time.

The families want the police to prove that the 12 Hongkongers weren’t arrested in local waters by the Chinese Coast Guard.

They also demanded the Hong Kong officials to contact the detainees being held in China to check on their actual condition to ensure that they aren’t injured.

Last Sunday, the families had held a press conference calling for international attention. They lamented that they could not even know if their loved ones were still alive. The families condemned the Hong Kong government for refusing to offer assistance, failing to seek the return of the detainees and acting as the mouthpiece of the Chinese authorities.

Hong Kong Chief Executive Carrie Lam mentioned once that "it is not that simple", although legislator James To revealed precedent cases that Hongkongers charged with criminal offences who 'transgressed the border' were simply sent back by Chinese authorities. Secretary for Security John Lee reiterated what China had said that the detainees "had chosen their lawyers from a list provided by Chinese authorities".

On August 23, 2020, 12 Hongkongers had been intercepted by the Chinese Coast Guard and detained in China since then. They were barred from meeting their families or lawyers appointed by their families. The Chinese authorities insisted on assigning government-appointed lawyers to represent the 12 people, although the families had already hired lawyers. Worse still, the Chinese lawyers appointed by their families have been pressured by the law society and the local authorities in China to drop the case.

The Chinese authorities have been criticized for undermining human and legal rights.

Protests Continue in Thailand: Citizens Wear Respirator Masks and Wave HK's Black Bauhinia Flag

More than ten thousand people had a rally at Sanam Luang (Royal Field) on September 19, 2020. They demanded the resignation of Prime Minister Prayuth Chan-Ocha, and reform of the country’s Monarchy. Citizens have installed “People’s Plaque” proclaiming that the country belongs to the people.

After handing over a letter of demands, tho crowd dispersed. Student Leaders had given the message they would have another phase of protests.

As captured in pictures, the pro-democracy protestors in Thailand shared similar traits with those in Hong Kong. Some teenagers dressed in black wore helmets and gas masks. People held their hands to form a human chain. Some hoisted a Black Bauhinia flag and stood in solidarity with the Hong Kong protests.

Netizens have found that the air raid simulations in the video released by the Chinese military force resemble iconic scenes of some Hollywood films including The Rock (1996), The Hurt Locker (2008) and Transformers: Revenge of the Fallen (2009).

Detainee's Father Suspects HK Police Assisted the Arrest: HK Police Held My Son Whatsapp Record

Pro-democracy legislator Eddie Chu Hoi-dick said information about the 12 Hong Kong citizens has, so far, only been released by the Chinese authority. Although the HKSAR government is aware of the incident, they have never disclosed specific information as to where the arrest was made and at what time.

Chu pointed out that the Hong Kong Marine Police has 24-hour radar surveillance over Hong Kong waters. He doubted that the Police have been holding up information from the families of the detainees and general public.

The father of one of the detained youths who is called Cheng Tsz-ho told reporters that he went to Tsuen Wan Police Station on August 26, 2020 in person to report his son’s missing. The officers refused to take down the case, claiming it is a normal situation for people to go out of reach in a 6/7-day fishing trip on the sea. Police officers even showed to him history of his son’s WhatsApp chats as proof.

Cheng’s father said that it is “highly likely” for HK Police to watch over his son, monitoring his phone records and handing useful intelligence to the Chinese authorities to make an arrest.

He scorned the so-called “maintaining status quo for 50 years” as a fake commitment under Carrie Lam Administration. He reiterated the rights every Hong Kong citizen rightfully deserved. He believes that his son is in good health condition and he “can make it through”. He admitted that he was not supportive of anti-ELAB movement as it first sparked, even considered youngsters involved in the movement “trouble-makers”. He now has changed his view and he wanted to tell his son, “Well done, boy!”

Li Tsz-yin’s father reported his son’s missing to the Wanchai Police Station on August 28, 2020 where he was told that his son has been detained in China. Li’s father said it is hard for him to know for sure whether his son has been detained in Yantin Detention Center when they were not allowed to make any visit. He opined that if a face-to-face visit is prohibited, they should be allowed to reach out in alternative means, such as via a letter or a photograph.

Tang Kai-yin’s brother said the Hong Kong waters are under HKSAR jurisdiction. He urged Hong Kong Police to investigate. With regards to Chief Secretary for Administration, Matthew Cheung Kin-chun's claim that the Hong Kong Office in Guangdong has been in close contact with Chinese authorities on this matter for as many as 80 times, Tang’s brother said, the Office in Guangdong has been providing the same response to his inquiry all along, instructing him to pass his letter via Immigration Office which will then be passed to relevant Chinese authority.

Inside the Surreal Trial of the ‘Most Benevolent Terrorist in the World’

[Editor's note: A 24-year-old Hongkonger Tong Ying-kit was the first person charged with the National Security Law, after he rode a motorbike towards the police. He was convicted on July 27, 2021 of "terrorism and inciting secession". The court sentenced him to nine years in jail.]

//A Hong Kong judge has now spoken candidly with VICE World News about what they considered to be an alarming outcome in Tong’s case. As the de facto test case of the new law, Tong was found guilty of terrorism and inciting secession, for which he was sentenced to nine years in jail.

“Privately, I felt this case was unfair. This is not how the law should work,” the judge said during an exclusive interview.

Tong’s case offered a glimpse of a once-proud institution in a crisis of confidence.

The judge, who spoke to VICE World News anonymously due to the sensitivity of the matter, said that the court relied on a “questionable” understanding of criminal law concepts and sentenced Tong too harshly. That assessment was based on the judge’s prior experience, though they had no involvement in Tong’s trial.

“[Tong] didn’t do much of anything—he didn’t commit murder or arson,” the judge said wryly. “He is the most benevolent terrorist in the world.”//
